Purcose:
To advisc the Commission with regard to I,__
Summary:
The Licensing Board in the 31I-Restart proceeding has certified to the Commission the issue whether psychological stress can be legally relevant to the proceeding.
The Board believes that psychological stress is cognizable under NEPA, whether or not an environmental impact statement (EIS) is needed, and recommends that the Commission i
permit the Board to consider psychological stress.
This consideration would not be in the context of preparing an EIS but would instead have the purpose of mitigating com-munity fears.
The Board believes that even when no EIS is required the " general pro-visions of NEPA" give NRC authority "to impose reasonablo, cost-effective conditions on the operation of 21I-1 directly, and perhaps solely, for the purpose of mit:. gating psychological stress."
