Dear Senator D'Amato:

This responds to your letter of March 30, 1981, transmitting a request dated February 6,1981 from your constituent, Ms. Vickee Hoiirmaster, for information on transportation of radioactive waste.

Transportation of radioactive materials, including radioactive waste, is regulated at the federal level by both the Nuclear Regulatory Commission (NRC) and the Department of Transportation (DOT). These two agencies partition their regulatory responsibilities by means of a Memorandum of Understanding (MOU) (Enclosure 1).

. A brief description is enclosed of the NRC and DOT requirements for the trans-portation of radioactive materials, including nuclear fuel and waste (Enclosure 2).

In our recent assessment of regulations (NUREG-0170, Enclosure 3), we found that the risks to the public health and safety from transportation of radioactive materials are very small.

We are aware that regulations and resolutions dealing with transport of radioactive material including nuclear waste have been passed )y local jurisdictions.

The Nuclear Regulatory Comission is not, however, involved in any transportation related litigation in Onondaga County, New York.

The Department of Transportation (DOT) published a final rule (Enclosure 4) to establish routing, driver training, and muting exemptions for radioactive

. material including nuclear waste shipment on highways.

This rule has an effective date of February 1,1982.
