TENTATIVE ISSUES r .

1. Averaging of Wipe Samples Old 173.397(a) allowed averaging of wipe samples over any 300 CMr area i of the package surface. _

2 New 173.443(a) makes no ment {on of Averaging over 300 cm , but mentions "In wiping an area of 300 cm '

2 Does this mean that Averaging within any 300 cm area is now precluded. ,.

2. Efficiency of Wipe Samples ,-

Old 173.397 set a limit then allowed for the wipe sample not to exceed ')~ ~

T6 percent of that limit:- BUT - allowed for other methods of equal or greater efficiency to be utilized, p'resumably other methods than wipe

. samples.

New 173.443 sets the limit on the wipe sample at 10 percent of the former

! efficiency to be used" - can this other method be wipe samples of demon-

) strated higher efficiency than 10 percent?

3. Exclusive Use/ Dedicated Vehicles Old 173.397 required surveys after a use of any exclusive-use vehicle,

. as a shipper requirement. This requirement was repeated in carrier sections 174.715, 176.716 (for LSA as full loads), and 177.843(a)

[forhig ay vehicles carrying exclusive-use shipments of unpackaged bulk 1.S A .

New 173.443 now requires the survey by the shipper for exclusive use vehicles carrying packages at the " factor of 10" contamination limits only. However, 173.443(d) has been added to incorporate the prior provisions of 174.715(b)and'177.843(b)for" Dedicated / Stenciled"

' closed exclusive-use rail or highway vehicles,- with the added .

, requirement that the package therein must not exceed the " factor of 10",

t presumably at the start as well as during transport. This added provisions is not however, currently reflected in the two carrier sections, 174.715(b)and177.843(b).

  • As a result of all this, a package must now start out at a " factor of
one" - then it may rise to a " factor of 10" in an exclusive use ship- -

li ment - unless the vehicle is a " Dedicated / Stenciled" closed vehicle, j wherein it may be at a " factor of 10" at the beginning of transport.

4. Performance of the Vehicle Survey at Destination Both the old and new rules require shipper survey after use as well as carrier surveys af ter use. NRC has a policy question of its own as to whether an enforcement action therein could be cased on substantiation of the violation by a third party, such as another licensee. What are DOT's views on this? Further, is it appropriate to retain the survey requirement in both the shipper.and carrier rules?
