1 l QUESTIONS CONCERNING I IFB NO. SECY-84-327

                                                                                                                                    \
1. Item 11 on page 13 of the IFB states that " Bidder shall list' three previous or current contracts for the same or similar services. Is it manbatory to list three contracts? If so, what are the-

' consequences if a bidder only has had one or two contracts? i Yes to the extent you can list three. To the extent you have t less than three, we will review those contracts listed. The 4 Government must determine that the prospective contractor is responsible before award can be made. Information obtained from the contacts listed will be used in making this determi-lj na tion. Please also refer to Item 12, page 14 of the IFB, li entitled

2. How many of the estimated pages shown on pages 20 and 21 of the IFB are attributable to Consnission meetings? ACRS meetings? Board hearings? Other meetings and conferences?

Speaking to pages of original transcript only, l; which are shown as Items 1(a) and 2(a) on Pages ) 20 and 21, our estimated page requirements are broken out as follows: ij

, tion." How is this term defined? Can orders ! be shif ted from a typed original to floppy disks by giving such orders to the reporter at the time 1 I of the meeting or hearing? l

*F l The term "if ordered before transcription," means that the requirement for a floppy disk record of the proceeding will be identified in the work order. To the second part of your ques-tion, the Comission will always order the typed original of the transcript. Floppy disks are copy sales.
4. What organization or organizations within NRC require floppy disks?
'L The estimated requirements are primarily for Comission meetings and hearings before the Atomic Safety and Licensing Board Panel.
5. Does NRC intend to make mag tapes from the floppy disks? If not, what is their intended use?

The answer is yes. l

6. Are the 17,500 pages for floppy disks original
  ' pages or copy sales?

' and vague. Please define these terms.

i We do not agree that these terms are too subjective,og vague. Please refer to the complete text of this subsection g., Legibility, pages 29 and 30 of the IFB. I 1

12. Under Article VI on page 35, 20 days is too long for acceptance. The current contract provision of eight days should be continued.
Article VI. Inspection and Acceptance, states preliminary
inspection and acceptance will be made by the Connission's receiving party but final inspection and acceptance shall be
; made by the Contracting Officer or his authorized representative. '

j Experience has shown that 8 days is inadequate for this purpose. Twenty days is required by the Government for final inspection and acceptance. .l l 13. Payment is tied to acceptance, that is, only i accepted work can be invoiced. That means the contractor must carry a 20-day backlog of work with payment occurring no sooner than 30 days after billing occurs. No small business can

! afford this cost of doing business. The present
j contract provision providing for payment upon ll delivery should be maintained.
f We acree that payment is tied to acceptance, as is the present contract. Final acceptance of services performed is required
; before payment can be made. Monthly invoices, as required
; under Article IX, Payment and Invoice Requirements, page 44 t

of the IFB, may be . submitted by the contractor for those ser-i i vices performed during the billing period. Those services l for which final acceptance has not been made or for those services which have been re.iected will be deleted from the I

invoice at the time the invoice is processed for payment.

Deleted items must be re-invoiced by the contractor in succeed- . ll i ing monthly billings. i 1 e

, The suggested revision will not be incorporated F

into the provision. At the time of rejection. - the contractor will be notified of the applicable contract specification under which the non-conforming work is rejected. Please note that Amendment One to the IFB changed 5 calendar days to read 5 business days.

15. Is rejected work subject to the penalty provisions of Article VII.A.? If so, how will the penalty 4 be assessed? Provide examples.

First, the reduction of price under the provisions of Article

VII.A., " Late or Defective Delivery " is not viewed as a penalty.

The reduction in price for late delivery or delivery of defec-1 tive work is a form of consideration flowing to the Government in exchange for giving up its right to timely receipt of work of the quality specified. Work rejected under Articles I.B.3.e. and l g. will be subject to reduction in price as noted in the pro- ,

. vision. The following examples are furnished:

Under Article I.B.3.e., Accuracy, pages 28 and 29 of the IFB, the contractor is required to furnish corrected { transcripts within 5 business days after notification of rejection. l If Daily copy was ordered: If replaced by 8:15 a.m.. the second business day, contractor will be paid at the 2-day rate. For deliveries after this time and within the 5 I business days, payment will be made at the 5-day rate. j If 2-Day copy was ordered: Contractor will be paid at the 5-day rate. l

. If 5-Day copy was ordered: For delivery made the next .

                                                                                              -p i.-
16. Questions 14 and 15 also apply to item (2) at the top of page 20. Please answer these questions in the context of item (2) at the top of page 28.

Does this latter section provide the definition i for rejected work under Article VI, section B? As indicated in our answer to Question 14, any work rejected

; will cite the applicable contract specification causing the j rejection. It is the contractor's responsibility to ensure j that all work submitted is in complete compliance with the l
% requirements of the contract. Work rejected for errors in the transcripts under Article I.B.3.e.(2) page 28 of the IFB.

is sub.iect to a reduction in price as discussed previously. The definition provided in Article I.B.3.e.(2) addresses specifically the worderror rate in delivered transcripts. Any portion of the contract work performed which is not in full cospliance with the specifications may be rejected.
