Karr's letter to you, the NRC has advised the State of Tr.xas thet the disposal of P, hone-Poulenc waste in the Conoco site could compromisr the opplicability of-the provisions of Section 83 of the Atomic Energy Mt of 19Ea, as ananded, that permit transfer of uranium nill tailings disposb1 sites to tna l!nited States Governnant. The applicability of Section 151(c) of the Nuclear t!aste Policy Act of 19P2 could be compromised in a sinilar nanner. This does not, however, oresent a situation of illegality or incompatibility since the altcraative of Texas ownership of the disposal site is recognized explicitly in Section R3, and transfer is not required under Scction 151(c).
