231 W. MICHIGAN, P.O. BOX 2046, MILWAUKEE, W153201 October 11, 1982 Mr. H. R. Denton, Director Office of Nuclear Reactor Regulation U. S. NUCLEAR REGULATORY COMMISSION Washington, D. C. 20555 Attention: Mr. Robert A. Clark, Chief Operating Reactor Branch 3 Gentlemen:

DOCKET 50-266 APPROVAL FEE FOR IN-SERVICE INSPECTION EXEMPTIONS POINT BEACH NUCLEAR PLANT UNIT 1 In a letter dated September 23, 1982, Ms. Reba M. Diggs, Facilities Program Coordinator for the License Fee Management Branch, has notified Wisconsin Electric that our application for exemptions from certain in-service inspection requirements for the Point Beach Nuclear Plant Unit 1 dated August 20, 1982 will be subject to approval fees pursuant to 10 CFR 170.22. Your staff has determined that a Class III is appropriate for this application.

Although we have notified you in the past that we consider imposition of 10 CFR 170.22 fees for NRC approvals which do not involve Facility License Amendments to be inappropriate, you have repeatedly denied this argument and have insisted upon remittance of such fees. Accordingly, in order to facilitate your prompt review and approval of our exemption requests, we are providing herewith a check in the amount of $1,000 as requested.

Very truly yours, a l -) fdy',

Assistant Vicb President 009 C. W. Fay Enclosure (Check No. 697139)
