PURPOSE This testimony treats intervenors' Contentions 21 and 21.C, which allege that LILCO's public information materials and EBS messages should be translated into Spanish.
As this testimony demonstrates, in conformance with NRC and FEMA regulations and guidelines, the LILCO Transition Plan provides for informational EBS messages and for periodic distribution of information to the public about how they will be notified and what their actions should be in the event of a radiological emergency at the Shoreham Nuclear Power Station.
The testimony further demonstrates that the guidelines suggest that translation of LILCO's'public.informa-i tion into Spanish is not necessary due to the small number of Spanish-speaking persons in the:EPZ.

The brochure and other printed educational materials which accom-i pany the LILCO Plan will not be read and/or J
understood by several segments of.the popu-lation, and the Plan therefore fails to com-ply with 10 CFR Sections 50.~47(b)(5),
50.47(b)(7) and NUREG 0654,Section II.B.1, E.5 and II.J.10(c).
Contention 21.C.
LILCO's materials are written exclusively in English.
Similarly,.
the EBS messages to be transmitted by WALK-in the. event of an emergency will be deliv-ered exclusively in English.
However, data-from the'1980 census show that there are more than 1,300-Hispanic' residents of the towns of Brookhaven and Riverhead who speak English either poorly-or not.at all. -These people will not understand either LILCO's
. educational materials or its EBS messages.

to a local broadcast station and remaining indoors), the principal points of contact with the news media for dissemination of infornation during an emergency (including the physical location or locations) are established in advance, and procedures for coordinated dissemination of information to the public are established.
NUREG-0654, II.E.5 State and local government organizations shall establish a system for disseminating to the public appropriate information contained in initial and followup messages received from the licensee including the 4
appropriate notification to appropriate broadcast media, e.g.,
the Emergency Broad-cast System (EBS).

NUREG-0654, II.G.1 states:
- 1. Each organization shall provide a coordi-nated periodic (at least annually) dissemination of information to the public regarding how they will be notified and what their actions should be in an emergency.
This information shall include, but not nec-essarily be limited to:
a.
educational information on radia-tion; b.
contact for additional information; c.
protective measures, e.g.,
evacua-tion routes and relocation centers, sheltering, respiratory protection, radioprotective drugs; and d.
special needs of the handicapped.
Means for accomplishing this dissemination may include, but are not necessarily limited to:
information in the telephone book; periodic information in utility bills; post-ing in public areas; and publications dis-tributed on an annual basis.

Q. How does LILCO propose to comply with the regulations and guidelines listed above?
A.

The LILCO Transition Plan provides for the activation of the Prompt Notification System and the Emergency Broadcast System to provide early notification and clear instruction to the populace within the plume exposure pathway EPZ.
The sample EBS messages contained in OPIP 3.8.2 are illustrative of the type of i
_-_ _ - - _ - -_ __ _ - ____ _ ___ __ _ _ informational messages that will be provided to the public in the event of a radiological emergency at SNPS.
LILCO also plans to distribute a public information brochure annually to all residents of the EPZ, to provide informa-tion in telephone books, and to place posters in public areas as methods of providing the public with information about how they will be notified and what their actions should be in an emergency.
The public information bro-chure will include information on radiation; a contact for additional information; information on the protective mea-sures available such as sheltering, respiratory protec-tion, relocation centers, and evacuation routes; and information for the handicapped about what provisions LERO has made for their special needs.

Q. The contention alleges that the 1980 census shows that there are more than 1,300 Hispanic residents of the towns of Brookhaven and Riverhead who will be unable to read or understand LILCO's public information materials because they " speak English either poorly or not at all."
What census data are the contention referring to?

Contention 21.C cites the 1980 census data as indicating that.the towns of l
Brookhaven and Riverhead have more than 1,300 Hispanic residents who speak English poorly or "ot at all.
We have reviewed the 1980 census data for the entire EPZ, including the towns of Brookhaven and Riverhead, and find that the data indicate that of the over 100,000 residents

of the EPZ, there are only 292 Hispanic residents in the i
EPZ who speak English either poorly or not at all.

is less than.3 percent of the population of the EPZ.

are only 292 Hispanic residents (of the over 100,000 resi-dents) in the EPZ who speak English poorly or not at all.
l In fact, Guidance Memorandum 20, issued jointly by the.
NRC and FEMA and entitled " Foreign Language Translation of.
Public Education Brochures and Safety Messages" (Attach-1 ment 3), states that " Licensees, States and. local govern-

i ments should provide public-education and.information l
(brochures and safety messages) translated into a. foreign
]
. minority language, if the number of the foreign population of voting age exceeds 5% of a surrounding county's or equivalent population."

As the census data in Attachments 1 and 2 to this tes-timony demonstrate, the percentage of EPZ residents of all l
l ages, as well as of foting age, who are Hispanic and who speak English poorly or not at all is far less than the 5%
figure at which NRC/ FEMA Guidance Memorandum 20 suggesto translation of public information materials is desirable.
In fact, even if LILCO were to adopt the figure used by intervenors of 1,300 Hispanic residents who speak English poorly or not at all, there would still be less than 5% of the population who would constitute a population speaking a single foreign language.

Q. Does LILCO plan to publish a public information brochure in Spanish or to broadcast EBS messages in Spanish?

No.
LILCO does not plan to translate its public information brochure into Spanish nor does it plan to broadcast EBS messages in Spanish; how--
ever, LILCO has taken reasonable and adequate steps to provide for non-English speaking Hispanics in the EPZ.

Q. What has LILCO done about people in the EPZ who may speak only Spanish?
A.

Each household in the plume exposure pathway EPZ has been sent a letter that includes 1
a statement in Spanish, printed in bold-faced type, asking i
people to advise LILCO if Spanish is their only language (Attachment 4).
A postage pre-paid postcard, also con-taining a statement in Spanish asking people tx). advise LILCO if Spanish-is their only language, was included with the letter for their replies (Attachment 5).
(English translations of the Spanish messages contained in the let-ter and postcard are given in Attachment 6.)
LILCO sent 42,000 letters to households.in the EPZ.
As of February 25, 1984, only 25 replies were received.
A Spanish translation of the letter and a translation.
of the postcard in letter form ~will be sent to the 25 Spanish-speaking households mentioned-above.
(Compare Attachments 4 and 5 with Attachments 7 and 8).
The letter:
that will be sent to Spanish-speaking residents of the EPZ (Attachment 7) informs them that an informational brochure concerning Shoreham will be forthcoming and that;they should inform LILCO of any special needs'they might have by means of the questionnaire and postage pre-paid enve-lope endlosed with the letter.
In this way, the Spanish-speaking residents will be alerted.tx> the f act that.the brochure contains'important information about Shoreham and'

- 10. Q. What else has LILCO done to ensure that Spanish-speaking residents of the EPZ are provided with adequate informa-tion about emergency planning for Shoreham?

Mailing lists for Spanish newspapers were checked to see whether there were any additional Spanish-speaking Hispanic families in the EPZ who did not return the postcard requesting information in Spanish.
The newspaper lists revealed the names of 45 ad-ditional residents of the EPZ who subscribe to the' Spanish newspaper but who had not requested the Spanish transla-tion of the informational letter.
Those 45 residents will also be sent the letter and questionnaire in Spanish (Attachments 7 and 8).

Guidance Memorandum 20 Joint FDiA/NRC Issuance Technological Hazards FOP.EIGN LANGUAGE TRANSLATION OF PUBLIC EDUCATION BROCHURES AND SAFETY MISSAGES Purpose This guidance me=orandum suggests when translation of public education materials into a foreign minority language is warranted and when other efforts should be made to afford foreign language minorities the same educational infornation as the general population.
Background
At a =eeting of the U.S. Nuclect Regulatory Comnission on September 18, 1982 and at a number of Atomic Safety and Licensing Board hearings thereafter, the issue of radiological safety education and information for foreign language cinorities living in the Plume Exposure Pathway EPZ has been raised.
Neither NRC nor FEMA has established guidance for when translation of public education' materials into a minority language should be required. The follow-ing is intended to establish such guidance.
[This guidance will be submitted to the NRC/FDIA Steering Conmittee for Emergency Preparedness for consideration as an addition to elenent G, Public Education and Information, of NUREG 0654/FD'A REP 1, when a revised edition is prepared. In the meantime, the following guidance will govern.]
This guidance takes the Voting Rights. Act of 1965 with Amendments of 1975 and 19E2 Oublic Law 94-73) as a point of departure. Under this law the Director of the Bureau of the Census is required to identify those States and political subdivisions where core than 5% of the citizens of voting age are members of a single language =inority.
Political subdivisions are defined by the Act as counties and independent cities, except for the follos-ing:

, Guidance Licensees, States and local gover=nents should provide public education end information (brochures and safety messages) translated into a foreign minority language, if the number of the foreign minority population of voting age exceeds 5% of a surrounding county's or equivalent populatica, Such a county or equivalent is covered under the Act and is. already under an obligation to provide bilingual ballots and voter services.
A list of counties covered under the Act based on the _970 Census is attached.
Periodic updates will be provided.
F.ecommendations If minority language individuals in the Plume Exposure Pathway EPZ do exceed 5% of the population and there are no foreign language materials not provided, other efforts should be made to afford them protecedon similar to that provided to the general population.
Such ef forts mignt include:
special courses of instruction for the foreign language o
co=nunity leaders public meetings featuring a trained foreign language speaker o
training leaders of neighborhood organizations o
o ~ advertisements in foreign language newspapers providing oral assistance to individuals through a. buddy system.
.o These ef forts should be adapted to local circumstances to achieve the purpose of the Public Information Program, i.e., to bring the population to a knowledge o* how they will be alerted and what they are eupposed to do, if a reactor acccident has occurred.

in the course of this work, we are also completing a brochure for people who live near Shcreham detailing the information you would need to have in "1e event of an accident at the plant.
Much of the information in the brochure will answer questions that many of you have raised about emergency preparedness planning for Shoreham. In the brochure we will include information about:
- 1. suggested traffic routes for leaving the area.
- 2. where people who do not have transportation can get a bus to relocation centers, and
- 3. where relocation centers, with food, beds and showers, are located.
In order to serve you better we must know about any special needs you or your neighbors may have.
