SUBJECT:
MEETING WITH MR. TERRY LASH. ILLI,N0!$ DEPARTMENT 0F NUCLEAR SAFETY ON FEBRUARY 14. 1990 A meeting was held between the NRC ahd:the Illinois Department of Nuclear-Safety (!DNS) on February 14,1990. A first part of the meeting was attended. copy of the agenda is enclosed.

It was affinred that both the NRC and the IONS desire to work cooperatively in areas of mutual interest including implementation of the Policy Statement and Nemoranda of Understanding relating to State particiption in NRC-activities. To help assure this goal Mr. Davis and Mr.1. ash will meet periodically and converse by telephone as appropriate.
Initially it is intended that the meetings will be conducted quarterly. This may change as circumstances dictate.

Mr. Davis will establish a list of NRC staff who will be assigned as the cognizant individual on each of the major interfaces with the State.
This information will be provided to Mr. Lash who will also assign e' counterpart staff-person or contact from IDNS.
Mr. Taylor will explore including 1DNS in the NRC Fitness for Duty Program.
Since Region !!! has done some preliminary inquiries with NRC Headquarters on whether or not this can be done. Mr. Davis will provide information on-thes) inquiries and the results obtained to Mr. Taylor.
Mr. Lash had requested that the fitness for duty requirements on some of his technicians be waved for a period of time which would enable him to. establish IDNS procedures regarding fitness for duty testing.
Mr.. Lash has now made arrangements with Commonwealth Edison Company to escort his technicians, so the NRC-does not need to address this request.
There are two Memoranda of Understanding (MOU) which are pending. These are.
the ASME MOU and-the Resident Engineer MOU. 'The NRC will expedite the approval of these.MOUs.

will work with' DNS to formulate an expanded MOU. Mr. Roland Lickus will-coordinate this effort for NRC and Mr. John Cooper will coordinate it for IDNS.
Illinois has requested an amendment to the Section 2746 Agreement to include
- material defined in Section 11.e (2) of the Atomic Energy Act. A notice of the recuest and the NRC's assessment of. the request will be published in the Feceral Register for public comment. 'The Office of State Programs has the lead on this issue..
Allied Chemical Company has requested pemission from the NRC to bury low level waste on its site at Metropolis.> lllinois'.
Illinois has written a:1etter to Allied Chemical Company stating that Illinois must approve such burial.-
-l IDNS lawyers are of the view that such burial would be. illegal. NRC lawyers hold the opposite view.
Mr. Treby will discuss this matter with Mr. England, the 3DNS attorney. No further action will be taken on-this matter by the NRC until it is discussed with the Chairman. NMSS has the lead on this issue.
I Mr. Lash requested that' the.NRC readdress the position which excluded Allied

Chemical Company from the Agreement-State Program. This was identified by l
Mr. Lash as being a low priority request. Mr. Denton will discuss the matter with Chairman Carr.
Commonwealth Edison Company has made a request to IDNS to bury low level waste on several of its sites. ' Mr. Lash stated that IDNS is not working on these requests because NRC may determine that the approval authority' rests with the NRC. Mr. Denton will review this matter and determine who in NRC will be assigned the lead to resolve it.
Mr. Lash expressed his concern regarding the fees charged by the NRC for materials license activities. He was concerned that IDNS fees are higher than NRC fees yet IDNS only captures about 17 percent of the cost in regulating materials activities. Mr. Denton has the lead'on this issue.

it with Mr. Hiller.
Mr. Lash expressed a mild concern that the recent assessment of the IDNS materials program was not efficient.
Apparently there was some duplication of effort from the various NRC' reviewers. Mr. Kassnerer has the lead to eliminate such duplication in the future.
l Mr. Lash stated that the-Illinois Medical Society had been successful in having the _ Radiation Protection Act Statute considered for sunset at the end of this year instead of December 1993. -Mr. Lash requested that the NRC prepare correspondence which would outline-the impact of rescinding the act on the Agreement State status.
Mr. Denton-has the lead on this issue.
