Dear Congressnan de la Garza:
I have received your letter of December 12, 1986 asking for Nuclear Regulatory Comission counsel on concerns relating to the Conoco-Conquista uraniun mill' tailings disposal site near Falls City.
Texas. On Jenuary 14,1987 the Department of Energy referred your letter on-the same subject to us for reoly.
As you are aware the State of Texas is an Agreenent State and exercises its own regulatory authority over uranium milling and tailings disposal activities in Texas. Consequently, the NRC has no,iurisdiction over specific-licensing and disposal activities in the State of Texas. As part of their program, the State of Texas adopted standards for mill tailings that are equivalent.-to the extent practicable, or more stringent than, the standards adopted and enforced by the Comission.
We are aware of the practice of pernitting disposal of waste frm uraniun insitu extraction operations and certain other small ore processing operations at existing large conventional mill tailings disposal sites.
This practice avnids proliferation of numerous small disposal sites, each of which would require _long term stabilization and control.
Because of the concerns expressed in your letters to Chaiman Zech and Dr. Bernstein, Comissioner of Health for Texas, we are reviewing the specific actions taken or to be taken by the Texas Bureau of Radiation Control regarding your concerns. We will provide you with our coments on this issue at an early date following completion of our assessment of the State's actions. We understand that the Texas Department of Health is preparing a response to your letter to Dr. Bernstein.
