This proceeding concerns the seismic design of the Diablo Canyon tiuclear Power Plant ("Diablo Canyon").
In ALAB-5 9 8, the Appeal Board granted in part the Joint Intervenors' motion to reopen the record to the extent they requested the con-sideration of new evidence resulting from a major earthquake in California's Imperial Valley, and denied the remainder of their motion regarding new information about the nature of the linkage between certain geologic faults near the facil-ity, and staff's alleged changed position on the environmental qualification of the facility's safety related equipment.
The Appeal Board found that: (1) the data from the Imperial Valley earth-quake may shed light on the correctness of key seismic findings by the Licensing Board and, thus, should be taken into account in reviewing the decision to approve Diablo Canyon's seismic design; (2) the new evidence on the possible connections between geologic faults near the plant, would not af fect the magnitude' of the safe Shutdown Earthquake as determined by the Licensing Board; and (3) recent staff actions

On September 27, 1979, the Licensing Board issued a partial initial decision in which it concluded that Diablo Canyon will be able to withstand safely any earthquake that can reasonably be anticipated in the plant's vicinity. 1/
Subse-quently, three matters which could af fect that decision developed:
1.
California's Imperial valley experienced a major earthquake; 2.
New information was developed regarding the linkage of geologic faults in the vicinity of Diablo Canyon; and 3.
The NRC staff initiated further regulatory actions regarding the environmental qualifica-tion of safety-related equipment.
These developments are discussed sequentially below.
Imperial Valley Earthouake on October 15, 1979, California's Imperial Fault experienced a major earthquake having a magnitude between 6.4 and 6.9 on the Richter scale.
Num-erous strong motion seismographs in the vicinity of the fault recorded the best data yet avail-able on strong ground motion in the immediate vicinity of such a large earthquake (near-field data).
Diablo Canyon is located in the near-field of the Hosgri fault, which controls'the seismic design of the plant.
The design. basis earthquake has been determined to have a magni-tude of 7.5.
Joint Intervenors argued that these circumstances make the Imperial Valley earthquake data singu-larly relevant to the seismic design of Diablo 1/

3 Canyon.
Ihey also presented Dr. Brune's prelim-inary analysis of the Imperial Valley earthquake data showing that in his view, the seismic design for Diablo Canyon does not satisfy Appendix A in several respects.
First, they contended that the Safe Shutdown Earthquake chosen for the plant must correspond to a free field response spectrum which encompasses the maximum possible earthquake induced vibratory accelerations at the site.

Some horizontal ground accelerations produced by, the Imperial Valley earthquake exceeded the accelerations associated with the Safe Shutdown Earthquake chosen for Diablo Canyon.
In addition some response spectra for the Imperial Valley Earthquake exceeded the design spectrum for the plant.
Intervenors believe that the new data shows that Diablo Canyon is designed to withstand an earthquake of magnitude 6.5 and not the Safe Shutdown Earthquake of magnitude 7.5.
- Second, vertical accelerations measured in the near-field of the Imperial Valley earthquake were much greater than two-thirds the measured horizontal accelcrations contrary to the design assumption for Diablo Canyon.
Finally, the Imperial County Service Building was heavily damaged by the Imperial Valley earthquake.
The so-called tau reduction, which some experts claim moderates the ef fects of earthquakes on large buildings, was not observed for this structure.
Pacific Gas and Electric (PG&E) offered several arguments in response:
1.
Appendix A does not require the choice of a design response spectrum which encompasses all maximum earthquake induced accelerations, but permits the use of a design response spectrum derived from an average of data for several earthquakes; 2.
Dr. Brune confused peak instrumental ground motion with design response spectrum values; 3.
Dr. Brune is a seismologist and, thus, has no expertise regarding seismic 1

Affidavits by PG&E's experts demon-strate that the Imperial Valley earth-quake data does not affect the design response spectrum for Diablo Canyon-because peak velocities and displace-ments at the freguencies for which they were observed do not affect structural design; 5.
Ihe occurrence of vertical accelera-tions greater than two-thirds the horizontal accelerations is immaterial because Diablo Canyon is conservatively designed to withstand expected vertical accelerations at the site; 6.
Analysis of the Imperial Valley eards-quake data by the United States Geolog-ical Survey (USGS ) shows that the linear extrapolations used by Dr. Brune overestimate predicted ground motion; and 7.
Failure to observe the tau effect at the Imperial County Service Building is irrelevant to the design of Diablo Canyon because the county building is built on piles in soil and Diablo Canyon is built on rock.
The NRC staf f presented similar arguments.
The Appeal Board found a number of apparent inconsistencies between the Imperial Valley i
earthquake data and. the information pre-sented during the Diablo Canyon seismic hearing.
Among these are the high accelera-
.l tions leading to horizontal response spectra i
exceeding the design spectrum for Diablo Canyon, the unexpectedly high values of vertical motion, and the failure to observe the tau effect.
Regarding die last point, the Appeal Board noted that PG&E's experts had demonstrated the existence of this effect by analyzing ground motion data for the Hollywood Storage Building, which is also built on piles in soil.
These incon-sistencies, and the uniqueness of the near-field data from the Imperial Valley earth-quake led the Appeal Board to conclude that '

i it would be appropriate and prudent to reopen the record on this issue.
Accord-ingly, the Appeal Board gave the parties 45 days to answer nine questions regarding seismic issues and to submit any other relevant testimony.

The Licensing Board determined it to be of magnitude 7.5.
Intervenors rely on a graduate student's recent-analysis of high-resolution seismic reflection data which led him to conclude that a strand of the San Simeon fault zone is connected to a strand of the Hosgri fault zone.
Because the maximum possible earthquake on a fault is proportional to its length, Intervenors contend that - the maximum credible earthquake for Diablo.
Canyon is greater than magnitude 7.5 because 4
that number was based on only the length of the Hosgri fault which the Board assumed to be unconnected to any other fault.

The Appeal Board found that Joint Intervenors' new evidence would not have resulted in a dif-ferent decision had it been considered by the Licensing Board.
In the Board's view, the Intervenors' evidence did not contradict the expert testimony by the USGS 'that even if the fault zones are connected the entire system is unlikely to experience an earthquake of magni-tude greater than 7.5.
Accordingly, the Appeal Board did not reopen the record on this issue.1

Environmental Qualification of Safety-Related Equipment Joint Intervenor's final ground for reopening is based on recent staff communications to licensees regarding the environmental qualifi-cation of safety-related equipment.
Intervenors contended that these communications showed that PG&E has not identified all safety-related equipment in the Final Safety Analysis Report for Diablo Canyon and that the effects of aging on this equipment have not been evaluated in
7 accordance with staff's new upgraded criteria.
Thus, Intervenors argued that the record must be reopened to identify all safety-related
- - equipment at Diablo Canyon and to determine whether the Licensing Board's decision would be affected by the alleged new standards regarding aging.
Staf f contended that Joint Intervenors misint'er-preted its communications.
Staff's request to PG&E for detailed information about safety-related equipment was directed to operational requirements and qualification parameters.
Contrary to Intervenors' contention, the request i
was not intended to imply that PG&E had not identified all safety-related equipment.

Staf f's notice on environmental qualification and aging presented HRC's proposed resolution of this generic issue.
Staff contended that the f act that its interim. position may require back-fitting at Diablo Canyon does not of itself demonstrate that the Licensing Board would have reached a dif ferent result on the issue because that Board did receive testimony on this issue.
PG&E argued that staff's interim position does require back-fitting, but only if later tests reveal that aging has adversely affected safety-related equipment.
The Appeal Board accepted staff's interpreta-tion that its letter requesting more information about safety-related equipment did not imply that PGLE had not identified all such equipment.
The Appeal Board also noted that the Intervenors had not identified any unlisted safety-related i
equipment.
Regarding staff's interim position on environmental qualifications, the Appeal Board found that the staff had informed the Licensing Board of the pending proposals, and that the Board had considered their future adoption in reaching its decision.

First, that new data obtained from a major earthquake in California's Imperial Valley which occurred on October 15, 1979 -- about three weeks after the decision below was rendered -- cast a shadow on the adequacy of the Licensing Board's seismic analysis, making it problematical whether the Diablo Canyon design criteria meet Commission requirements; second, that "new seismic reflection data," gathered by a University of Cali-fornia graduate student, invalidate both the Licensing Board's 1/

The term is defined in 10 C.F.R. Part 100, App. A, S III(c) as "that earthquake which is based upon an evaluation of the maximum earthquake potential con-sidering the regional and local geology and seismology and specific characteristics of local subsurface material.
It is that earthquake which produces the maximum vibratory ground motion for which certain structures, systems, and components are designed to remain functional.
These structures, systems, and components are those necessary to assure (1)
The integrity of the reactor coolant pressure boundary.
(2)
The capability to shut down the reactor and maintain it in a safe shutdown condition, or (3)
The capability to prevent or mitigate the conse-quences of accidents which could result in potential offsite exposures comparable to the guideline expo-sures of this part. "

Unlike district courts, ad-ministrative agencies frequently have continuing respon-sibilities over matters under their supervision.
The settled law on reopening administrative records is con-trary to the applicant's position.
Thus, in ICC v.
Jersey City, the Suprene Court upheld an ICC refusal to reopen a record not because the consideration of post-l trial evidence was proscribed, but because whether to reopen for that purpose was a matter entrusted to the agency's discretion.

We have considered the motion to reopen in the light of those standards as well as in the context of the decision below and the record upon which it rests.
In our judgment, the Imperial Valley earthquake data may well shed significant additional light upon the correctness of key seismic findings made by the Licensing Board.
If so, we should take that new information into account in reviewing the decision approving the plant's seismic design.
The matter has obvious safety implications and intervenors' motion was made with reasonable dispatch af ter the information became available.
We accord-ingly grant the motion to reopen on this issue to the extent specified in part II of this opinion.
However, as explained in parts III and IV, we find no cause to reopen the record on either the Hosgri-San Simeon linkage or the environnental qualification program questions.

The new seismic data may affect our evaluation of the entire seismic reanalysis.
We are, therefore, holding our decision on the remainder of the appeal in abeyance until we have examined those data more closely and have fully eval-uated their significance.
II.
1.
A brief recapitulation of the circumstances surrounding the design of the Diablo Canyon nuclear power plant will place our decision to reopen in perspective.
We observed when this case came before us for another purpose last year (ALAB-519, 9 NRC 42, 45) that:
[a]ll nuclear power plants must be designed and built to protect the public from_the hazards of radioactive releases should the plant be subjected to movements in the earth's crust.
And such con-siderations were taken into account when the Diablo Canyon facility was initially proposed for its Pacific coast site.
At that time the Nacimiento fault was taken to be the nearest major active fault, some 18 to 20 miles northeast of the plant.
The facility was designed, engineered, and constructed to withstand earthquake damage on this basis.
But, years after construction was approved and well underway, that assumption was discovered to be ill-founded.
Subsequent offshore explorations for petroleum have revealed that, at its. closest point, the "Hosgri fault" lies only a few miles off the site of the Diablo Canyon facility.
That proximity raised the likelihood that an earthquake in the vicinity of San Luis Obispo might be " considerably more severe" than initially antici-pated.
In light of this intervening development, the plant's design was extensively reanalyzed by the appli-cant, the staff, and the [ Advisory Committee on Reactor Safeguards).
Their consensus was [that] the Diablo Canyon facility as constructed, with some design modi-fications, would withstand safely the more severe earthquake shocks now reasonably anticipatable.

Although it joined in that conclusion, the ACRS expressed reservations about the seismic reevaluation of the facility.
The Committee noted, for example, "that, for want of better
data, certain calculations were necessarily accepted 'largely on (expert) judgnent and experience rather than on extensive observations or analyses,' judgments not previously applied in approving power plant design," and "'that the design bases and criteria utilized in the seismic reevaluation of the Diablo Canyon station for the postulated Hosgri event are in certain cases less conservative than those that would be used for an original design. '"

These matters were explored in the hearings below. The Licensing Board concluded that the plant was adequately designed to protect the public from harm in the event of an earthquake.
Its conclusion rests, among other things, on (1) the " design response spectrum" utilized in the design 7/
reanalysis by staff witness Dr. Nathan M. Newmark; (2) the assumption that the magnitude of vertical acceleration experienced in a major earthquake would be two-thirds of 8/

On October 15, 1979 -- after the decision below was rendered -- California's Imperial Valley experienced an earthquake ("IV-79") with a magnitude of 6.4 to 6.9 on the Richter Scale.
This approached in size the 7.5 magnitude
" Design Basis" (or safe Shutdown) earthquake on the Hosgri Fault that, in accordance with Commission requirements, all parties agree the Diablo Canyon facility's safety systems 12/
=ust be designed to survive in functioning condition.~
Because of the Imperial Valley's known high seismicity (a' result of the Imperial Fault, which bisects the region),
numerous strong motion instruments (seismographs) had been put in place there before the earthquake occurred.
The response of that instrumentation to IV-79 provided seismolo-gists with what has been described as "the best near-field data set available to date."
Intervenors argue that data obtained from this major seismic event have rendered the Licensing Board findings questionable and that the record should be reopened to' take the new seismic haformation into consideration.

We have studied the intervenors' motion and the ap-plicant's and staff's responses to it.
Doing so has left us of the opinion that the IV-79 data do raise factual issues bearing on the saf ety of the plant and their resolution might lead us to a different result than the one the Licensing Board reached.
For example, the design response spectrum for Diablo Canyon was determined primarily from the record of the Febru-ary 9, 1971 earthquake at Pacoima Dam.
That record includes a peak horizontal acceleration of 1.2g which, upon reduction to a response spectrum, yields an " effective" or high fre-quency anchor point acceleration of 0.75g.18 Comparable figures for the smaller IV-79 event are a peak of 0.81g and 15/
a 0.36 mean acceleration. - Yet some of the horizontal response spectra generated from the Imperial Valley motion records ex-ceed the Diablo Canyon spectrum values.
In the case of vertical motion, the near-field IV-79 vertical peak accelerations and the vertical response spectra 14/

In the Diablo Canyon seismic reanalysis, however, vertical motion values are apparently taken to be two-thirds of comparable horizontal values.11/
We further note that some of the vertical response spectra also exceed the Diablo Canyon design spectrum values.
Finally, we are told by the applicant and the staff not to be concerned that apparently no tan ef fect was exhibited at the Imperial County Services Building (which was heavily damaged as a result of the earthquake).

may be discounted because that building is built on piles, in soil, whereas the Diablo Canyon site is rock.1E/
In the proceeding below, Dr. Newmark (the staff's seismic expert witness) used the motion records of the Eollywood Storage Building -- approximately the same size as the Imperial County Services Building -- to demonstrate the existence and nature of the tau effect.
But the Hollywood building is also built on piles, in soil.

It was also pointed out that there is nothing unique about rest of the equipment in a nuclear power plant and that a wealth of experience exists with this equip-ment in facilities around the wcrld which have been in existence the past ten, twenty or more years (Tr. 8790).
The Staff review of the seismic design of the Diablo Canyon plant was the most extensive ever undertaken by the Staff of the NRC.

The Applicant's review was also extraordinarily thorough.
The Board finds that the Applicant has demonstrated through appropriate analysis and tests that-Category I structure [sJ, systems, and co=ponents will perform as required during the seismic load of the safe shutdown earthquake.
The Board finds that the Category I structures, systems, I
~and components will be adequate to assure (a) the in-tegrity of the reactor coolant pressure boundary, and (b) the capability to shut down the reactor and maintain it in a safe condition.

What is the significance of this difference in view of the conclusion of the authors of USGS Circular 795 35/
In other words, if the various IV-79 near-field response spectra were used to generate a smoothed, average response spectrum for a zero-period acceleration appropriate to that event (in accordance with techniques explained in Blume's testimony fol. Tr. 6099 at page 6 and pages 39 and 40), and if this spectrum were scaled to a 0.75g zero-period accel-eration, would the resulting response spectrum be bounded by the Newmark Spectrum for Diablo Canyon?
(based on an analysis of data provided in that document) that, for comparable earthquake magnitude and. distance, there are no significant differences between peak horizontal accelera-tions measured on soil or rock?

This question should be considered in light of statements by applicant's witness Blume to the effect that acceleration, rather than velocity or displacement, is the critical parameter in the design of Diablo Canyon (Blume Affidavit, Para. 9; Testimony fol. Tr. 6099, p. 33).

Throughout the Licensing Board hearings, parties stressed the role of soil-structure -interactions as a mecha-nism that would reduce the magnitude of structure motion relative to ground motion (e.g., Tr. 8878; 8947-46).
Staff and applicant's arguments (in response to intervenors' suggest-ion of the apparent lack of tau effect during IV-79) point to soil structure interactions as the reason for building motion exceeding that of the ground (Blume Affidavit, Para.10; Rothman - Kuo Affidavit, p. 7).

Yet, when the acceleration data of two such stations, El Centro Array Numbers 6 and 7, are plotted as a function of distance from the f ault (e.g., Blume Affidavit, Figures 1 and 2), the horizontal acceleration values f all well below the regression line mean for the 1 km distance.
The vertical acceleration values are also lower than the mean on such a plot.

the focusing phenomenon and relate the results of such analyses to the likelihood that, in the event of an earthquake anywhere along the Hosgri Fault, focusing might result in amplified seismic motion at Diablo Canyon.

We have received preliminary reports of the effect of IV-79 on the El Centro Steam Power Station.
(Board Noti-fication December 17, 1979, Levin and Martore Observations; Rothman - Kuo Affidavit, p. 12).
In many respects, the structures and systems of that facility resemble those of the Diablo Canyon plant.
Their response to a severe, well instrumented seismic event can be analysed to help confirm or refute analytical techniques and assumptions used in the Diablo Canyon seismic analysis.
The parties should prepare and submit such an analysis.

In addition to answering our questions about infor-mation from the Imperial Valley earthquake, we would like the parties to address Paragraph E on page 6 of the McMullen affidavit (included with the Staff. Response to Joint Intervenors' Motion to Reopen).
