Dear Senator D'Amato:

This responds to your request for coment on Dr. Lloyd Sokolow's letter, dated July 29, 1982.

In that letter, Dr. Sokolow expressed concern that the NRC was proposing to remove the requirement for psychological testing of nuclear power plant employees.

L The NRC does not presently have any specific regulatory requirements for psychological testing, but some nuclear power plant licensees have comitted in their security plans to using psychological testing as a screening.

i mechanism. When approved, such comitments become enforceable conditions of the utilities' operating licenses. Licensee plan comitments in this regard generally follow the requirements and recomendations of American National ll StandardInstit'ute(ANSI)StandardN18.17. The requirements and recomenda-tions of this standard are endorsed in NRC Regulatory Guide 1.17 " Protection

  • l of Nuclear Power Plants Against Industrial Sabotage," which does not make them requirements for regulatory purposes, but does provide guidance on an acceptable way to meet NRC regulations.

As Dr. Sokolow pointed out, the NRC staff is drafting a screening rule for nuclearpowerplantemployees(10CFRSection73.56).

Psy-hological testing is being evaluated as one possible element of the proposed employee screening o

l requirements. We expect that the draft rule will be approved for publication

. by spring 1983.. At that time, the proposed requirements will. be published l

in the Federal. Register for a 90-day public comment period.

Dr. Sokolow and others will be considered and evaluated before publication of the final NRC rule.
