Withdrawal of Ceft on of Permanent Cessation of Powe r Ooerations for Davis-Besse Nuclear Station. Unit No. 1. and Perrv Nucle ar Power Plant, Unit No. 1 On March 28,2018, FirstEnergy Solutions Corp. (FES), the parent company of FirstEnergy Nuclear Generation, LLC (FENGen) and FirstEnergy Nuclear Operating Company (FENOC), announced plans to retire the Davis-Besse Nuclear Power Station (DBNPS), Unit No.1;the BeaverValley Power Station (BVPS), Unit Nos. 1 and 2; and the Perry Nuclear Power Plant (PNPP), Unit No. 1 due to severe economic challenges.
ln correspondence dated April 25,2018 (Accession No. ML18115A007), and pursuant to 10 CFR 50.82(aX1Xi) and 10 CFR 50.4(bX8), FENOC certified to the U.S, Nuclear Regulatory Commission (NRC) that FES intended to permanently cease power operations at DBNPS by May 31,2020; BVPS Unit No. 1 and PNPP by May 31,2021; and BVPS Unit No. 2 by October 31,2021.
On July 23,2019, the Ohio General Assembly passed the Ohio Clean Air Program, which contains provisions for preserving Ohio's nuclear generation. The Ohio Governor signed the bill into law on July 23,2019. Based on the Ohio Clean Air Program, FES is reversing its decision to permanently cease operations at its Ohio facilities, DBNPS and PNPP. Therefore, FES formally withdraws its "Certification of Permanent Cessation of Power Operatior"ls" for DBNPS and PNPP. The "Certification of Permanent Cessation of Power Operations" remains unchanged for BVPS.
Beaver Valley Power Station, Unit Nos. 1 and 2 Davis-Besse Nuclear Power Station, Unit No. 1 Perry Nuclear Power Plant, Unit No. 1 L-19-185 Page 2 On October 22,2018, FENOC requested a license amendment for DBNPS that proposed changes to Sections 1.0 and 5.0 of the Technical Specifications to support a planned permanently defueled condition (Accession No. ML18295A289). FES formally withdraws this amendment request.
On February 5, 2019, FENOC requested a license amendment for DBNPS that proposed license and associated technical specification changes for a planned permanently defueled condition (Accession No. ML19036A523). FES formally withdraws this amendment request.
Also, on February 5,2019, FENOC requested a license amendmentfor DBNPSthat would revise the DBNPS Emergency PIan for the planned post-shutdown and permanently defueled condition (Accession No. ML19036A524). FES formally withdraws this amendment request.
On April 30, 2019, FENOC requested an exemption for DBNPS from certain record retention requirements that would no longer be necessary based on the planned permanently shutdown status (Accession No. ML19120A208). FES formally withdraws this exemption request.
Also, on April 30,2019, FENOC requested approval for use of a Decommissioning Quality Assurance Plan at DBNPS in support of the facility's planned permanently shutdown status (Accession No. ML19120A209). FES formally withdraws this request.
