SUBJECT:

EMERGENCY OPERATIONS FACILITY (E0F) FOR THE TURKEY POINT NUCLEAR POWER STATION (SECY 83-111)

On April 8,1983, the Commission advised the Executive Director for Operations that they did not object to the staff approving a request by Florida Power and Light Conpany (FPL) for an exception to the E0F location of NUREG-0737 and directed the staff to inform FPL of the approval.

A copy of the SECY memorandum is enclosed for your information (Enclosure 1).

Since the Commission has agreed with thp staff position on this matter, I am v

requesting that you inform the licensee of the approval to establish an EOF 24 miles from the Turkey Point Nuclear Power Station.

A proposed draft letter to the licensee is enclosed for your consideration (Enclosure 2).

Dear Mr. Uhrig:

This responds to your letters of October 13,1981, July 2,1982 and January 4, 1983 wherein you requested that the NRC grant you an exception to Table 1 of Supplement I to NUREG-0737 with regard to the location of the Emergency Operations Facility (E0F) for the Turkey Point Nuclear Power Station.

On April 8,1983, the Commission approved your request for an exception.

Accordingly, you are hereby informed of the approval to establish the E0F for the Turkey Point Nuclear Power Station in the FPL General Offices in Miami, 24 miles from the plant site.

This approval applies only to the physical location of the Turkey Point E0F and does not apply to any other design features which will be reviewed by the NRC during a post-implementation appraisal of your facility.

This is to confirm.our agreement during our March 31, 1983 meeting with regard I

to obtaining information on the location and habitability of Emergency Operations Facilities (E0Fs). This need is in redponse to the Commission's desire to

review all exemption requests from licensees to Table 1 of Supplement 1 to NUREG-0737.

A copy of the Secretary's' Memorandum M830302B directing the staff to refer these exemptions to Comission is enclosed for your information.

As we agreed, Ed Williams of EPB will contact Walt Paulson of ORB #5 and verbally request any information he needs in order complete the reviews of the EOF design plan with regard to location and habitability.

Walt will call the approriate PM and ask him to obtain the information verbally from the licensee.

l The PM will ask the licensee to confirm any information which is not docketed in writing.

Walt will give the information he receives from the PM to Ed and will follow up the request with the letter from the licensee when he receives

it.

I believe that the number of requests of this type will not be large and that this procedure will be the most expeditious in obtaining the needed infonnation.

As a consequence of the last minute consultation with the Brunswick and Robinson Licensee on their E0F design concept wherein they are now going tL change their position thereby negating the need to develop a commission paper, we are asking you to have each PM contact his affected licensees to determine if the information 4

we have on hand reflects their current position in this regard.

This question should be asked in the context that any exceptions to the requirements in Table 1 of the supplement will be sent to the Commission for review.

Please inform us of any licensee that indicates he intends to change his position.

We appreciate your continued cooperation in assisting with this effort.

The Commiission was briefed by stafffon actions regarding the location and habitability of emergency operations facilities proposed by utilities.

A majority of the Commissiongexpressed a continuing desire to review all exemption requests; and directed staff to refer exemption requests and proposed staff action (grant or deny) to the Commission for decision on a negative consent basis.

Chairman Palladino, and Commissioners Gilinsky, Ahearne and Asselstine were in favor of this action; Cc =issioner Roberts dissented.

He preferred that the Commission review only exemption requests of special interest.
