Dear Senator D'Amato:

10n May 8,1981,-Mr. William Dircks.- NRC's Executive Director for Operations, wrote to you responding to concerns of Westchester County residents about the-emergency: plans. currently 'under development for the Indian Point environs.

Mr. Dircks' letter notes'. the January 8,1981 order of the Comission that a hearing be held in the vicinity of the Indian Point facility and indicates-that appointment of a hearing board is iminent.

This characterization may be somewhat misleading in indicating that appointment is iminent. The Comission'is equally divided.over the appointment of;a Chaiman for the Indian Point board.

The Comissioners have stated. in writing
