Dear Mr. Denton:

This letter is in reference to a July 10, 1984 telephone ~ conversation between Dan Fieno, NRC/0NRR, and W. H. McDowell, Duke Power Company / Licensing, concerning the McGuire Nuclear Station spent fuel pool two region rerack modifications.

. Duke Power Company intends and expects to utilize only Region 1 locations for storage of unqualified fuel assemblies, i.e. fuel assemblies which do not meet

the burnup criteria for Region 2 storage. However, in the-unlikely event that all Region 2 spaces are filled and storage of other unqualified fuel

. at:semblies is needed, a checkerboard storage configuration will be utilized in Region 2 for etorage of the unqualified assemblies.

The NRC had requested Duke Power to commit to physical blocks in the non-fuel locations during checkerboard storage. Initially Duke Power did not commit to this based on reasons described in a June 7, 1984 letter to H. R. Denton, NRC, from H. B. Tucker, Duke Power Company. In the July 10, 1984 telephone conversation, Dan Fieno stated the NRC's position on this topic and again requested that Duke Power commit to the physical blockage of non-fuel locations.

During this telephone conversation, W. H. McDowell agreed that Duke Power would commit to this restriction.
