Department. of Transportation Washingt:n, D.C. 20590 Decr~ I4r. Dugoff:

As we discussed, both the Department of Transportstion and the Nuclear Regulatory Comission have statutory responsibility for regulating the safe transport of radioactive materials. The Department of Transportation has published a final rule, Docket tio. h!4-169, to become effective July 1,1983, which amends existing rules covering radioactive materials transportatien to make them more compatible with the recomendations of the International Atomic '

Energy Agency. The Department's Federal Register tiotice of'liarch 10, 1983 ccr.cerning the amendments indicates tnat the effective date may be extended depending on the publication and effective date of corresponding amendments -

to 10 CFR Part 71, by the I uclear Regulatory .Comission.

The ';uclear Regulatory Comission has these rule changes under consideration with a decision regarding amendments expected shortly. Following a decision, a period will elapse before the rule can become effective. Since the rule enarges lar;aly involve procedural rather than public health and safety _

matters, anc in order to avoid unnecessary confusion by having differing .

federal stancards, we recuest that your Department consider delaying the effective date of its final rule until a decisien is made by the Comission on arending fiRC rules. If the Connission decides to publish rules similar to those of the De:ar: rent as is expected, our staff will contact your staff to arrive at a suitable early date for joint implementation. '

inank you for ycur consideration in this matter. You may be assured that tne Cemission will make every effort to expedite handling of this rule.

Sincerely, ,

p;gn @ g ,an 1.Dh:ks.
