SAFEGUARDS EVALUATION REPORT: AMENDMENT APPLICATION DATED FEBRUARY 1, 1993 RE REVISIONS TO FUNDAMENTAL NUCLEAR MATERIAL CONTROL PLAN Backaround By cover letter dated February 1,1993, General Electric (GE) submitted 11 revised pages to their Fundamental Nuclear Material Control Plan (FHMC),

identified as changes being made pursuant to 10 CFR 70.32(c). Upon the Nuclear Regulatory Commission review, one of the changes was determined as not being a 70.32(c) type change, in that the minimum number of individuals making up an inventory team was decreased. This discrepancy was resolved by the licensee's submittal of eight revised Plan pages by letter dated May 28, 1993, of which two pages replaced two of the previously submitted pages. The two replacement pages re-established the previous minimum number of inventory team members. The other six pages of the May 28th submittal pertained to clarifications to FNMC Plan commitments.

By letter dated June 21, 1993, GE submitted one revised page to the Plan to provide a clarification (as requested by NRC) regarding the determination of the standard error of inventory difference (SEID).

Discussion As a net result of the three submittals identified above,17 pages of GE's FNMC Plan have been revised. Staff review has determined that all of the modificatinns made on these pages qualified as 70.32(c) changes in that they did not represent a decrease in the effectiveness of the licensee's material control and accounting (MC&A) program, and as such, did not require NRC approval prior to implementation.

Cateaorical Exclusion Based on the content of the submitted FHMC Plan revisions, the staff has determined that these changes are organizational, administrative, or procedural in nature, and do not adversely affect the public health and safety or the environment. Accordingly, the staff has concluded that the criteria in 10 CFR 51.22(c)(11) for categorically excluding an action from an environmental review has been met. Therefore, neither an Environmental Assessment nor an Environmental Impact Statement is warranted for this proposed action.

Conclusion / Recommendation The staff concludes that the licensee's FNMC Plan changes will have no adverse effect on the public health and safety or on the environment, and that the FNMC Plan changes do not decrease the effectiveness of the licensee's MC&A program. Therefore it is recommended that Safeguards License Condition SG-1.1 to License SNM-1097 be revised to incorporate these Plan changes.
