Office of Nuclear Reactor Regulation Items of Interest Week Ending April 23, 1993 Comanche Peak Steam Electric Station (CPSES) - Unit 2 The unit is currently at 48 percent power, holding to perform power plateau's flux mapping, nuclear instrument calibrations, and steam dump and feedwater pump testing prior to performing a scheduled 10 percent load swing. TU Electric's start-up testing schedule has been delayed approximately three days, because of secondary water chemistry cleanup.

r The following schedule includes milestones for upcoming start-up testing:

Perform remote shutdown test (reactor t'-ip from 20 percent power)

Perform turbine trip from 25 percent and Loss of Offsite power test May 1 Complete Mode 3 outage May 6 Begin 75 percent Power Plateau testing May 9 Begin 100 percent Power Plateau testing May 20 A 50 percent readiness assessment is scheduled to be performed by Region IV during the week of April 26, 1993. The team will, through independent inspection, review the licensee's 50 percent assessment, and their identification, evaluation, and resolution of start-up and plant deficiencies.

The Comanche Peak Oversight Panel plans to meet on site in early May to review power ascension testing to date.

The staff met with TVA senior managers led by 0. Kingsley, Generation Group President, in the Region 11 office on April 21, 1993. NRR staff was headed by Mr. Steven Varga. This is one of a series of management meetings that are held periodically to address significant issues.

Included in the meeting agenda was the target date for issuance of the operating license and fuel loading.

TVA informed the staff that the new target date is April 1994, a slip of 3 months from the previous fuel load target of January 1994. The new date reflects the fact that construction work is behind schedule.

EPRI Meetina 5

On April 15, 1993, the staff held a meeting with EPRI to discuss the issue of regulatory treatment of non-safety systems in the passive advanced light water reactor designs. The meeting centered on the processes proposed by EPRI and the staff to be used by plant designers to identify risk significant systems, structure, and components, their reliability and availability missions and-regulatory requirements.

i identified shortcomings in.their process, and a lot of progress had been made in the issue. There was a consensus that there are no differences in 1

principle or substance, but that the packaging of the EPRI process needs to be improved. The meeting concluded with an agreement to hold another meeting on May 17, 1993. One week before the meeting, EPRI will provide to the staff its comments on the staff-proposed process or a revised process.

Meetina with NUMARC on Guidelines for Dioital Instrumentation and Control

On April 15, 1993, the staff from the Division of Reactor Controls and Human f

factors met with NUMARC to discuss the recently submitted NUMARC document i

" Guideline on Licensing Digital I&C Upgrades." This document is a joint effort of NUMARC and EPRI to establish criteria for licensees to use when performing the safety evaluation for a digital, upgrade to an analog 18C system

under the requirements of 10 CFR 50.59. The document is intended to assist licensees in determining whether a proposed digital system retrofit involves j

an unreviewed safety question thereby requiring staff. approval before its implementation. The staff and NUMARC exchanged views on the content of the document and on the establishment of a threshold with examples, and discussed future actions. The staff plans to provide.NUMARC with its comments and i

recommendations concerning the document by the end of May 1993. This effort j

is part of the resolution of issues resulting from the comments received on l

the draft generic letter on this subject published for comment in May 1992.

Office of Nuclear Material Safety and Safeguards Items.of Interest Week Ending April 23, 1993 Louisiana Enerav Services (LES) Proposed Construction of the Clairborne Enrichment Center (CEC) in Homer. Louisiana The Nuclear Regulatory Commission has recently received over a hundred letters protesting the proposed LES uranium enrichment facility to be constructed in i

Homer, Louisiana.

All of the letters express similar concerns against nuclear facilities and

" environmental racism," because of selecting of the CEC site in a poor black community. Some of the letters appear to be from private citizens, while others are from organizations such as Greenpeace and the Sierra Club.

Division met with representatives of the Defense Nuclear facilities Safety

Board (DNFSB) to discuss common interests in the development of Standard Review Plans (SRPs) that address all of the safety principles essential for protecting the public health and safety during the operation of nuclear material processing facilities.

DNFSB's principal function is the review and evaluation of the content and implementation of standards relating to the design, construction, operation and decommissioning of defense nuclear facilities of the Department of Energy. The Board is to recommend to the Secretary of Energy those specific measures that should be adopted to ensure that the public health and safety are adequately protected.

Using the NUREG as the focal point, DNFSB staff identified reference documents and specific guidance within those documents that will be useful in the development of SRPs. This information was provided to FCSS staff during the meeting for use in the ongoing efforts to review NRC-licensed fuel cycle facilities.

Combustion Enaineerino. Inc. (CE)

On March 26, 1993, CE was authorized by License Amendment 23 to store special nuclear material (SNM) in the Kardex unit. The Kardex unit is a computer-controlled multi-module storage unit for fuel pellets.

During CE's "preoperational inspection," CE discovered that the actual number of storage shelves differed from that previously reported in licensing documents.

i On April 14, 1993, CE representatives met with staff of the Office of Naclear Material Safety and Safeguards and Region 111 to clarify this discrepancy.

In the meeting, CE provided information detailing safety implications, root causes, and actions taken to prevent recurrence. Also discussed in the meeting was information that CE provided in a letter dated April 13, 1993.

Although the discrepancy poses no immediate nuclear safety concerns, CE indicated that they will not introduce SNM into the Kardex until they have completed modifications that will bring the unit back to the "as designed" APRIL 23, 1993 ENCLOSURE B

2 condition. The modifications are to be completed by April 23, 1993. CE has requested that the Nuclear Regulatory Commission concur in the use of the Kardex as described in CE's April 13, 1993, submittal. We will respond to CE's request after the staff has completed the review.

Prooram plans for the U.S. Sucoort to the Former Soviet Union After one year of intensive bilateral discussions, the U.S. and several republics of the former Soviet Union (FSU), including the Russian Federation are close to finalizing the Implementing Agreements on cooperation in the area of material control and accounting (MC&A) and physical protection. These Implementing Agreements will be under the Umbrella Agreements resulting from i

the Nuclear Safe and Secure Dismantlement (SSD) initiative. The U.S. effort in the area of MC&A and physical protection, which will be funded by the Nunn-Lugar resources, is jointly led by the Nuclear Regulatory Commission and Department of Energy (DOE). The U.S. Defense Nuclear Agency (DNA) will serve as the Program Manager overseeing the execution of the implementing programs.

At this time, detailed implementing program plans are being developed by a 1

working group consisting of representatives from NRC, DOE, and DNA. The U.S.

effort will result in installation of model safeguards systems in selected FSU nuclear facilities for the purpose of demonstration of system capability and training.

International Trainino Course on physical protection of Nuclear Facilities and i

Materials A representative of the Division of Fuel Cycle Safety and Safeguards made a presentation at the eleventh International Training Course on "The U.S.

i Nuclear Regulatory Commission System of Physical Protection." This three week course is conducted approximately every eighteen months by Sandia National i

Laboratories, as mandated by the Nuclear Nonproliferation Act, on behalf of the Department of Energy, and in consultation with the NRC and the IAEA.

Thirty nine students representing 32 countries, including 13 from republics of the former Soviet Union, participated.

TN-24 Scent Fuel Storace Cask On April 16, 1993, a notice was published in the Federal Reaister to extend the comment period for the Proposed Rule to add the TN-24 spent fuel storage cask to the list of approved tasks in 10 CFR Part 72. The comment period was reopened for an additional 30 days to ellow comments or supplementary infor-mation, previously categorized as proprietary, that was recently released pursuant to the provisions of 10 CFR 2.790(c).

The proposed rule, originally published on June 26, 1992, would amend the Nuclear Regulatory Commission's list of approved storage casks by adding casks to the list that holders of r

power reactor operating licenses would then be authorized to store spent fuel in under a general license. A Final Rule for the other cask, the VSC-24, in the original proposed rule was published on April 7,1993.

Office for Analysis and Evaluation of Operational Data Items.of Interest Week Ending April 23, 1993 Diaonostic Evaluation and Incident Investication Branch (DEIIB)

The South Texas Project (STP) Diagnostic Evaluation Team (DET) will be back on-site next Monday, April 26, 1993, for its final planned on-site evaluation period. An interim exit with the licensee, on the status technical issues, is scheduled for 9:00 am April 30, 1993 at the STP site. The final exit meeting with the licensee to discuss the DET results is tentatively scheduled for May 26, 1993.

Technical Trainino Center (TTC)

On April 18-21, the TTC Technical Assistant participated in the American Nuclear Society's Topical Meeting on Nuclear Plant Instrumentation, Control and Man-Machine Interface Technologies, in Oak Ridge, Tennessee. The TTC staff activities at the ueeting included chairmanship of several technical sessions and participation on the planning committee meeting. This meeting proved an excellent forum for I&C and human factors experts to exchange information and ideas; over 250 professionals from the U.S. and 12 foreign countries participated. Other NRC staff attending the meeting included representatives from the I&C and Human Factors branches of NRR and the Electrical and Mechanical and Human Factors branches of RES.

Managers from the OECD Halden Reactor Project visited the TTC April 22-23.

Representing the Halden Reactor Project were Torbjern Bjerlo, Process Control Program Manager, and Kjell Haugset, Man-Machine Systems Research Division Head. The purpose of the visit was to see the simulation activities associated with the TTC, to meet with TTC management and cognizant simulation staff, and to see work being done to use the PICASSO system to graphically display variables computed by full scope simulators and engineering workstations. PICASSO is the picture assembling software tool developed by the OECD Halden Reactor Project for process control applications.

Incident Response Branch (IRB)

IRB staff met with SRA, the new contractor for the Task Order Agreement

" Technical Assistance for Emergency Response," in a preliminary meeting on April 20 to provide them with an orientation on NRC's Incident Response System and acquaint them with their potential responsibilities under the contract.

IRB staff participated in a FRMAC Operation Work Group Meeting at Las Vegas during this week.

Office of Administration Items of Interest Week Ending April 23, 1993 Earth Day 1993 On April 22 and 23, 1993, the Division of Contracts and Property Management coordinated Headquarters Earth Day activities. On April 22, an Earth Day Information Center was featured in the OWFN lobby providing employees with a variety of literature on recycling, conservation and energy efficient methods of commuting to work. Headquarters employees who have regularly used energy efficient and environmentally sound comuting options (alternative transportation) for three years or more were recognized by the Chairman in a picture taking ceremony. On April 23, the Employee's Welfare and Recreation Association sponsored a lunch time walk and cleanup of Battery lane Park in Bethesda.

Approval letters were signed and distributed.

NIH Computer Timesharina t

Effective June 1, 1993, tne hours of operation for the National Institutes of Health (NIH) Programmer Assistance and Liaison Unit (PAL) Consulting Desk will be reduced, closing one hour earlier than current practice. The new hourslof operation will ba from 8:30 am to 3:00 pm.

Microcomputer Relocation Support Increased requests for support have been received from the Program Offices such that the moves of microcomputers and associated peripherals are scheduled for every Friday throughout the month of May and the first few weeks of June.

This is in addition to the routinely scheduled installation and move activi-ties on Tuesday and Thursday of each week, AUTOS Agency Upgrade of Technology for Office Systems (AUTOS) implementation is complete for the Office of Information Resources Management (IRM) in the Phillips Building. A total of 169 machines have been installed. This total includes all workstations, printers, and file servers.

IRM installation and indoctrination continues through May 3, 1993.

Office of Personnel Items of Interest Week Ending April 23, 1993 Personnel Directors Group Meetino Attended Eileen Mason attended a Small and Independent Agency Personnel Directors Group meeting on April 21 concerning performance standards. Robbie Kunreuther, Director of Government Personnel Services, presented a program on evaluating employees on their manner of performance. The theory behind this system is that the goal of improving performance is seldom attained through the results-oriented performance elements and standards characteristic of most Federal performance appraisal systems.

NRC Team Participated in WalkAmerica Challence l

On April 18, eighteen NRC employees, friends, and family members walked with the NRC team in the annual WalkAmerica Challenge, the largest annual fundraiser for the March of Dimes.

Funds from WalkAmerica support the March of Dimes Campaign for Healthier Babies, a nationwide effort to prevent birth defects, low birth weight, and infant death.

Earth Day Observed by NRC Employees On April 22, fourteen NRC employees participated in Earth Day events in Bethesda. Activities included planting flowers donated by the EWRA at the Battery Lane Park and cleaning the grounds.

Items of Interest Week Ending April 23, 1993 Sionificant Enforcement Actions:

Three Notices of Violation and Proposed Imposition of Civil Penalty in the cumulative amount of 5175,000 were issued on April 19, 1993 to the tiouston Lighting and Power Company (South Texas). The first of these three separate actions was based on a number of violations of established procedures which resulted in the failure to inform NRC licensed operators in the control room of potentially significant conditions that could have affected the operation of the plant. Because the failures to follow established procedures involved plant management personnel, these violations have been classified as a Severity Level III problem. The base civil penalty of $50,000 has been escalated 50 percent to 575,000 after finding 50 percent mitigation appropriate for the licensee's corrective action and 50 percent escalation appropriate for NRC identificaticn of the violations and 50 percent appropriate for the licensee's prior opportunity to identify one of the violations.

(EA 92-175, EA 93-023, and EA 93-047)

A Notice of Violation and Proposed Imposition of Civil Penalties in the cumulative amount of $12,500 was issued on April 20, 1993, to Mercy Catholic Medical Center, FitZgerald-Mercy and Misericordia Division, Darby and Pennsylvania, Pennsylvania. The action was based on a Severity Level III violation and a Severity Level III problem.

The Severity Level Ill violation involves a substantial failure to implement the Quality Management Program, as i

required by 10 CFR 35.32, in that written directives signed and dated by the authorized user were not prepared prior to administration of certain radioactive materials to patients. A 56,250 penalty is proposed for this violation. The Severity Level III problem is an aggregate of sixteen violations of the radiation safety program which collectively represent a breakdown in the control of licensed activities. A $6,250 penalty is also proposed for this problem.

For the first penalty, a basis existed for 50%

escalation because the violation was identified by the NRC, and 100%

escalation based on multiple examples.

For the second penalty, a basis existed for 50% escalation based on NRC identification, and 100% escalation based on prior opportunities to identify the violation.

(EA 93-052)

Civil Penalties Paid:

Memorial Hospital of Laramie County, Cheyenne, Wyoming paid the civil penalty i

in the amount of $1,250. The action was based on:

(1) failure to instruct key personnel in the licensee's Quality Management (QM) Program; and (2) failure to follow a procedure in the licensee's QM Program, which caused a therapeutic misadministration. An improper verification of brachytherapy source strength led to an event in which a patient received a dose of 5669 centigray (cGy) instead of the prescribed dose of 3258 cGy. A second event occurred due to the same violation; however, in that event the treatment was discontinued because of patient intervention. The issue of whether the second event constitutes a misadministration (within the definition of 10 CFR 35.2) is currently under NRC staff review. The violations have been categorized in the aggregate at Severity Level III. The base civil penalty was mitigated by APRIL 23, 1993 ENCLOSURE K

i 50% because the licensee took prompt and effective corrective action.

l (EA 93-011) k'estern Technologies, Inc., Phoenix, Arizona paid the civil penalty in the amount of 58,000. The action was based on the willful failure to wear alarm ratemeters when performing radiography in NRC jurisdiction, which was classified at Severity Level II.

Week Ending April 23, 1993 Second Buildino Status During the week, pavers were laid and concrete curbs were poured on the plaza, and south and east sides of the building grounds were brought to final grade.

Concrete ramps meeting Uniform Federal Accessibility Standards were poured in two locations along the path of access from One White Flint North to Two White Flint North at the P1 level. About 100 workers were on-site daily through the week.

Painters, elevator installers, mechanical and electrical contractors are finishing up their respective assignments.

The base-building interior work is i

essentially completed except for floor 4 and a few isolated areas.

During the week, the Office staff worked with GSA staff to resolve outstanding issues on base-building chtnge orders. The staff submitted new change orders to be processed under the interior build-out contract, and clarified and refined data in fund and work tracking systems used jointly by Consolidation and GSA to monitor progress.

The Office staff coordinated with GSA on revisions of the locations of key-carded entrance doors on all floors which were made necessary by changes required in bathroom design and layouts on each floor.

Changes to layouts in two areas of floor 4 were coordinated to address concerns raised by a preliminary permit review with Montgomery County.

Office of State Programs Items of Interest Week Ending April 16, 1993 Subcommittee on Water Resources Meetina Maria Lopez-Otin, Federal Liaison, attended the April 14, 1993, meeting of the Subcommittee on Water Resources (SWR). The members discussed the April draft of the report," WATER RESOURCES SCIENCE: A Research Strategy for Meeting Critical National Needs". The report is intended as the first step in the development of long-range plans for the overall coordination of interagency Federal research and i

development efforts to address relevant continental water issues. There appears l

to be agreement on the outline of the report and the work done so far. However, Ms. Lopez-Otin expressed reservations regarding the proposed chapter 6 which dealt with budget matters. She also requested a timetable for modifications to the report, with a view towards having a sufficiently static document with which she could brief the NRC principal. The NRC's principal to the Committee on Earth and Environmental Sciences is Dr. Eric Beckjord. In this regard, Steve Ragone, Chairman of the SWR, stated that he intends to meet with each of the CEES's principals in the near future.

Insoection Procedures Course Office of State Programs sponsored an inspection procedures course on April 19-23, 1993, in Murfreesboro, Tennessee. The class consisted of twenty-four students from State radiation control programs.

The course covered the various aspects of inspection procedures. James Myers, State Programs, was the

Region I Items of Interest Week Ending April 23, 1993 1.

Enforcement Conference with Radiation Oncolooy Center at Marlton An Enforcement Conference with Radiation Oncology Center at Marlton, Marlton, New Jersey, was held in Region I on April 16, 1993, to discuss the apparent violations identified during a routine safety inspection conducted at the licensee's facility on February 2 and 4, 1993.

Region I participants included the Regional Administrator, Thomas T.

Martin, and DRSS Division Director, Richard W. Cooper. Also attending the Conference were representatives of the NRC's Office of Enforcement and Office of General Counsel.

Licensee participants included the owner of the Center, Douglas Colkitt, M.D. and Carolyn Horowitz, M.D.,

Medical Director of the facility and Radiation Safety Officer (RS0).

The principal areas of concern discussed at the Conference included the licensee's lack of oversight of the radiation safety program, the RS0's lack of knowledge of regulatory and license requirements, and the lack of knowledge demonstrated by the RSO and her staff in the routine and emergency operation of their high dose rate remote afterloader and associated safety systems.

A total of 15 apparent violations were discussed. Er.forcement action is currently being considered.

Region II Items of Interest Week Ending April 23, 1993 1.

General Electric Company - Wilminoton. North Carolina On April 20, the Regional Administrator, Director of the Division of Radiation Safety and Safeguards, and staff from the Office of Nuclear Materials Safety and Safeguards held a meeting to discuss the licensee's completion of the performance improvement program established to improve the licensee's criticality safety program after the May 1991 event where material containing uranium-235 was inadvertently transferred. The program addresses findings in the NRC's Incident Investigation Team report (NUREG 1450).

Tennessee Valley Authority - Watts Bar On April 21, representatives of the Tennessee Valley Authority were in 1

the Region 11 Office to meet with Regional management regarding schedule and status for their Watts Bar facility.

Duke Power Company I

On April 23, representatives of the Duke Power Company were in the Region 11 Office to present a self-assessment of their Catawba Nuclear Power Plant.

Radiation Monitors Declared Inocerable at Robinson Radiation monitors used to monitor radioactivity in plant area and process streams were declared inoperable by Robinson plant management on April 20, 1993. The monitors were declared inoperable after it was d?termined that an internal power supply for radiation monitor R-18 failed without indication in the control room via annunciator. Alti.cugh fuictional, the licensee declared all remaining process and area m;nitors inoperable. The radiation monitors are manufactured by the duclear Research Corporation. The R-18, utilizing a MD-51 Gamma Scintillation detector, monitors all waste disposal system liquid releases from the plant. The plant has implemented compensatory i

measures while the monitors are out-of-service. These measures include the analysis of grab samples, and the use of alarming dosimetry for area radiation detection and increasing monitoring of functional control room radiation monitors.

A Part 21 report will be issued by the vendor.

It appears a circuit board may have to be modified to cause an alarm when the power supply fails. Nuclear Research Lorporation indicates these monitors are in use in other power reactor facilities.

Region 11 has discussed this with NRR.

B&W Naval Nuclear Fuel Division On Tuesday, April 20, 1993, the licensee determined that ultrasonic cleaning and washing operations (wet operations) on a new High Performance Fleet Core (HPFC) type of S6W cluster had been performed APRIL 23, 1993 ENCLOSURE R L

without license required Nuclear Licensing Board approval and without license required NCS controls in placa. The licensee had recently t

received a license amendment authorizing a K (multiplication factor) of 0.90 during wet operations involving clad,gcomponents under normal conditions. The amendment also required additional NCS controls be implemented to preclude the introduction of additional components if the introduction of such components would cause the multiplication factor of the operation to exceed the licensed accident limit of 0.95.

controls should have been in place prior to performing the wet l

operations on the cluster.

The licensee has stopped all HPFC 56W related activities and will not resume operations involving these clusters until all requirements have been met.

The licensee is continuing root-cause evaluation of the event, including a review of all operations at the facility to determine NCS are in place and are being followed. The licensee will brief the NRC on its review findings on April 27, 1993.

Region III Items of Interest Week Ending April 23, 1993 1.

Saratoaa Community Hospital On April 22, 1993, an Enforcement Conference was conducted in the Region III office between representatives of Saratoga Community Hospital (License No. 21-16891-01) and members of the Region III staff. The purpose of the conference was to discuss the findings from the routine safety inspection conducted from March 22 through April 6, 1993. Nine apparent violations were identified during the inspection. The licensee did not contest any of the apparent violations during the conference.

The results of the conference are under review and a final determination on enforcement action is pending.

Egrtheast Ohio Recional Sewer District (NE0RSD)

On April 19, 1993, NRC/RIII personnel met with members of the Northeast Ohio Regional Sewer District (NE0RSD) staff and their consultant in Cleveland, Ohio, to discuss the status of the decontamination plans for their Southerly Plant and related topics. The NE0RSD stressed the need for removal of ash from the sanitary ponds at the facility by early summer so that the sewage treatment for that portion of the City of Cleveland can remain in operation. The discussion also included NE0RSD plans to install radiation monitors to detect any future releases to their three plants, its site characterization plans, and attempts to obtain information on the source of the cobalt-60 contamination.

Gaseous Diffusion Uranium Enrichment On April 20-22, 1993, several staff and management representatives from Region 111 participated in a three-day training session on uranium enrichment gaseous diffusion technology. The course was presented by DOE at the Oak Ridge National Laboratory. Training included cascade theory., operational occurrences, UF cylinder handling and storage, and 6

tours of the shutdown K-25 facilities. Also, NRC staff met with DOE and Martin-Marietta staff to discuss current progress of the FSAR upgrades for the Portsmouth and Paducah facilities.

ST. Joseph Hospital. Flint. Michioan On April 21, 1993, the licensee reported a medical misadministration to NRC Region III (Chicago) when on April 20, 1993, a brachytherapy tandem source assembly was removed from a patient before the radiation treatment had been completed.

The temporary implant involved 69.9 millicuries of cesium-137 which sometime during the night was removed from the patient.

It is not known at this time who or how the assembly was removed. The attending nurse has stated the patient handed the source assembly to her, and she placed the assembly on the window sill approximately 2.3 meters from the patient. The source assembly was discovered at 8:20 a.m. EDT on April 21, 1993. The attending physician retrieved the sources and the RSO placed them into storage. The APRIL 23, 1993 ENCLOSURE R

DOE Picks Up Well-locaina Sources DOE contractor, Bionomics, picked up well-logging sources owned by Brand-X Perforator's, Inc. and Hole-Truth, Inc. on April 16, 1993. The americium sources were packaged and shipped to Los Alamos. The cesium sources were transported to Bionomics' facility in Tennessee, where they will be prepared for transport to Barnwell for burial.

interlocks on the containment airlock doors which resulted in an inadvertent breach of containment integrity. This enforcement conference was open to the public.

Enforcement Conference with Houston Liahtina & Power Company (HL&P)

The Group Vice President - Nuclear and members of his staff met in the Region IV office, Thursday, April 22, for an enforcement conference.

The purpose of the enforcement conference was to discuss apparent violations identified during a followup inspection to the augmented inspection team inspection conducted at South Texas Project.

Specifically, the violations concerned repeated overspeed trips that were occurring on both units' turbine-driven auxiliary feedwater pumps (TDAFWP) and the inoperability of a Unit 1 emergency diesel generator (EDG) that resulted from painting the exterior of the machine. These TDAFWP issues, concurrent with the problems identified with the EDGs, were subsequently determined to have rendered Unit l's TDAFWP and two motor-driven auxiliary feedwater pumps inoperable for a period of 61 hours7.060185e-4 days <br />0.0169 hours <br />1.008598e-4 weeks <br />2.32105e-5 months <br />.

Proposed Rule Sianed by EDO On April 23, 1993, the Executive Director for Operations signed a proposed rule for a 30-day public comment. The proposed rule would extend the expiration date from August 23, 1993, to December 31, 1994 of the rule entitled, " Authorization to Prepare Radiopharmaceutical Reagent Kits and Elute Radiopharmaceutical Generators; Use of Radiopharmaceuticals for Therapy" (Interim Final Rule). This action would permit licensees to continue to use byproduct material under the provisions of the Interim Final Rule until the NRC completes a related rulemaking to address broader issues for the medical use of byproduct material (including those issues addressed by the Interim Final Rule).

This constitutes notice to the Commission that, in accordance with the rulemaking authority delegated to the EDO, the EDO has signed this proposed rule for publication in the Federal Register.

On April 20, the Regional Administrator, Director of the Division of Radiation Safety and Safeguards, and staff from the Office of Nuclear i

Materials Safety and safeguards held a meeting to discuss the licensee's completion of the performance improvement program established to improve the licensee's criticality safety program after the May 1991 event where material containing uranium-235 was inadvertently transferred. The program addresses findings in the NRC's Incident Investigation Team report (NUREG 1450).

On April 23, representatives of the Duke Power Company were in the Region II Office to present a self-assessment of their Catawba Nuclear Power Plant.

Radiation Monitors Declared Inoperable at Robinson Radiation monitors used to monitor radioactivity in plant area and i

process streams were declared inoperable by Robinson plant management on April 20, 1993. The monitors were declared inoperable after' it was determined that an internal power supply for radiation monitor R-18 failed without indication in the control room via annunciator. Although l

functional, the licensee declared all remaining process and area monitors inoperable.

The radiation monitors are manufactured by the Nuclear Research Corporation. The R-18, utilizing a MD-51 Gamma Scintillation detector, monitors all waste disposal system liquid releases from the plant. The plant has implemented compensatory

}

measures while the monitors are out-of-service.

These measures include the analysis of grab samples, and the use of alarming dosimetry for area i

radiation detection and increasing monitoring of functional control room radiation monitors. A Part 21 report will be issued by the vendor.

appears a circuit board may have to be modified to cause an alarm when the power supply fails.

Nuclear Research Corporation indicates these 7

monitors are in use in other power reactor facilities.

Region II has discussed this with NRR.

H&W Naval Nuclear Fuel Division On Tuesday, April 20, 1993, the licensee determined that ultrasonic cleaning and washing operations (wet operations) on a new High Performance fleet Core (HPfC) type of S6W cluster had been performed l

1 without license required Nuclear Licensing Board approval and without license required NCS controls in' place.

The licensee had recently-received a license amendment authorizing a K, (multiplication factor) of 0.90 during wet operations involving clad,, components under normal conditions. The amendment also required additional NCS controls be implemented to preclude the introduction of additional components if the r

introduction of such components would cause the multiplication factor of the operation to exceed the licensed accident limit of 0.95.

These controls should have been in place prior to performing the wet operations on the cluster.

j The licensee has stopped all HPFC 56W related activities and will not resume operations involving these clusters until all requirements have been met. The licensee is continuing root-cause evaluation of the i'

event, iecluding a review of all operations at the facility to determine NCS are in place and are being followed. The licensee will trief the NRC on its review findings on April 27, 1993.

Saratoaa Community Hospitel On April 22, 1993, an Enforcement Conference was conducted in the Region III office between representatives of Saratoga Community Hospital (License No. 21-16891-01) and members of the Region III staff. The purpose of the conference was to discuss the findings from the routine safety inspection conducted from March 22 through April 6, 1993. Nine apparent violations were identified during the inspection.

The licensee did not contest any of the apparent violations during the conference.

The results of the conference are under review and a final determination on enforcement action is pending.

Northeast Ohio Reaional Sewer District (NE0RSD)

On April 19, 1993, NRC/RIII personnel met with members of the Northeast Ohio Regional Sewer District (NE0RSD) staff and their consultant in Cleveland, Ohio, to discuss the status of the decontamination plans for their Southerly Plant and related topics. The NE0RSD stressed the need for removal of ash from the sanitary ponds at the facility by early summer so that the sewage treatment for that portion of the City of Cleveland can remain in operation. The discussion also included NE0RSD plans to install radiation monitors to detect any future releases to their three plants, its site characterization plans, and attempts to obtain information on the source of the cobalt-60 contamination.

Gaseous Diffusion Uranium Enrichment On April 20-22, 1993, several staff and management representatives from Region III participated in a three-day training session on uranium enrichment gaseous diffusion technology. The course was presented by DOE at the Oak Ridge National Laboratory. Training included cascade theory, operational occurrences, UF cylinder handling and storage, and 6

tours of the shutdown K-25 facilities. Also, NRC staff met with DOE and Martin-Marietta staff to discuss current progress of the FSAR upgrades for the Portsmouth and Paducah facilities.

ST. Joseph Hospital. Flint. Michiaan On April 21, 1993, the licensee reported a medical misadministration to-NRC Region III (Chicago) when on April 20, 1993, a brachytherapy tandem source assembly was removed from a patient before the radiation treatment had been completed.

The temporary implant involved 69.9 millicuries of cesium-137 which sometime during the night was removed from the patient.

It is not known at this time who or how the assembly was removed. The attending nurse has stated the patient handed the source assembly to her, and she placed the assembly on the window sill approximately 2.3 meters from the patient. The source assembly was discovered at 8:20 a.m. EDT on April 21, 1993. The attending physician retrieved the sources and the RSO placed them into storage.

i licensee estimates that the patient received 311 rad of the 2000 rad intended treatment dose and the dose to the attending nurse was estimated less than 10 millirem.

Region III will conduct a special inspection, April 26, 1993, to evaluate the circumstances.of the incident and the licensee's response to it. The inspection will also include a determination of potential personnel exposures to the patient and workers.

This meeting was held at the Prairie Island Training Center-and was open to the public.

On Wednesday, April 21, 1993, Frank Congel, Director, Division of Radiation Safety and Safeguards in NRR, and two members of his staff, conducted a training session for Region III technical staff on lessons learned from hurricane Andrew and the startup of Turkey Point.

This routine management meeting was held to discuss recent operating performance, the scope of the upcoming refueling outage, including shutdown risk plans, several licensing issues, and the status of the MOV program.
