Office of State Programs Corplaint Against Texas Regulation of a Mill Tailings Site Staff has received a letter from the law fim of Henry and Kelly in
~
Austin Texas representing " Citizens for Closing the Conquista Tailings Pond." The letter states that the Texas definition of byproduct material (mill tailings) is broader than that in the Uranium Mill Tailings Radiation Control Act (UMTRCA) and that Texas is allowing wastes from rare earth processing operations to be disposed of in the tailings pile of the Conquista mill. The letter claims this is contrary to UMTRCA. The letter also states that the company has not prepared an.-

= adequate closure plan and that the amount of surety is inadequate. The citizens group also objects to a license transfer, now being considered l
by Texas, being approved untti these matters are rectified. This matter l
was the subject of a recent inquiry from Congressman de la Garza. The staff is looking into these matters and will respond to both letters.
