The 431st meeting of the Advisory Committee on-Reactor Safeguards was' held at-Conference Room 2B3, Two White Flint North Building,-

Rockville, Maryland, on May 23-25, 1995. The purpose of'this ,

meeting was~to discuss and take appropriate action on the items listed in.the attached agenda. The meeting was open to public attendance. There were no written statements nor requests .for time

-to make oral statements from members of the public regtrding the

I. CHAIRMAN'S REPORT (Open) .,

Dr. Thomas S. Kress, Committee Chairman, convened the meeting at 8 :30 a.m. and reviewed ~ the schedule for- the meeting. He' announced that-the Items of Interest for this meeting included a letter from Admiral de Mars, a copy of Chairman Jackson's speech to the Japan.

Atomic Industrial Forum, and a memorandum to all NRC employees, entitled Standards of Conduct, that apply to ACRS Members as well.

The Committee also ' agreed to - hold a brief discussion of Jay -

' Carroll's memorandum of - May 20, 1996 entitled "SECY-96-077 .-

% k 431st ACRS Meeting 2 May 23-25, 1996 Introduction Dr. Apostolakis, Chairman of the Individual Plant Examinations Subcommittee, introduced the topic and reviewed previous discus-sions related to IPEs. He also introduced representatives of the NRC staff and its contractor, the Brookhaven National Laboratory 1 (BNL). Dr. Apostolakis stated that the purpose of this information briefing was to review the ongoing staff ef forts to prepare the IPE '

Insights Report as a Draft NUREG. The primary focus of this  ;

meeting was the safety goal implications described in Section 7.1 of the Insights Report. That section provides an assessment of the l population of plants compared with the NRC safety goals as stated i in SECY 86-76.

Dr. Powers stated that he would not participate in Committee decisions on this subject because he has a conflict of interest.  !

NRC Presentation Ms. Mary Drouin, Chief, IPE/IPEEE Section, RES, led the discus-sions. Messrs. Wayne Hodges, Director, DST /RES, Thomas King, RES, and Trevor Pratt, BNL, provided supporting discussion.

Ms. Drouin provided an overview of the progress of the Draft NUREG

" Individual Plant Examinations Program: Perspectives on Reactor Safety and Plant Performance," referred to as "The IPE Insights Report." She noted that today's presentation was primarily on Section 7.1, " Safety Goal Implications." Significant points made during the discussion were:

e The NUREG under development has five main objectives:

1. Obtain perspectives on the impact of the IPE pro-gram on reactor safety.
2. Obtain a better understanding of reactor and con-tainment design and operational features, modeling methods and assumptions, significant plant improve-ments that af fect the core damage f requency (CDF) ,

and containment performance for different reactor and containment types.

3. Evaluate the role of the control room operator.

Determine what specific operator actions are con-sistently found to be important for classes of plants.

4. Evaluate the quality of the IPEs as compared to l current state-of-the-art probabilistic risk assess- i ments (PRAs) and the potential role of IPEs in l risk-informed regulation. I i
5. Provide perspectives on additional items, such as  !

IPE results relative to the Commission's safety  !

goals, and identify improvements as a result of the l Station Blackout Rule. Compare the IPEs to the i NUREG-1150 evaluation.

Mr. Carroll questioned wnc*her the report addresses shutdown risk )

and was advised that shutdown risk is not addressed. 1 Mr. Lindblad and Dr. Apostolakis ytestioned the definition of vulnerability. The staff defined minerability as an event i resulting in a CDF of 10" per reactor yesr; however, the facility-  !

specific definition was left up to each .?icensee. )

Dr. Apostolakis discussed the fact that the staff review did not  !

evaluate whether the modeling used by ir.dividual licensees was i adequate, only that the models were applied cons'.stently. I Dr. Kress questioned whether IPE results we2 e validated. The staff )

stated that the IPE results were accepted as reported by each  !

licensee. Dr. Kress also asked if any fc llow-up effort was in place to look at design vulnerabilities. Ms. Drouin responded that a meeting is planned with NRR to review this issue.  ;

At the conclusion of the briefing, Mr. Lindblad stated that he believed the IPE process was valuable in understanding the individual facilities and identifying safety weaknesses. Dr.

Miller stated the process is probably ve y good, and can result in better- informed decisions regarding reactor safety.

Dr. Apostolakis summarized his view that the operator has a significant role in actual events and that techniques for human reliability analysis (HRA) are improving. He also stated that future discussions on the IPE Insights Report including HRA will be held during a subcommittee meeting on June 11, 1996, and the subse-quent full ACRS discussion on June 12-14, 1996.

Conclusions The Committee plans to continue their review of this matter during future ACRS Subcommittee and Full Committee meetings.

Mr. James Carroll, Chairman of the Plant Operations Subcommittee, introduced the topic to the Committee, and reviewed previous discussions with the ACRS regarding the proposed rule on Shutdown Operations.

Mr. Carroll made the following comments: 1 e NRR is proposing to resolve this issue by rulemaking ,

rather than by use of a Generic Letter as was the case I the last time the Committee considered this issue.

o On August 13, 1991, the Committee wrote a letter comment-ing on the BNL and SNL risk studies at Surry and Grand Gulf nuclear power plants and stated that neither of the studies was a very good surrogate for the population of operating reactors. The Committee stated that shutdown risk is very plant-specific.

O Mr. Carroll stated that the NUMARC guidance document 91-06 has been used in the industry, and that dccument has improved the performance of plants durinsi shutdown operations. He stated that the staff also believes that, with some additions, the document could provide the basis for implementation of the rule.

NRR Presentation Mr. Warren Lyons, NRR, provided an overview of the proposed rule.

He characterized the rule as being risk-informed with performance-based elements. Significant points made during the discussion were:

e The proposed Shutdown Operations Rule and Regulatory Guide are being developed using a risk-informed and performance-based approach.

e The proposed rule will apply to all licensees who have light water nuclear power plants. The rule is structured into three operational areas: (1) safety criteria, (2) licensee-determined performance criteria for normal operation bounded by safety criteria, and (3) backup cooling capability and containment.

  • Shutdown operation is defined as the state when the reactor is subcritical, one or more fuel assemblies are

located in the reactor vessel or in the refueling cavity,  !

and the reactor coolant system temperature and pressure i permit operation of the decay heat removal system.  !

e Proper implementation of the guidelines in the NUMARC 91-06 document will satisfy the limiting conditions for operation. However, the staff does not believe that the NUMARC 91-06 document is sufficient to ensure uniform compliance by all licensees.

e The staff is revising the regulatory analysis and the associated Regulatory Guide, which support the proposed rule, to incorporate NEI comments.

Mr. Carroll stated that the Maintenance Rule should address the staff's concerns with shutdown risk. Mr. Warren did not think that -

the Maintenance Rule would address all the staff's concerns.

RES Presentation Mr. Harold VanderMolen, RES, provided a brief background'and the results of the risk studies performed by BNL and SNL at Surry and l Grand Gulf Nuclear Power Plants. '

Mr. VanderMolen stated that the staff's original interest in low power and shutdown risk was based on BNL and French studies which indicated that core-damage frequency (CDF) during shutdown could be significant. This project became part of NRC's research plan in 1 response to the Chernobyl accident in 1986. It was divided into two parallel studies performed by BNL and SNL. Surry and Grand Gulf were selected for these studies.  ;

The objectives of these studies were to assess the risks of severe accidents due to internal events, internal fires, internal floods, and seismic events initiated during various plant operational states other than full power operation, and to compare the estimated CDFs, important accident sequences, and other qualitative results with those resulting from accidents during full power oper tion as assessed in NUREG 1150. The scope of these studies included a Level 3 PRA for these plants. I Mr. VanderMolen stated that the results of shutdown risk studies in the Grand Gulf PRA showed a CDF in the " middle 10-5 per-reactor-year" range and for Surry, the CDF was in the " middle 10-5 per-reactor-year" range. The main finding of the study at Surry was that during mid-loop operation, the risk of consequence measures related to long-term health effects and latent cancer fatalities was high compared to those at full power operation. The main conclusion of the Grand Gulf study was that, with many plant features unavailable to mitigate a release, the potential exists

For the most likely accidents, the coni:ainment is open, the suppression pool is bypassed, and the containment sprays are not available. Members asked if Grand Gulf and Surry were typical of plants in the U.S.. The staff responded that the above-mentioned st.adies were plant specific.

i Nuclear Enerav Institute '(NEI) Presentation P Mr. Tony Pietrangelo, of the Nuclear Energy Institute (NEI),

provided industry comments on the proposed rule. He stated that the industry still questions the need for a shutdown rule. He also i

stated that NUMARC 91-06 was issued to provide guidance to the industry to assess plant management during shutdown.  !

NEI's concerns with the proposed rule include: (1) the establish-ment of outage planning and control requirements (this is seen as the purview of plant management) , (2) codification of NUMARC 91-06 (sets an undesirable precedent for future industry self-improvement initiatives), (3) the proposed rule overlaps with the requirements of the Maintenance _ Rule, and (4) additional regulatory oversight of shutdown conditions on the licensees.

4 Mr. Pietrangelo further stated that the risk analyses and event experience demonstrated by the staff do not reveal the problems.

Finally, Section (c) (4) of the proposed rule is not necessary.

Conclusion The Committee issued a letter to the Executive Director for Operations, dated June 4, 1996 on this matter.

IV. Dicital Instrumentation and Control Systems (Open)

Introduction Dr. Miller, Chairman of the Instrumentation and Control Systems and Computers Subcommittee, introduced the topic and recognized the Members and ACRS Consultant, Mr. Edward L. Quinn, who participated-in- the Subcommittee meeting held on May 22, 1996. He also introduced representatives of the NRC staff and its contractor, the Lawrence Livermore National Laboratory (LLNL) . Dr. Miller stated that the purpose of this meeting was to continue the ACRS review of staff efforts to update the existing Standard Review Plan (SRP)

Chapter 7 related to digital instrumentation and control (I&C) systems. He noted that the ACRS began its review of the proposed

l 431st ACRS Meeting 7 May 23-25, 1996 SRP update in March 1996 and stated that this ACRS review would cover two SRP sections, one branch technical position (BTP), and four regulatory guides which endorse four industrial standards. He 1 also stated that this meeting would complete the ACRS review of all '

draft regulatory guides and suggested that a Committee letter would be appropriate at this time.

NRR Presentation 1

Mr. Matthew Chiramal, Senior Level Advisor, HICB/NRR, introduced the NRC staff and led the discussion of the proposed SRP update (BTP and SRP sections) . Mr. Jerry Wermiel, Chief, HICB/NRR, and Mr. Gary Johnson of LLNL provided supporting discussion.

l Mr. Chiramal reviewed the ground rules for updating the SRP and ,

provided a detailed description of proposed SRP Section 7.2,  !

" Reactor Trip System;" SRP Section 7.9, " Data Communications;" and '

BTP-16, " Level of Detail in Design Certification Applications. "

Significant points made during the discussion were:

  • The ground rules include: maintaining existing regulatory bases; incorporating lessons learned from advanced light water reactor reviews, digital retrofits, and operating experience; and describing I&C system criteria for both  !

operating plants (modifications) and future advanced '

reactor designs.

e The SRP and regulatory guides will aid future reviews in that neither the SRP nor regulatory guides are proposed for backfit; the SRP, BTPs, and regulatory guides are guidance only; and they provide acceptable approaches for designers of digital systems for modifications and 10 CFR 50.59 safety evaluations.

e The SRP and regulatory guides will aid reviewers in that selected portions of the SRP can be used based on the scope of proposed changes; depth of review will be determined by reviewers based on safety significance and complexity of proposed changes; only the differences from previously approved designs need to be reviewed; and defense-in-depth and diversity are only applicable to reactor trip systems and engineered safety feature actuation systems.

e The planned BTP on commercial off-the-shelf software may be replaced by a safety evaluation report on a topical report being developed by a working group of the Electric Power Research Institute.

RES/LLNL Presentation

)

Mr. Joel Kramer, CIHFB/RES, summarized the overall RES/LLNL effort and introduced the presenters. Mr. John A. Scott, LLNL, led the discussion for RES regarding development of regulatory guides and I endorsement of industry standards. Dr. Frank Coffman, Chief, CIHFB/RES, provided supporting discussion and Mr. Robert Brill, CIHFB/RES, also participated.

Mr. Scott reviewed the draft regulatory guides on digital computer  ;

software used in safety systems of nuclear power plants for i developing life cycle software processes, software requirements  !

specifications, sof tware unit testing, and sof tware test documenta-tion. Significant points made during the discussion were:

i e The overall philosophy is to tie the regulatory guides to l existing NRC regulations and industry consensus stan- i dards. i l

e Each regulatory guide endorses one or more IEEE Standards  :

as a method acceptable to the NRC in meeting regulatory requirements. The NRC staff makes " exceptions, additions and/or provides clarifications" to portions of IEEE Standards which are not in agreement with regulatory I positions. These items were reviewed during the presen- l tation. 4 l

Drs. Apostolakis and Catton questioned the level of detail provided l in the guidance and how the reviewer will evaluate quality. The  !

NRC staff stated that the process _a intended for use by the reviewer but also serves to identify areas for consideration by the designer (i.e., licensee or applicant). The staff described the process whereby the reviewer is expected to use judgement in ,

determining the areas needing review on a case-by-case basis.

Dr. Powers questioned the consensus process used to develop industrial standards. The staff described the four-step process used by IEEE beginning with a standards working group, followed by subcommittee review and agreement, committee resolution of negative ballots, and final approval by the standards board. The staff also discussed the difficulty of pursuing alternatives to this approach.

Drs. Apostolakis and Powers questioned how controlling the process will lead to a system that accomplishes what is expected (i.e., the issue of process versus product). The staff stated that control-ling the process significantly enhances the likelihood that the product will perform as designed but added that there were no guarantees. They emphasized that testing provides verification that the installed system will function as designed (i.e.,

validates the adequacy of the product). Dr. Miller added that

emphasis on developing good requirements specifications will I

l significantly limit the errors discovered later in testing. The l staff stated that this was the best approach available but could not ensure error-free results. The staff offered to present a case study of an actual review at the next meeting to demonstrate the process. l At the conclusion of the briefing, Dr. Miller summarized his views on the SRP update and informed the staff that he was preparing a letter for consideration by the Committee. He noted that this letter would comment on the overall approach of the SRP and document ACRS issues (i.e., level of detail in the guidance, balance between process and product, etc.). He also reviewed plans for future ACRS Subcommittee reviews in August and October 1996.

Conclusion

The Committee prepared a letter to the Executive Director for Operations dated June 6, 1996, on this matter.

V. Reculatorv Review Grouc Recommendations (Open)

Introduction Dr. Seale noted that the Regulatory Review Group, established in early 1993, issued an August 1993 report that provided recommenda-tions for reducing the regulatory burden on licensees. He stated that most action items were complete and that the remaining action items were well in hand and had been assigned to specific entities within the agency for resolution.

NRC Presentation Mr. Eugene Imbro, NRR, presented an overview of how the Regulatory Review Group was formed and the accomplishments of the group. He summarized the Regulatory Review Group implementation plan that included the cost beneficial license actions (CBLA) program, the commitment management process, the marginal-to-safety program, the probabilistic risk assessment implementation plan, and proposed amendments to the regulations. He explained that the staff previously briefed the Committee regarding several ongoing implementation plan items such as graded quality assurance, risk-informed in-service surveillances and tests, and decommissioning.

In conclusion, Mr. Imbro stated that the Regulatory Review Group had been dissolved, that the existing management processes provided

  • 431st ACRS Meeting 10 May 23-25, 1996 oversight for ongoing items, and that management would track and periodically review the implementation plan status.

Mr. Imbro and the Committee discussed the assignment of responsi-bilities for implementation plan action items, commitment manage-ment, the number. of licensees that participated in the CBLA program, the benefits of regulatory reduction,.and the resources committed to the project. They also discussed verifying that the estimated safety impact of completed items was correct.

Conclusion The Committee issued a letter to the Executive Director for Operations' dated June 5, 1996 regarding this matter, j

VI. Meetina with the NRC Commissioners (Open)

The Committee met with the NRC Commissioners on May 24, 1996, in the One White Flint North Building, Rockville, Maryland. J The NRC Commissioners were briefed by and held discussions with the Committee on the following topics:

A. Use of IPEs in the regulatory process, PRA framework document, pilot applications, and the next steps to expand the use of PRA in the regulatory decision-making process B. Fire protection issues, including fire PRA models and PRA-based scoping analysis of degraded fire barriers C. Proposed final revisions to 10 CFR Parts 50 and 100 D. Status of ACRS review of regulatory guidance documents related to digital instrumentation and control systems.

E. Status of ACRS review of standard plant designs:

  • ABWR and System 80+ design certification rules e AP600 design e Test and analysis programs associated with the AP600 and SBWR designs F. Conformance of operating plants with NRC safety goals.

e 8 431st ACRS Meeting 11 May 23-25, 1996 Conclusion In the June 11, 1996 Staff Requirements Memorandum resulting from this meeting, the Commission requested that the ACRS provide advice on certain specific issues. The Committee will review these matters and report back to the Commission.

B. Reconciliation of ACRS Comments and Recommendations

[ Note: Mr. Sa'n Duraiswamy was the Designated Federal Official for this portion of the meeting.]

The Committee discussed the response from the NRC Executive Director for Operations to ACRS comments and recommendations included in recent ACRS reports:

EDO letter dated April 24, 1996, responding to the ACRS report dated March 15, 1996, concerning the review of recent fire probabilistic risk assessment reports by Brookhaven National Laboratory and certain fire barrier issues.

The Committee decided that it was satisfied with the EDO response.

During the 430th ACRS meeting, ACRS decided it was satisfied with the March 22, 1996, EDO response to the February 26, 1996, ACRS letter on strainer blockage issues. Mr. Lindblad raised a concern regarding actions in the EDO letter not being implemented in the final NRC Bulletin as decried in the EDO letter. Mr. Len Sofer, OEDO, agreed to provide a response to ACRS concerns.

C. Report on the Meeting of the Planning and Procedures Subcommittee (Open)

The Committee heard a report from Dr. Kress on the Planning and Procedures Subcommittee meeting held on May 22, 1996. The following items were discussed:

1. NEW ACRS MEMBER The Commission approved the appointment of Mr. John J. Barton to fill the vacancy created by the re-tirement of Mr. James C. Carroll in June. The Commission requested the screening panel to recom-mend names for the ACRS vacancy in September.

2. JOINT ACRS/ACNW SUBCOMMITTEE ACNW approved a letter to Chairman Jackson on the health effects of low levels of radiation. The  !

j letter has been forwarded to the ACRS for consider- '

ation. Dr. Larkins proposed that a presentation l (1/2 hour) and discussion of the letter be sched- ,

l uled for the June 12-14 meeting. Any changes made l by the ACRS could then be provided to the ACNW for  ;

i consideration during their meeting on June 26-28. i ACNW has proposed to change the date of the next Joint Subcommittee meeting from August 5-6 to .

August 20 and for ACRS Joint Subcommittee members to participate in a discussion of Expert Judgment on August 21 as part of the ACNW meeting.

RECOMMENDATION The Subcommittee recommended that a presentation be made before the Full Committee at its June 12-14 i

1996 meeting and that the ACNW letter be discussed following the presentation.

The French responded f avorably to the ACRS proposal for a quadripartite meeting, suggesting that it be held in 1997 and proposing agenda items.

The Canadian Advisory Committee on Nuclear Safety has agreed to meet with the ACRS in Rockville on i

RECOMMENDATION The Subcommittee recommended that the Full Commit-tee discuss the proposed agenda for the quadripar-tite meeting, to be followed by a letter to the i three other participating committees containing the ACRS proposed agenda. The letter would recommend .

meeting, as Japan would be the host country.

5. POLICY REGARDING POTASSIUM IODIDE A draft st&ff paper on a proposed change in policy concerning the use of potassium iodide states that ACRS agrees with the staff's recommendations, although the ACRS has n a reviewed this issue. The Subcommittee was asked ehether 1) the staff should be asked to correct the record, 2) ACRS should re- i view the policy change and take a position, or 3)

ACRS should do nothing further.

RECOMMENDATION The Subcommittee recommended a presentation on this issue to the Full Committee, followed by a letter if appropriate. The Full Committee Members were requested to suggest appropriate speakers for the presentation and indicate the issues they wished to have covered.

6. MEMBERS' ISSUES e A message from William Lindblad to T. S. Kress questioned the change of meeting dates for the summer meetings.
  • A memorandum from James C. Carroll recommended that Members interact more frequently with summer interns.
