SUBJECT:

QUARTERLY UPDATE OF THE HEGULATORY AGENDA The Division of Freedom of Information and Publications Services, ADM, requires your input to prepare the quarterly update of the NRC Regulatory Agenda for April through June 1992, the second quarter of this cairndar year. Attached are copies of- agenda entrica for the ru?<> and petitions for rulemaking (PRM) for-which your office iu cesponsible that were included in last quarter's Agenda. Also attached are instructions for updating and adding Agenda entries. Please provide the required material to ADM and to RES by July 3, 1992.

The NRC Regulatory Agenda is used-to indicate those rules that have received the Executive Director for Operations' (EDO) initial approval or annual reapproval for continued development.

In offices subject to the EDO's purview, only those rules'that have received his approval may be developed and may-appear in the agenda.

Additionally, the EDO's procedures on the subject of timely resolution of PRMs require that each office under his purview report quarterly on the status of each PRM to the Rules at.d Directives Review Branch. The EDO requires that the renolution of new PRMs should not be later than 12 months _from the date of publication of the notice of receipt.in the Federal Register.

Any extension of a PRM resolution date aust be approved by the.

EDO in advance. Your response must indicate any proposed extensien of a PRM resolution date, the new proposed date, and the specific reason (s) for the proposed extension. The reason (s) must be provided in sufficient detail to enable the EDO to monitor the action that has been taken to date and to detcimine whether or not to grant the request ~for an extended resolution L date, l

g. whether the rule is subjec- to a legal doodline, either statutory or judicia), and whether this deadlino is for
a NPRM, a Final Rule, or some other action;
h. NRC resources and scheduling needed for the rulemaking;
i. the latest publication ni comment period datos;
j. the targot for Final Action on the rulo;
k. key intermediate milostones as approved by-the EDO (boginning of Division Review, completion of Otfico concurrence, submission of rule to EDO) for the present phase (ANFRM, NPRM, Final Rule) of rulemaking.

For each rulo now under development that has been approved by the EDO but was not included in last quarter's agenda, please provide the required information as a new agenda entry in the NRC agenda format.

InLaccordance with the EDO's procodures on the subjact of control of rulemaking and its timeliness, you are required to send a momorandum to the EDO for each quarterly updato of the NRC Regulatory Agonda, which either--

e cortifies that each rulemaking is on schedulo;

e indicatoo each rule for which, although the original ochedulo han olipped, the targot completion date will probably be met becauco of corrective actiono taken (pleace deceribo); or e indicaten each rulo for which the original schedule will probably not be met and providos the raanon for the clippage and a new target date for final action on the rule.
