APPENDIX A NOTICE OF VIOLATION Duke Power Company Docket No. 50-491 Cherokee 1 License No. CPPR-167 As a result of the inspection conducted on September 8-11, 1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified.
10 CFR 50, Appendix B, Criterion V, implemented by DPC Tr pical Report,
" Duke 1-A, Amendment 5", Section 17.1.5.2, requires that work g,erformed on safety-related items be accomplished in accordance with the requirements imposed by specifications, drawings, codes, standards, regulations, quality assurance criteria and site circumstances.
Table 17.0-1 of the Topical Report states the licensee will incorporate ANSI N45.2.2-1972.
Section 6.3.3 of this standard states that " hazardous chemicals, paints, solvents and other materials of a like nature shall be stnred in well ventilated areas which are not in close proximity of important nuclear plant items."
Likewise, Section 6.2.3 states that "the use or storage of food, drink and salt tablets dispensed in any storage area shall not be permitted."
Contrary to the above, on September 8, 1981, inspectors found three cans of a flammable substance stored along with other empty gasoline containers in warehouse No.1, a Level B storage area where safety-related components (HPSI, containment spray and charging pumps) are presently stored.
Flam-mable substances (Rodofast, Texaco fluids, URSA motor oil) were also four.d stored in the Level A portion of warehouse No.1.
Although "No Smoking" signs were prominently displayed, evidence of smoking (cigarette packages and butts) were found in all warehouses examined with the exception of the Level A area. Additionally, soft drink cans and plastic coffee cups were in evidence during the warehouse inspections.
This is a Severity Level V Violation (Supplement II.E).
Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tions; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
