REQUEST TO INITIATE RULEMAKING 10 CFR PARTS 50.72 AND 50.73
'b Your October 31,1991 memorandum requested my approval to initiate rulemaking actions to revise Parts 50.72 and 50.73. This action would delete certain notification and reporting requirements therein that are not adding meaningfully to NRC's understanding of operating reactor safety. The principal changes you envision in this rulemaking would involve deletion of reporting requirements for invalid actuations (random or spurious in nature) which have been determineu not to be of actual or potential safety significance and which should ultimately result in an estimated 5-10%
reduction in reported LERs.
I approve initiation of this rulemaking. -It is understood that _the lead rulemaking responsibility rests with AE00 because of the current workload in RES. In giving this approval, I would offer the following comments.
1.
This proposed rulemaking action is consistent with and responsive to NRC findings from the Regulatory Impact Survey.
The September 1991 issuance of NUREG-1022, Rev.1-(draft) for public 2.
comment will likely need to be revised again to reflect completion of the rulemaking action proposed-above.
In the interests of resource-savings, AE00 should, to the extent practical, take into account in its rulemaking action the public comments received on the proposed NUREG-1022,= Rev.1-(draft). The final NUREG publication should be synchronized with the final rulemaking changes to Parts 50.72 and-50.73.
This will likely obviate the apparent OGC concerns-about-- keeping a separate track for each action absent-the final rule' revision's being in
-place.
3.
AE00 should explore ways to further ensure a timely final rule
_ publication and that minimize the estimated 1.5 FTE (total) expenditure-planned for Parts.50.72 and 50.73 revisions.
