Dear Mr. Furbush:

On March 8,1982, the Comission d'irected tile staff to make a concerted effort for one week to obtain an agreement among the partf es on a company or list of companies to carry.out the indepepdent Design Verification Program - Phase I for Diablo Canyon.

The Comission 'arther instructed the staff that if the

. efforts were unsuccessful, the staff should proceed with the recommendations contained in SECY-82-89 as modified by the Comission. Over the past week representatives of PG&E, Governor Brown, Joint Intervenors, and the NRC staff consulted regarding a possible agreement among all parties on a company to carry out such a program.

The staff and all parties have now concluded that further discussions do not appear to be fruitful in reaching settlement acceptable to all parties.~ Therefore, the staff will now proceec' as directed by the Comission.

By letter of March 12, 1982, you oroposed that Teledyne Engineering Services (Teledyne) be retained to conduct the independent audit of Phase I of the program.

Based upon the staff review as contained in SECY-82-89 and pursuant to the~

Comission direction, the staff hereby approves Teledyne as the independent company to conduct the Design Verification Program - Phase I for Diablo Canyon.

However, certain issues with respect,to Phase I of the program remain to be resol ved.

L Among the issues to be considered during the completion of our review of the Teledyne program are (1) the Teledyne qualifications in civil - structural aspects of nuclear pover plants; (2) the procedures to be applied by Teledyne to evaluate the performiance of R. L. Cloud Associates to date and in future program activities; and (3) the consolidation into a ~ single program plan of your submittal of December 4, 1931, the R. L. Cloud submittal of February 27, 1982, the Teledyne submittal of March 8,1982, and other potential revisions to the program.

To expedite the resolution of these matters, the staff is prepared to meet with you and Teledyne to discuss them in a forthcoming meeting.
