1. Pursuant to the Atomic Energy Act of 1954, as amended, (hereinafter referred to as "the Act") and Title 10, CFR, Chapter 1, Part 50, " Licensing of Production and Utilization Facilities," the Atonito Energy Comission (hereinafter referred to as "the Commission") hereby issues a construction permit,,

supplied to an exieting 10 megawatt turbine generator, as described in the application.

D, The applicant may proceed to design and construct the facility described in the application and amendments thereto without further authoritation. However, this does not consti-tute final approval of any technical specification of the facility as distinguished from the generaldesign ocncept pro-posed. Before the license is issued to operate the facility, the Comionion must finally approve r11 technical specifica-tions. If the applicant desires final approval of any particular technical specification prior to the issuance of the license to operate, he may request that the Comission grant specific approval of rny technical specification by appropriate amendment to this permit.

2. This permit is provisional to the extent that a license authorizing operation of the facility will not be leeued by the Comission unless Saxton Nuclear Experimental Corporation has submitted to the Comission (by amendment' to the application) the complete, Final Hazards Summary Report (portions of which may be submitted and evaluated from time to time) and the Cocciosion has found that the final design provides reasonable

UNOLASSIFIED and upon a finding that the facility authorized has been constructed in conformity with the application, as amended, and in conformity with the provisions of the Act and the rules and regulations of the Commission and in the absence of any good cause shown to the Commission why the granting of a license would not be in accordance with the Act, the Commission will issue a Class 104 license to Saxton Nuclear Experimental Corporation pursuant to Section 104(b) of the Act, which license shall expire six years from its date of issuance or five years from the date the reactor first achieves criticality, whichever is earlier.
