FINAL RULE AMENDING NRC'S PART 110 REGULATIONS FOR THE EXPORT OF GASEOUS DIFFUSION ENRICHMENT PLANT COMPONENTS q
Attached for your signature is a final rule to be published in the Federal Register that amends 10 CFR Part 110 regulations pertaining to the export of specially designed nuclear components for use in gaseous diffusion enrichment plants (Attachment 1). The revised regulations add to Part 110 new l
definitions for these items that further clarify to exporters those specially designed components for use in gaseous diffusion enrichment plants. The i
purpose of the. clarification is to improve the administration of international export controls over these items.
This action is necessary to address the i
concerns of the Executive Branch and other governments that the current NRC regulations covering these components may present a potential proliferation risk.
It is an interpretative rule only. This action will conform NRC's-export regulations with the internationally accepted list of controlled export items as set forth in the Zangger Committee's guidelines.
Because these amendments involve a foreign affairs function of the United States, the Administrative Procedure Act provisions governing rulemaking do not apply to this-action (5 U.S.C. 553(a)(1)). Therefore, a notice of proposed rulemaking is not required for this action, and we recomend that the i
final rule become effective upon publication in the Federal Register.
Backfit Analysis:
The. staff.has determined that a backfit analysis is not required because the amendments do not-involve any provisions which would impose backfits'as definedin.10CFR'50.109(a)(1).
Notices:
A notice to the Commission that.the EDO has signed this rule is attached for inclusion in the next Daily Staff Notes (Attachment 2). The appropriate Congressional Committees will be notified (Attachment 3).
