Dear Ms. Bell:

This is in further response to your letter dated August 6,1984, in which you requested, pursuant to the Freedom of Information Act (FOIA), documents relating to NRC's staff and Commission consideration of the potential complicating effects of external events such as earthquakes upon emergency response planning.

The documents listed on Appendix B are responsive to your request.

Documents 4, 5, 6, and 19 have previously been made available at the NRC Public Document Room (PDR) for inspection and copying. Access to these documents may be acquired by referring to the accession number listed by each of these documents. With the exception of documents 13 and 14, which are discussed below, the remaining documents are being placed at the PDR in the file folder F01A-84-661.

Documents 13 and 14 contain information which is being withheld pursuant to Exemption 5 of the FOIA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Document 13 is a 13-page memorandum to S. Trubatch from C. W. Reamer regarding the Diablo Canyon Order on Earthquakes and Emergency Planning. This memo contains predecisional advice and recommendations regarding the licensing of Diablo Canyon.

Release of this memorandum would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. This document is being withheld in its entirety. There are no reasonably segregable factual portions.

Document 14 is a one-page memo to H. Plaine from S. Chilk regarding the requirements for and discussion of earthquakes and emergency planning for Diablo Canyon.

This memo also contains predecisional advice and recommendations regarding the licensing of Diablo Canyon.

Releasing this memo would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. The nonexempt portions of this memo are being placed in the PDR in file folder F0IA-84-661.

Other documents relating to earthquake activities in emergency planning have been previously addressed in response to your request F01A-84-795.

Pursuant to 10 CFR 9.15 of the Commission' regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. John C. Hoyle, Assistant Secretary of the Commission.

This denial may be appealed to the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

This completes NRC's action on this F0IA request.
