SUBJECT:

Beaver Valley Power Station, Unit Nos. 1 and2 Docket No. 50-334, License No. DPR-66 Docket No. 50-,412, License No. NPF-73 Withdrawal of Certification of Permanent Cessation of Power Operations for Beaver Valley Power Station, Unit Nos. 1 and2 On March 28,2018, FirstEnergy Solutions Corp. (FES), the parent company of FirstEnergy Nuclear Generation, LLC (FENGen), announced plans to retire the Davis-Besse Nuclear Power Station (DBNPS), Unit No. 1; the Beaver Valley Power Station (BVPS), Unit Nos. 1 and 2i and the Perry Nuclear Power PIant (PNPP), Unit No. 1, due to severe economic challenges. ln correspondence dated April 25, 2018 (Ace,ession No. ML181154007), and pursuant to 10 CFR 50.82(aXl)(i) and 10 CFR 50.4(b)(8), FirstEnergy Nuclear Operating Company, acting as agent for and on behalf of FENGen, certified to the U.S. Nuclear Regulatory Commission (NRC) that FES intended to permanently cease power operations at DBNPS by May 31,2020; BVPS Unit No. 1 and PNPP by May 31,2021; and BVPS Unit No. 2 by October 31,2021. By correspondence dated July 26, 2019 (Accession No. ML19207A097), FES withdrew its "Certification of Permanent Cessation of Power Operations" for DBNPS and PNPP.

By NRC order dated December 2,2019 (Accession No. ML19303C953), the NRC staff approved the transfer of the operating licenses for BVPS, Unit Nos. 1 and 2 (including a transfer of operating authority and a transfer of ownership). By correspondence dated February 27,2020 (Accession No. ML200304440), the NRC staff issued the conforming license amendments for the transfer that identified Energy Harbor Nuclear Corp. as having operating authority for BVPS, Unit Nos. 1 and 2, and Energy Harbor Nuclear Generation LLC as having ownership of the units. These entities are subsidiaries of Energy Harbor Corp.

On March 13,2020, the new Board of Directors for Energy Harbor Corp. reversed the decision to permanently cease operations at Beaver Valley Power Station, Unit Nos. 1 and 2. Therefore, Energy Harbor Nuclear Corp. formally withdraws its "Certification of Permanent Cessation of Power Operations" for BVPS, Unit Nos 1 and2.
