HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING JULY 27, 1990 Seabrook On July 19, 1990, at 9:52 pm, Seabrook Station Unit I reached 100% power operation, producinc 1,150 megawatts of electricity, for the first time in its history. However, shortly after reaching full-power operation, operators had to lower reactor power to 90% because of steam generator level oscillations.

The oscillations were caused by inaccuracies in the heater drain tank level system. The system was fine-tuned and the plant was returned to 100% power on Sunday, July 23, 1990. The plant will remain at 100% power this week for continued power ascension testing.

Environmental Protection Rulemaking for License Renewal On July 23, 1990 an advance notice of proposed rulemaking on the coverage of environmental protection regulations for the renewal of nuclear power plant operating licenses was published in the Federal Register. A companion notice of intent to prepare a generic environmental impact statement was also published.

NRC's environmental protection regulations are in 10 CFR Part $1. The rulemaking will address, on a generic basis, the types of environmental impacts which may occur due to renewal of an individual nuclear power plant operating license and continued operation of the plant. The objective of the rulemaking is to generically dispense of as many environmental impacts as possible thereby narrowing the scope of impacts which must be treated during an individual nuclear power plant I

Office of Nuclear Reactor Regulation items of Interest Week Ending July 27, 1990 Comanche peak Unit 1 Comanche Peak Unit i reached 100% power for the first time on July 1.3, 1990.

The licensee successfully conducted its 100-hour warranty run from July 17, 1990 to July 22, 1990. A 50% load rejection was performed on July 24, 1990 and the last major test, a full trip from 100% power, occurred on July 26, 1990.

The plant was then shutdown for a one-week maintenance and repair outage.

Commercial operation is expected to begin about August 3, 1990.

Sequoyah, Units 1 and 2 A meeting was held in Rockville with Tennessee Valley Authority (TVA) on Monday, July 23, 1990, to discuss the errors in the 1987 calculation which determined the 15 " worse case" conduits. This meeting was postponed from Thursday, July 19, 1990, at the request of TVA.

The acceptable testing of these 15 conduits was part of the staff's basis to approve the restart of both units in 1988 from the extended shutdown in 1985. TVAdiscussed(1)the errors in the 1987 conduit selection calculation, (2) the corrective action programs to resolve the issue, (3) the QA program to explain why the 1987 calculation was not approved by TVA, and (4) the justification for continued operation (JCO) of the two Sequoyah units. The staff requested in the meeting and TVA committed and submitted a revised JC0 on Friday, July 27, 1990, based on the staff comments in the meeting.

Wolf Creek Gene ating Station On Monday July 23, 1990 Kansas City Power & Light Company (KCP&L) made an unsolicited $875 million bid to purchase all outstanding shares of each class of common and preferred stock of Kansas Gas and Electric Company (KG&E).

This action follows a number of previous merger proposals that have been made since 1983. The offer is scheduled to expire at midnight on August 20, 1990.

KG&E has not made any formal comment on the takeover bid and is evaluating the offer.

On Tuesday, July 24, 1990, J. Michael Evans, Senior Vice President and Chief Operating Officer of KCP&L met with senior NRR management and OGC personnel.

During this meeting he provided a copy of the SEC and FERC filings along with a letter to both Chairman Carr and Dr. Murley stating KCP&L's intention to maintain the operation of Wolf Creek in the status quo without changes to WCNOC or WCNOC management.

Interagency Working Group Meeting Several members of NRR's Vendor Inspection Branch attended the third meeting of the interagency working group on " Problem Parts and Suppliers" at the Department of Defense facilities in Arlington, Virginia, on July 20, 1990. The purpose of the meeting was to obtain an update of the activities of the various govern-ment agencies in the area of problem parts and suppliers since the last meeting in April, and to continue the discussions on the method to be established for rapidly communicating such information to other potentially affected Federal agencies. The discussions indicated that the other agencies are developing their internal policies and procedures for the identification and dissemination of this type of information, and GIDEP, the vehicle selected for informing other agencies, has made progress in establishing the system and procedures to be used. A subcommittee, which includes an NRC representative, was appointed to develop the special guidelines for the member agencies to provide vendor-related information to GIDEP, facilitate its distribution, and limit access to the mem'oer agencies in view of the sensitive investigatory nature of the information. The next meeting for the working group is planned for mid-October.

The Vendor Inspection Branch volunteered to host the next interagency meeting.

Salem Main Steam Isolation Valves Closure The design basis for the Salem main steam isolation valves (MSIVs) is that the valves will close within the Technical Specifications required fast closure time with main st9am pressure above 100 psig. The licensee's calculation indicated that actually a minimum main steam pressure of 250 psig is necessary s

to achieve the required fast closure of the MSIVs.

However, the calculated main steam pressure following a main steam line break (MSLB) before the required MSIV closure is less than 250 psig. The licensee's preliminary conclusion is that the MSIVs at Salem Units 1 and 2 could not satisfy their designed safety function and meet the requirements specified in the Salem Technical Specifica-tions.

Motor-Operated Valve Action Plan On April 18, 1990, the NRC staff held a public meeting to discuss the results of motor-operated valve (MOV) tests conducted as part of the resolution of GenericIssue87,"FailureofHPCI(HighPressureCoolantInjection) Steam Line Without Isolat1on." The testing program included blowdown tests of typical MOVs used for containment isolation in the steam lines of the HPCI and Reactor Core Isolation Cooling (RCIC) systems, and in the supply line of ENCLOSURE A JULY 27, 1990

the Reactor Water Cleanup (RWCV) system at BWR plants.

Following a staff survey of 6 BWR units to determine the capability of the MOVs installed in those lines, the BWROG agreed at a May 24, 1990, meeting to survey the remaining BWR plants to obtain information on the applicable MOVs in the HPCI, RCIC, and RWCV systems.

From our evaluation of the BWROG-supplied MOV data, the staff has determined that a concern exists regarding the capability of certain MOVs to perform their design function to isolate a downstream pipe break.

Senior NRR management met on Ju'y 19. 1990, to discuss the need for regulatory actions to be taken in response to the staff's evaluation of the MOV data. As a result of that meeting, the staff developed an action plan to address the MOV operability concerns. On July 20, 1990, the staff briefed the NRR Executive Team regarding the action plan, j

Group (RRG)pproval of the plan, the staff activated the BWR Regulatory Respon Following a assessment on mitigating factors regarding potential MOV deficiencies.

Further, the staff is performing a sensitivity analysis on the NUREG-1150 models based on the MOV deficiencies to gain insights on this problem and will determine the need for more detailed modeling. The staff is currently preparing a draft 50.54(f) letter which will be discussed with the BWR RRG on August 1.

implementation of the Safeguards Agreement between the United States and the International Atomic Energy Agency (IAEA). The principal topics of j

discussion were the status of IAEA's implementation of short notice random

8 HIGH-LEVEL WASTE mat!AGEMENT NRC/ DOE Meeting on' Quality Assurance (QA)

StafffromtheDivisionofHigh-LevelWasteManagement(HLWM)metwith

- representatives of the U.S. Department of Energy (DOE), the State of Nevada, Nye County, Nevada, and Clark County, Nevada, on July 19, 1990, to discuss items of mutual concern regarding QA. Among the topics discussed was progress DOE has made in the implementation of trending analysis for QA program deficiencies recorded during audits or surveillances.

LOW-LEVEL WASTE MANAGEMENT AND DECOMMISSIONING Fedeial Low-level Waste Disposal Facility In the July 24, 1990, meeting of the Low-Level Waste Forum in Minneapolis, Minnesota, a Department of Army representative discussed plans for consolidation of federal waste management responsibilities through a program to be administered by the Army.

Included in this plan is consideration for establishment of a federal low-level waste disposal facility separate from those currently)being developed by the States. All federal low-level waste (except DOE waste,

including some now planned by States for disposal in their facilities, could be disposed of in the federal facility. There are no firm plans at this time for such a facility, but it is one option being investigated by the Army. The Army is also negotiating an interagency agreement with DOE for their acceptance of federal wastes in the event commercial capability is unavailable.

Office of Nuclear Regulatory Research Items of Interest Week Ending July 27, 1990 Recently Issued Publication The NRC has issued a new guide in its Regulatory Guide Series. This series has been developed to describe and make available to the public such information as methods acceptable to the NRC staff for implementing specific parts of the Commission's regulations, techniques used by the staff in evaluating specific problems or postulated accidents, and data needed by the staff in its review of applications for permits and licenses.

Regulatory Guide 3.66, " Standard Format and Content of Financial Assurance Mechanisms Required for Decommissioning Under 10 CFR Parts 30, 40, 70, and 72," provides guidance acceptable to the NRC staff on the information to be provided for establishing financial assurance for decommissioning facilities licensed under 10 CFR Parts 30, 40, 70, end 72.

This guide also establishes a standard format for presenting the information.

Division of Engineering Regulatory Guide (DG-1009), " Standard Format and Content of Technical Information for Applications to Renew Nuclear Power Plant Operating Licenses" The regulatory guide (DG-1009) on, " Standard Format and Content of Technical Information for Applications to Renew Nuclear Power Plant Operating Licenses" was submitted for office level concurrence on 07/23/90. This W ets the schedule date stated in SECY-90-160, " Proposed Rule on Nuclear Power Plant License Renewal." The development of this R.G. has been closely coordinated with the RES staff involved in the license renewal rulemaking and the NRR staff involved in the development of the Standard Review Plan - Plant Life Extension (SRP-PLEX).

In fact, the issuance of the Draft Regulatory Guide was delayed to accommodate last minute changes in the SRP-PLEX. The draft R.G.

(RES) and the SRP-PLEX (NRR) are planned to be submitted as a packags to.

the CRGR by the f,:nd of August.

Possible Joint Research Exchange Program RES staff led by Mel Silberberg, Chief, WMB met with Dr. Steven Ragone, Acting Assistant Director for Research, USGS, Drs. Newell Trask, Chief, and Peter Stevens, Nuclear Waste Hydrology Branch, Water Resource Division, USGS, and Dr. David Russ, Geologic Division, USGS, on July 24, 1990 in Reston, Virginia to discuss the possibility of a joint research exchange program. The discussions involved review of existing NRC-USGS research interactions in hydrology, outlining of mutual research interests and specific projects, and establishment of a formal arrangement (i.e., MOV) for sharing information from the mutual researen progrems. One possible mechanism to be included in the MOU may involve the establishment of an annual technical workshop in the areas of hydrology, hydrogeology, geochemistry and some areas of geology.

The research exchange agreement would also allow NRC/RES contractors to meet directly with USGS research investigators to discuss timely research results and technical review of the mutual programs and pro'ects.

Individual plant Examination t ternal Every On July 25, 1990 a notice was published in the Federal Register regarding the availability of a draft generic letter and NUREG which address requirements and guidance for the external event portion of the individual plant examination.

The documents are being issued for a 90 day public comment period and a workshop is scheduled for September 11-13, 1990 in Pittsbergh, PA to facilitate discussion and comment on the documents.

Division of Systems Research Open Peer Review Workshop on NUREG/CR-4523, "The Probability of Liner Failure in a Mark-I Containment" 3

The NRC has supported research on the Mark-I containment drywell shell meltthrough issue for several years. As part of these efforts, the staff recently issued draft NUREG/CR-4523, (T. G. Theofanous et. al.) entitled, "The Probability of Liner Failure in a Mark-I Containment." On July 23-24, 1990, the NRC conducted an open peer review workshop in Harpers Ferry, West Virginia to discuss comments from the peer review group.

The meeting was generally considered a success.

Even the strongest critics felt that significant progress had been made in closing the issue.

Favorable opinions by most reviewers confirmed the strength of the methodology. Although the peer review group assessed the methodology favorably, there were questions concerning assigned probability distributions for components of the analysis.

An AE00 Engineering Evaluation Report, AE00/E90-06, " Potential for RHR Pump Damage," was issued on July 13, 1990. This study was initiated based on an event at Sequoyah which involved an RHR pump running deadheaded during a surveillance. low test.

In the test, both RHR pumps were in minimum flow, parallel operation when the discharge check valve _ of the weaker pump was. forced closed by the pressure of the stronger pump. The condition resulted in no flow through the weaker pump.

The review indicates that although Bulletin 88-04 had addressed the pump-to-pump interaction problem during miniflow operations, the loss of miniflow path due to closure of the pump discharge check valve had not been specifically addressed.

The potential for the adverse pump-to-pump interactions, which can cause the discharge check valve to close, may not be recognized during a surveillance test in which one pump is tested at a time.

Based on the results of this review, AE0D has suggested that NRR issue an Information Notice to inform the licensees of the above concern.

AE0D has issued-an Engineering Evaluation Report,'AE0D/E90-07, "Effect of Internal Flooding of Nuclear Power Plants on Safety-Related Equipment." This report documents the results of a review of internal flooding events during the period 1980 to 1989. These events have caused a loss of essential equipment of safety-related systems that are needed for decay head removal, plant shutdown and cool down and should be recognized as meaningful precursors to core damage accidents.

c Office of Governmental and Public Affairs Items of Interest Week Ending July 27, 1990 State Programs Low-Level Waste Forum Roland Lickus, Director, Region 111 State and Government Affairs, attended the Low-Level Waste Forum quarterly meeting on July 23-24, 1990 in Minneapolis, Minnesota.

Forum participants were briefed on the status of legal challences to the Low-Level Radioactive Waste Policy Act and Amendments Act, on cha N nges to North Carolina, Texas and Michigan siting efforts and on the Alabama hazardous waste case. The Department of Energy provided an update on technical assistance tasks for fiscal year 1991 and'there was discussion of the impact of new Department of Transportation regulations on LLW transportation. Paul Lohaus, LLOB, briefed the Forum on the status of NRC activities on database rulemaking, BRC, Agreement State guidelines, on-site disposal and NRC's storage policy. There were discussions on waste form and packaging, working with local communities, mixed waste, material vs. waste, financial assurances, Congressional update and State plans for environmental-assessments.

Several Forum Members requested further written clarification as to whether NRC had changed its position on authorizing storage of waste for periods of time up to five years, or longer, and whether NRC would authorize storage beyond 1996 while States completed development of disposal capacity. At the meeting, NRC staff responded to these questions indicating that the Chairman's response to Cindy Monaco did not preclude storage of LLW beyond 1996.

NRC recognized the need for short term storage while disposal capacity was being developed and would respond-to applications and authorize storage beyond 1996 on a. case by case basis.

In response, staff also specifically highlighted tne Chairman's response noting NRC's position that storage of LLW as a substitute for the development of new disposal capacity is inconsistent with the LLRWPAA and that that position applied to long-term storage used as a means to avoid the clear intent of the law.

Several Forum representatives requested confirmation of the verbal statement that NRC would consider requests for and authorize storage of LLW beyond 1996. Other Forum representatives recognized the delicate balance required of HRC in this matter and need for NRC to not affect State actions to develop new disposal' capacity.

Staff is presently completing a Commission Paper on the 1993 and 1996 title transfer and possession provisions of the LLRWPAA which focuses on the issues vf short-term interim and long-term indefinite storage of LLW. Any subsequent clarification can be considered and provided following action on that paper.

On July 24, 1990, SEC hosted a meeting of security and

Emergency Notification System (ENS) Failure at Vogtle Nuclear Power Plant

-The intermittent line problem between the Vogtle Nuclear Power Plar,t and the Emergency Operations Center was repaired on July 25. _Three separate problems were identified and corrected by AT&T. A component problem that

'y could' affect other plants was identified during this outage, and AT&T has been instructed to replace the components at all nuclear power plants having the-same brand of equipment.

UPS Service Suspended-The United Parcel-Service (UPS)'has notified the agency that UPS services may be interrupted on August 1, 1990.

During the past_several months UPS-and the International Brotherhood of Teamsters have been engaged in negotiations.for a new three year contract.

The current contract expires at midnight on July 31, 1990 - UPS cannot guarantee.that service will continue uninterrupted af ter July 31, 1990.

Effective Thursday July 26, the.HRC will suspend the-use of UPS until the. agency is notified that services are back to normal.

In the interim, service will be continued by Roadway Package Systems and the United States-Postal Service.

This action was based on the shipment of : package containing Barnwell, South Carolina with free standing liquid-(water)posal Site at irradiated waste from Millstone to the Low level Waste Dis in the package in~ excess of the regulatory limit. The adjustment factors in the Enforcement Policy were considered in determining.the amount of this civil penalty and the base amount of the penalty was mitigated by 50% due t' the. licensee's corrective actions and escalated by 50% due to the

.A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2,500 was issued on July 23, 1990 to High Mountain Inspection Service, Inc., Mills, Wyoming. This action was based on observations by an NRC inspector of failures to perform a required survey and conduct of radiography by an individual who was not under the personal supervision of a radiographer. Other violations involved recharging of pocket dosimeters and maintenance of records of tests and transportation of

. radioactive material. The base civil penalty was mitigated 50% for the licensee's past performance. (EN 90-069) 3.

_A Notice of-Violation and Imposition of Civil Penalty in.the amount of

$10,000 was issued on July 24, 1990, to Davis Memorial Hospital, Elkins, West Virginia. The action was based on 24 violations including but not limited to failures to: conduct Radiation Safety Committee meetings 5 separate calendar quarters, perform annual reviews of the entire radiation safety-program, train individuals frequenting restricted areas, assay iodine-131 doses prior to administering to patients, mathematically-calculate activities of radiopharmaceutical doses that were administered to. patients, properly determine molybdenum-99 breakthrough contamination, decontaminate, and limit radiation levels in unrestricted areas. The violations are of very significant concern as they indicate a lack of management oversight brought about by the careless disregard of the Radiation Safety Officer (RS0) for his= duties and responsibilities as' RS0 and chair of the Radiation Safety Committee. The escalation and mitigation factors in the Enforcement Policy were considered ai d on balance, a 150%

escalation of the base civil penalty was deemed appiopriate (50% escalation for NRC identification, 50% mitigation for licensee s prompt and extensive corrective action, 50% escalation for prior notice, and 100% escalation forduration). Since this was an initial inspection, the pau performance factor was not applicable. The enforcement correspondence notes that consideration was given to issuance of a suspension order.

Such an order was not issued because of the licensee's voluntary action to shut down its facility and the corrective actions taken.

The proposed civil penalty was mitigated by 50% for the extensive correc-tive actions undertaken after senior management became aware of the event.

It should be noted that the licensee has not been specifically informed '

The escalation and mitigation factors in the Enforcement Policy were considered and on balance, a 100% escalation of the base civil penalty for the unqualified user violation was deemed appropriate (50% for NRC identification, 100% for multiple occurrences and 50% mitigation for the licen,ee's good past performance). Adjustment based on other factors was not deemed appropriate.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $5,000.was issued on July 25, 1990 to Newman Memorial Hospital, Shattuck, Oklahoma. The action was based on 10 violations demonstrating a l:

lack of attention to NRC requirements by the radiation safety officer and a lack _of management oversight by the Radiation Safety Comittee (RSC).

In summary, the licensee was found in violation of requirements related to:

(1) responsibilities of the RSO and RSC, (2) personnel dosimetry and ALARA,'(3) ensuring proper operation of the hospital's dose calibrator, (4) radiation surveys and (5) labeling and use of radiopharmaceuticals.

Vermont Yankee Annual Emergency Preparedness Exercise On July 18, 1990, NRC Region I participated in the annual emergency preparedness exercise at the Vermont Yankee Power Plant. The NRC response consisted of a Base Team and Site Team totalling approximately 50 regional. personnel... Involvement with the three states was minimal.

The NRC response was observed by representatives of Brookhaven National Laboratory and the Commonwealth of Pennsylvania.

During the week, power ascension testing was conducted. Tests conducted at 100% included: completion of process effluent monitoring, thermal ex-pansion and piping vibration tests, nuclear instrumentation system align-ments, flux mapping, and partial calibration of steam ard feedwater flow instrumentation. Power ascension testing was suspended at midnight Tuesday, to prepare for the formal site dedication ceremony Wednesday.

. Testing resumed Thursday.. Additional tests conducted at 100% power in-cluded: power coefficient measurement data.which required three 40MW load swings; a 10% load swing and a 50% load reduction test. The plant re-sponded as designed to all transients and no equipment' malfunctions occurred. Plans are to conduct the reactor trip test from 100% power on Sunday, July 29, at 8:00 a.m., and the simulated loss of offsite power test from 20% power on Monday, July 30.

operator when the failure of a 4160V-480V nonsafety transformer resulted-in a runback of the main feedwater pumps. The transformer which failed is

-one of 72 such transformers in use within the plcnt (12-1E and 60 Non-1E applications). The failure was apparently caused by an electrical surge and can be prevented by the installation of a surge arrestor. Five transformers had been previously fitted with surge protection devices; repairs to-the failed transformer of this event included the installation of a surge arrestor, bringing the total number of surge protectors instal-led to six. The remaining 66 transformers will.have surge protection

.added during future schedule outages.

As of today, all transformer failures have occurred-in non-1E applications.

Dresden Nuclear Station On July 23, 1990, Chairman Carr toured the Dresden site with Mr. A. Bert Davis, Regional Administrator, Region 111, and members of the Region III staff.

On July 23, 1990, Dr. Carl Paperiello, Deputy Regional Administrator, Region-III, and members of the Region 111 staff, met with licensee management representatives at:the site to present the SALP 9 Report for the Dresden station. The licensee received Category 1 ratings in Plant Operations, Emergency Preparedness and Security, and Category 2 ratings in the other functional areas.

Kansas Gas and Electric Com9any-Kansas City Power and Light Company (KCPL) announced, on July 24, 1990,-

that it has commenced a tender offer for all outstanding. shares of. Kansas.

Gas and Electric Company.

Each company now owns a 47-percent share of Wolf Creek Nuclear plant.

In a bulletin to employees, Bart Withers, president and chief executive officer of Wolf Creek Nuclear Operating Corporation said he has been assured by the president of KCPL that the proposed merger would not impact operation of the Wolf Creek f acility.

Rancho Seco Nuclear Generating Station in a letter dated July 24, 1990, the licensee provided a decommissioning financial plan and requested an: interim exemption from NRC requirements to-have full funding at the time of termination of operation. The licensee has proposed to base its financial' planning initially on the minimum L requirements of 10 CFR 50.75, which would be approximately $113 million.-

To accomplish this goal, the licensee plans an_ initial contribution of

'$55 million on or before July 26, 1991 and annual contributions of.

~

$2 million. The licensee is continuing to study decommissioning options and costs and may revise its. initial cost estimates, in another letter dated July 24, 1990, the licensee has requested an exemption from performing an annual emergency planning exercise which would necessitate full participation of State and local agencies.

Original plans were to conduct this exercise in December 1990. The licensee proposes to perform communications drills instead of a full exercise. The licensee has previously submitted a revision to the emergency plan based on the defueled condition of.the plant which is under review by the NRC staff.
