- I As you were sfreviously advised and as reflected in IFB NO. SECY-84-327 the NRC has a firm requirement for an electronic record of individual proceedings on floppy disks. The disks will have several applications,

- including primarily word search, connunications among NRC Headquarters
( and Regional Offices, and conversion to magnetic tape for use by the j Atomic Safety and Licensing Board Panel (ASLBP).
4 The estimated quantity of pages (17,500) for both the basic and option l

The estimate includes a small contingency of 500 pages.

- 1. Item 11 on page 13 of the IFB states that " Bidder shall list' three previous or current contracts for the same or similar services. Is it manbatory to list three contracts? If so, what are the-
' consequences if a bidder only has had one or two contracts? i Yes to the extent you can list three. To the extent you have t less than three, we will review those contracts listed. *F l The term "if ordered before transcription," means that the requirement for a floppy disk record of the proceeding will be identified in the work order. To the second part of your ques-tion, the Comission will always order the typed original of the transcript. Floppy disks are copy sales.
- 4. What organization or organizations within NRC require floppy disks?
'L The estimated requirements are primarily for Comission meetings and hearings before the Atomic Safety and Licensing Board Panel.
- 5. Does NRC intend to make mag tapes from the floppy disks? If not, what is their intended use?

- plately compatible with and capable of being successfully read and processed on this equipment.

j Experience has shown that 8 days is inadequate for this purpose. Twenty days is required by the Government for final inspection and acceptance. .l l 13. Payment is tied to acceptance, that is, only i accepted work can be invoiced. That means the contractor must carry a 20-day backlog of work with payment occurring no sooner than 30 days after billing occurs. No small business can
! afford this cost of doing business. The present

First, the reduction of price under the provisions of Article
- VII.A., " Late or Defective Delivery " is not viewed as a penalty.
The reduction in price for late delivery or delivery of defec-1 tive work is a form of consideration flowing to the Government in exchange for giving up its right to timely receipt of work of the quality specified. Work rejected under Articles I.B.3.e. and l g. will be subject to reduction in price as noted in the pro- ,
. vision. The following examples are furnished:
Under Article I.B.3.e., Accuracy, pages 28 and 29 of the IFB, the contractor is required to furnish corrected { transcripts within 5 business days after notification of rejection. l If Daily copy was ordered: If replaced by 8:15 a.m.. the second business day, contractor will be paid at the 2-day rate. For deliveries after this time and within the 5 I business days, payment will be made at the 5-day rate. j If 2-Day copy was ordered: Contractor will be paid at the 5-day rate. l
