SUMMARY

Scope:

This special, announced inspection was conducted in the area of the licensee's program for the receipt of special nuclear material.

Results:

One licensee-identified, non-cited violation was identified.

The licensee exceeded its licensed material possession limits when it inadvertently took receipt of a spent fuel shipment intended for another licensee (Paragraph 2).

On March 24, 1994, an inspector was sent to Lynchburg, VA to review the circumstances surrounding a spent fuel shipment that was to have gone from Duke Power Company's McGuire facility to the B&W Lynchburg Technology Center (B&W LTC).

Instead, it arrived at the B&W Commercial Fuel Plant (B&W CNFP) and was received into the protected area in violation of the possession limits of Material License No. SNM-1168.

l The' shipment left the McGuire facility on March 22 at approximately 6:30 p.m. enroute to B&W LTC. The driver / escorts had two sets of paperwork -- correctly completed shipping papers, and a sealed envelope addressed to the B&W Fuel Company which contained a DOE /NRC Form 741, which incorrectly reflected a transfer to the wrong licensee.

The truck arrived at B&W LTC at approximately 11:00 p.m., on March 22, 1994.

The staff had already departed but arrangements had been made with the B&W Naval Nuclear Fuels Division (B&W NNFD) to have the driver / escorts remain with the vehicle until morning.

The B&W NNFD facility is located adjacent to B&W LTC and the security staff there also provides security for LTC.

The NNFD night shift security force, through personnel error, had not been briefed on the shipment's scheduled arrival. A B&W NNFD security officer spoke to the driver / escorts, and based on a review of the mis-addressed envelope and previous experience, escorted the shipment to B&W CNFP, a short distance down the road.

The shipment arrived at approximately 11:30 p.m.

The security officer on duty at B&W CNFP was cognizant of a standard operating order which required him to complete a form entitled "After Hour Truck Arrival Notification " This was not proceduralized, but rather was a standard practice.

The form stated "The only trucks allowed to enter the plant site after normal working hours without prior approval are the Air Products liquid nitrogen tanker and the Tri-State Truck...."

The shipment was being transported by Tri-State Trucking so the officer took receipt of the shipment.

He signed the shipping papers and allowed the truck to be parked within the protected area within his view. The next morning the licensee became aware of the shipment and contents.

Through communications with B&W LTC, the licensee was aware

2 of the shipment's correct destination.

The driver / escort were recalled to the facility and the shipment was removed on March 24, 1994 at approximately 9:30 p.m.

The licensee immediately changed the standing order so the shipments that arrive after hours without prior notification require the officer to contact cognizant plant personnel prior to taking receipt of the shipment.

Materials License No. SNM-1168, Docket No. 70-1201, Expiration date September 30, 2000. sets forth the following material, forms, and quantities for the licensee to receive and possess.

4 This violation will not be subject to enforcement action because the licensee's efforts in identifying and correcting the violation meet the criteria specified in Section V.G. of the Enforcement Policy.

Exit Interview The inspection scope and results were summar ized on March 25, 1994, with those persons indicated in Paragraph 1.

The inspector described the areas inspected and discussed in detail the inspection results.

The inspector advised the licensee that although the security officer on duty at the time the spent fuel shipment arrived appeared to have followed his standard operating procedures, the licensee was in violation of Material License SNM-Il68 by exceeding its material limits.

This occurred when the spent fuel shipment was brought onto the property. Dissenting comments were not received from the licensee.
