WEEK ENDING DECEMBER 15, 1989 Browns Ferry, Unit 2

All three Browns Ferry units were defueled after shutting down in 1985.

Units 1 and 3 were put into an extensive lay-up program. During January 1989, l

TVA loaded fuel back into the Unit 2 core.

Af ter nearly a year's effort of working on the necessary restart mo(ifications with fuel in the core, TVA announced today that it would again defuel Unit 2.

i TVA indicates that the remaining Unit 2 work would be more efficiently accom-l l

p11shed with the core safely offloaded.

In addition TVA has indicated that efforts in completing a special nuclear material accountability program involv-l ing core neutron instrumentation and the replacement of 275 electrical cables will be enhanced'by this action.

j Meetina With 00E.to Discuss Surety of Nuclear Waste Fund One-Time Fee On December 13, 1989, staff from the Division of High-Level Waste Management, l

NMSS, and the Policy Development and Technical Support Branch, NRR, met with l

staff from the Office of Civilian Radioactive Waste Management, U.S. Department l

of Energy (DOE), to discuss the potential for shortfall in the 'one-time" fee to be paid into the Nuclear Waste Fund. The potential for shortfall arises because a number of utilities elected to defer payment. There is concern i

i that some of those utilities may not be able to make the payment when it is due.

The NRC staff who attended the meeting understood DOE representatives to say that under the Nuclear Waste Policy Act of 1982, DOE may not accept spent fuel for disposal if payment to the Nuclear Weste Fund is not made. Staff is preparing a letter to DOE stating the staff's understanding of DOE's position and requesting DOE's confirmation and/or clarification of its position.

Continued funding of the high-level waste program was addressed in the 1984 Waste Confidence Decision, and is being addressed in the ongoing 5-year review of that decision. Potential shortfall in funds and the question of responsibility for spent fuel ir the case of utility inability to meet its contractual obligation for payment are potentially significant issues that l

would have to be considered in preparing the final rtview of the Waste Confidence Decision.

A New Approach.to Detection of Plastic Explosives The Safeguards staff is reviewing literature and field test results on a new high-tech explosives detection system which was developed by a Massachusetts based company, Thermedics, Inc. The manufacturer claims that the detection system, EGIS (trademark), can detect small quantities of commercial and military plastic explosives. Although the preliminary field tests confirm the manufacturer's claim, the Safeguards staff is planning to request Sandia National Laboratory to conduct additional field tests with pure explosive compounds. Confirmation of the ut9 fulness of this system will contribute a significant addition to explosive detection capabilities.

Second Buildina Status On Monday, December 11, Chairman Carr, Mr. Thorpson, and Mr. Springer met with the General Services Administration (GSA) Acting Administrator Austin and members of his staff to discuss the status of the Two White Flint North 4

project. Mr. Austin assured Chairman Carr of his continued support for the NRC's headquarters consolidation and of his staff's continued efforts towards resolving the contractual issues with the developer.

f Catawba Units 1 and 2 l

Catawba Unit 2 completed 109 days of continuous operation for the first time in its history. Previously, this unit encountered a high reactor trip rate, many of which were related to the narrow range operating band associated with l

the Westinghouse D-5 steam generators.

In June 1989, the licensee implemented a modification to expand the operating band and make the D-5's behave similarly to the D-3's on Unit 1.

Following implementation of the modification, operators observed steam generator level control to be significantly improved and Unit 2 experienced no reactor trips for the duration of the period.

Catawba Unit 1 is operating at 100% power.

Public Service Company.of New. Hampshire.(PSNH) Board Seabrook Unit;1_

of Director's Decision On December 13, 1989, PSNH announced that its Board of Directors has endorsed i

Northeast Utilities' proposal to acquire PSNH and resolve PSNH's 23-month-old i

bankruptcy.

How PSNH's bankruptcy will be resolved will depend on a number of actions, including those of the U.S. Bankruptcy Court and the N.H. State legislature.

Therefore, any change of ownership may take a while.

l Three. Mile. Island Unit-2 On Friday, December 8,-1989, defueling operations were resumed at TMI-2. They i

had been suspended after defueling workers handled a high doserate component on November 28. Following an inspection and a licensee investigation of the event, an enforcement conference was held in the Region I office on December 4 The licensee implemented the corrective action program presented at the L

enforcement conference by December 8 and began defueling support activities.

Over the weekend of December 9 and 10 several hundred pounds of fuel debris were loaded into canisters. The amount of fuel debris remaining in the reactor 4

vessel is estimated to be less than 1000 pounds by the licensee.

Fuel removal and video verification should be completed by early January 1990.

The international research effort to obtain samples from the TMI-2 reactor vessel lower head will then have a one-month window. This will be followed by the i

verification of remaining fuel and criticality safety, dewatering of the reactor vessel, independent fuel measurements, and the final fuel shipment to the Idaho National Engineering Laboratory. The licensee will then decontaminate i

and prepare TMI-2 for post-defueling monitored storage.

i Division of Engineering.Technolony PORV.and Block Valve.Testtnc.at. Palisades (EMEB)

As a result of the recent transient in which the Palisades pressurizer PORV and its block valve malfunctioned, the licensee removed both valves and tested them at the Wyle Labs, NORCO test facility. The tests, which were observed by an NRC representative, were conducted from Wednesday, December 6 to Friday, December 8.

The test program attempted to duplicate the spurious PORY opening i

and subsequent failure of the block valve to close. Although the PORV's i

spurious opening was duplicated in the tests, the block valve failure could not i

be. The failure to duplicate the block valve problems may be due to the relatively small steam capacity at the test facility. The licensee has shipped J

the PORV and block valve back to the plant for reinsta11ation. The data taken during the tests is beir.g evaluated by the licensee and is being presented to the plant safety comittee Wednesday, December 13 and will be discussed in I

detail during a conference call with the NRC on Friday, December 15.

On December 11, 1989, an IAEA team conducted a one-day inspection at the B&W Fuel Company in Lynchburg, Va. The team audited the facility's ledger through the end of November and weighed and sampled uranium dioxide pellet boxes.

at the GE Fuel Fabrication Plant in Wilmington, North Carolina. The team stored in audited the facility's ledger, measured the U-235 content of UFg cylinders by nondestructive assay, weighed and sampled uranium cioxide powder in storage and weighed and sampled uranium dioxide pellets scheduled for shipment.

Debriefing on large. Scale.Reprocessina Plant. Safeguards.(LASCAR) i Working. Group Meeting On December 7, 1989, a member of the International Safeguards Branch participatedinaninteragencymeetingattheDepartmentofEnergy(DOE) for the purpose of a debriefing by United States representatives who attended

the LASCAR Working Group meetings in Hannover, Federal Republic of Germany in October. Representatives of the Arms Control and Disarmament Agency, Department of State, DOE and Nuclear Regulatory Commission were briefed on the accomplishments of the Working Groups, points of disagreement, status t

of final reports from the current active Working Groups and plans for future Working Group meetings that will evaluate reprocessing plant operations not yet addressed. The possibility of the fourth Plonary meeting being held in t

l the U.S. in 1991 was also discussed.

l meeting with the Nuclear Assurance Corporation, Virginia Power and observers i

from the Spanish organizations of Empresa Nacional de Residuos Radiactivas, 1

S.A. and Equipos Nucleares, S.A.

The purpose of the meeting was to discuss I

design changes since the last meeting, development and analysis plans, testing arrangements, and scheduling for the Model No. NAC-STC spent fuel cask. The l

ca Q is being designed for storage and transport of spent pressurized water l

re6ctor fuel. An application to the NRC addressing storage is expected in February or March 1990 and the transportation application is expected early in the summer of 1990.

Package Supplier Inspection On December 4-8, 1989 a special inspection was conducted at Source Production and Equipment Company (SPEC), St. Rose, LA. The inspection focused on quality assurance for the fabrication of radiographic devices and was conducted by two members of the Transportation Branch.

HIGH-LEVEL. WASTE MANAGEMENT High-level Waste Quality Assurance Meeting l

On December 13, 1989, staff from the Division of High-level Waste Management (DHLWM) met with representatives from the U.S. Department of Energy and the l

State of Nevada for the bi-monthly quality assurance (QA) meeting relative to the high-level waste repository. Although tite impact of DOE's recently announced schedule changes on its QA program implementation was on the agenda, DOE could only superficially discuss the subject because the impact of the changes has not yet been fully analyzed. The State of Nevada discussed observations on DOE audits performed to date. The State noted that DOE's performance in carrying out the audits had improved in the past year. DOE also provided an update on their plans to revise the Privacy Act procedures to allow NRC and Nevada access to the personnel qualification records of staff i

4 in the repository program.

j LOW-LEVEL WASTE MANAGEMENT Waste-Disposal. Application On November 14, 1989 Envirocare of Utah, Inc. submitted to Low-Level Waste Management (LLWM) an application to dispose of byproduct material (uranium or l

thorium mill tailings) at a facility near Clive, Utah. The application is unique because it seeks private authority to dispose of byproduct material at a site remote from a milling operation. The proposed activity falls between existing NRC regulations in Part 61 covering commercial disposal of LLW and Part 40 covering licensing of uranium milling operations.

Following the Office of Gentral Counsel guidance, staff will prepare a Notice of Receipt, for Commission approval, to be published in the Federal Register, which will formally establish the regulatory criteria the staff will apply in review of the application (i.e., the criteria set out in Appendix A to Part 40 which are applied to disposal of tailings at mills).

Office for Analysis and Evaluation of Operational Data Items of Interest Week Ending December 15, 1989 l

l Division.of Safety Programs DSP staff members gave presentations at the Region I resident inspectors meeting on December 8,1989. The discussions included an overview of the program for evaluating risk potential using operational events as initiating events (Accident Sequence Precursor Program) conducted for the agency by Oak Ridge l

National Laboratory.

Program. The purpose of the presentation was to describe the indicators in detail so that the Regions would be more efficient in their review of the draft report and better utilize the information it contains. The presentation concluded with a discussion of the recently issued Announcement No. 200 concerning the use of performance indicators.

4 Division-of Operational. Assessment The TTC is proceeding to acquire some large General Electric (GE) boiling) water reactor (BWR) nuclear power plant components (pumps, motors, valves, etc.

from a cancelled plant equipment liquidator to use as training aids. These components will be transported to the training center and configured for display in additional leased space. The costs will be accomodated within AEOD's existing i

budget. This project will add an additional dimension to technical training i

courses since course attendees will be able to see first hand, as well as touch in a nonhostile environment, H rger sized nuclear power plant components.

is projected that these traihn.g aids will be used about an hour in each reactor technology course and perhaps in other specialized technical training courses.

The integration of these large training cids into TTC courses will provide

)'

course attendees a better perspective on the size, workings and complexity of components in a nuclear power plant. These components are generic in nature and, thus, of substantial value in reactor technology courses covering all vendor designs. They may also be of use in existing and future courses in r

areas other than reactor technology.

For example, the components could be used for demonstrating equipment radiation survey techniques and decontamination methods. Disassembled components could oe used for demonstrating maintenance techniques and where particular maintenance problems might occur.

Items of Interest Office of Governmental and Public Affairs Week Ending December 15, 1989 Internationc,,1 Programs Foreign Visitors On Monday, representatives from Mititubishi Atomic Power Industries met with staff from NRR, RES and AE0D to discuss and demonstrate a PC-aided education system for emergency operating procedures for use in the training of reactor operators, and a new control room prioritized alarm system.

On Wednesday, Mr. Shigeru Fukuyama, Manager, Nuclear Safety Technology Center, met with staff from the Emergency Preparedness Branch, NRR, to discuss emer-gency planning and preparedness.

Following these discussions, he visited the Operations Center.

IAEA Training The International Atomic Energy Agency is conducting a training course in radiation safety for sealed sources and radioactive materials in Cairo. Egypt from December 13-22, 1989. Ronald Wascom, Assistant Administrator of the l

Regulatory Branch on the Louisiana Department of Environmental Quality, is an i

instructor at the training course.

State. Local and. Indian Tribe Programs Tennessee Radiation Control Program Review R. L. Woodruff, Region II State Agreements Officer, lead a team review of the Tennessee Radiation Control Program on December 11-15, 1989 in Nashville, Tennessee. Jack Hornor, Region V State Agreements Officer, and John Pelchat, Region 11 Radiation Specialist, assisted in the review. An exit meeting with J. W. Luna, Commissioner, Department of Health and Environment, was held on December 15, 1989.

1989 in Chicago, Illinois. The conference, sponsored by_ the Illinois Depart-ment of Nuclear Safety, included panel discussions on " National-Perspective on Implementation of the Low-level Waste Policy Act" and " Host State Perspectives".

There were also sessions on selecting a site, citizens' advisory group and facility design and a workshop on annual stevey forms and reports, j

Meeting with New York State Officials.on.Nine Mile Point.1 NRC staff met in Albany, New York on December 13, 1989 with representatives from the New York State Energy Office, Public Service Commission and Attorney i

The purpose of the meeting was for the New York State officials to gain a better understanding of NRC's regulatory programs as they relate to the State's economic feasibility assessment of Nine Mile Point 1 and the potential impact on the licensee. NRC staff indicated that they could only provide a status of NRC programs and entertain but would not be able to quan-tify the financial impact of these programs on Nine Mile Point 1.

Also dis-cussed was severe accident and nunagement programs, naintenance policy, reactor vessel inspection and surveillance program, reactor aging research activities, and spent fuel storage options.

Williston, North Dakota. The action was based on violations involving use of radiographer's assistant to independently conduct radiographic activities, failure to notify NRC of licensed activities in Wyoming and Montana, and failure to provide accurate information.

Civil Penalties. Paid Dennis I. Maehara, M.D., Inc., Honolulu, Hawaii paid the civil penalty in the amount of $250. The action was based on a violation involving an extremity exposure to the tip of the finger in excess of the quarterly allowable limit of 18.75 rems and the failure to follow procedures for the cleaning (of aEA89-160) strontium-90 eye applicator which lead to the extremity exposure.

Uniroyal Goodrich Tire Company, Woodburn, Indiana paid the civil penalty in the amount of $500. The action was based on an incident involving inadvertent disposal of two gauges, each containing 12.2. mil 11 curies of strontium-90, to an unlicensed facility, and numerous other violations that, in the aggregate, were considered to represent c breakdown in control of licensed activities.

Region 1 Items of Interest Week Ending December 15, 1989 1.

Oyster Creek On December 7,1989, the licensee made a four-hour notification to the operations center which involved a main condenser vacuum transient without scram either automatically or manually. On December 8, 1989, Region I connenced an Augmented Inspection at the site in response to operational concerns that at least one indicator in the control room indicated a scram condition and that the reactor protection systems sensors apparently did not function properly. Subsequent to a conference call between the licensee and NRC staff, the licensee completed a shutdown and cool down of the reactor by December 8, 1989.

The Augmented Inspection team concluded its review on December 12, 1989.

The cause of the event was personnel error by a licensed operator in operating a backwash system for the main condenser circulating water (CW) system. Operators quickly responded to the error by restoring CW flow and reducing power in accordance with the applicable abnormal procedure. The resultant vacuum transient in one of three sections of the condenser was noted by the operators but the independent vacuum trip sensing system (alarms / trip functions only) apparently lagged the indicating system.

There was no clear evidence to the operators at the time of the event that a scram condition existed and as such the operators performed adequately.

The disparity between sensing systems could not be fully explained since there were localized pressure variations that were apparently steam flow induced.

The team also noted that a contributing cause to the personnel error was the non-use of an appropriate information/ caution system to warn operators that backwashing could not be accomplished for present plant conditions on that section of the condenser. Further the technical specifications (TS) require that the vacuum trip switches be set at greater than or equal to 23 inches of mercury yet the licensee had set these switches at the limit allowing the instruments to drift below the TS limit by as much as 1.5 inches of mercury. The team's report should be issued during the week of January 1,1990.

Licensee short term actions before startup included resetting the vacuum trip instrumentation to 24 inches of mercury; training the operators on the design information obtained during the event; and clarify existing administrative controls on when to manually scram the reactor. Long term actions are being formulated.

Emergency Preparedness Conference The Emergency Preparetsss Section Chief and Incident Response Coordinator attended an Emergency Preparedness Conference on December 12-13, 1989 for Region I licensee's. Major topics of discussioa included: discussion of DECEMBER 15, 1989 ENCLOSURE N

the 1990 emergency preparedness exercise schedule; discussion of NRC Region I incident response; emergency action levels; protective action decision making; and a discussion on the implementation of changes to an emergency preparedness program that could affect the overall quality of the program.

were in the Region II Office to attend an Enforcement Conference regarding Brunswick Service Water System operability issues, such as supply valve redundancy, leaking cross-tie valves to the conventional service water header, and numerous other issues.

On December 12, 1989, McGuire Nuclear Station experienced an inadvertent release of noble gases from the Waste Gas Shutdown Tank A into the Auxi.

11ary Building. Due to the removal of a relief valve from the system during maintenance, noble gases vented to the Waste Gas compressor Room were exhausted via the Auxiliary Building Ventilation System to the unit i

vent. Using unit vent monitor readings, the licensee conservatively calculated that 11.71 curies of noble gases were released from the vent stack over a two-hour period with the highest instantaneous MPC at the site boundary of 68 percent of 10 CFR Pa ct 20 limits.

Farley Emergency Exercise P

On December 13, 1989, Farley held a limited participation exercise.

Several exercise weaknesses were identified including communication and management control inadequacies between the TSC and OSC, and untimely Protective Action Recommendation.

Virginia-Electric and Power Company During startup of North Anna Unit 1 on December 12, 1989, after repair l

2 coolent pump sustained an electrical ground and subsequent motor trip.

The decision was to replace the motor and on December 13, plant conditions were set. Pressurizer level was reduced to 20 percent with pressure at 7 psig (235'F). At 1730 on December 13, the motor was uncoupled and the shaft was backseated.

Shaf t leakage is 3/4 gpm to the containment su;np.

The existing motor is in the process of being removed and the new motor is being prepared for hookup. The licensee plans a restart on December 22.

Harris Site Regulatory Effectiveness Raview December 1115, the Regulatory Effectiveness Review (RER) was conducted at the Harris Site. No significant findings resulted from the review.-

8.

Turkey. Point On December 13, security personnel at the Turkey Point Nuclear Plant found remnants of several suspected marijuana cigarettes inside the Protected Area. The security personnel were reacting to a report from a plant employee of " suspicious behavior" of a contractor employee. Tests sub.

sequently confirmed the presence of marijuana in the cigarettes, and the licensee identified four contractor employees who had been working in the area. Plant access was suspended for all four individuals, and they were required to submit to drug testing. Test results for one individual were positive for :narijuana and cocaine. The licensee's investigation is continuing.

The licensee presented L comprehensive corrective action program.

Perry Nuclear Power Plant On December 11, 1989, Mr. H. J. Miller Director, Division of Reactor Safety, and members of his staff participated in a Region III Equipment Qualification (EQ) meeting at the O' Hare Airport Holiday Inn. The meeting was sponsored by the Cleveland Electric Illuminating Company for the l-purpose of identifying and discussing curent EQ issues. The NRC was l

invited to the meeting to provide the NRC's perspective on Region III EQ j

follow-up inspections and current EQ issues.

Byron Nuclear Power Station On December 12,1989,at11:58a.m(CST),anUnusualEvent(UE)was declared on Unit 1, which was operating at 94% power. The UE declaration resulted from a fire that started in the IB Condensate / Condensate Booster (CD/CB) pump motor while attempting to return the pump to service.

The station's fire brigade was immediately dispatched to the area and extinguished the fire. The UE was terminated at 12:35 pm.

While attempting to isolate electrical power to the affected IB CD/CB pump motor auxiliary pressure oil switch, the 1A CD/CB pump breaker was inadvertently opened, causing the lube oil pump to trip on indicated low lube oil pressure. Due to prompt action by control room operators, the breaker error was identified and corrected preventing the 1A 7

Zion Nuclear Power Station On December 8,1989, Dr. Carl J. Paperiello, Deputy Regional Administrator.

Mr. Thomas 0. Martin, Deputy Director, Division of Reactor Safety, and senior members of the Headquarters staff attended the Vendor Inspection Branch exit meeting with Commonwealth Edison Company representatives at the Zion Nuclear Power Station. The exit was conducted as part of a procurement team inspection that concluded that significant upgrades to the licensee's dedication program for utilizing commercial grade components in safety-

related applications were necessary.

Point Beach Nuclear. Power. Plant I

On December 11, 1989, two workers suffered steam burns to the upper portion of their bodies while performing maintenance on a heater drain pump discharge check valve. The check valve had been isolated and the upstream portion vented to the atmosphere. The downstream portion of the line between the check valve and the isolation valve could not be vented.

but was assumed depressurized through the leaking check valve. The steam release occurred during the process of removing the valve bonnet.

Both workers were transferred to a local hospital by ambulance.. OSHA was l

notified and arrived on site the following day. A Preliminary Notification (PN) was issued by the region, 8.

Fermi 2 Nuclear Power Station Augmented inspection coverage of Fermi 2 restart activities, which began on November 27, 1989, was terminated on December 13, 1989, following successful RCIC and HPCI surveillance testing at normal operating

Region IV Items of Interest Week Ending December 15, 1989 1.

Waterford Steam Electric Stationcunit 3 Representatives of the Louisiana Power & Light Company met on December 11, 1989, in the Region IV office for an enforcement conference. The purpose of the conference was to discuss licensee quality control inspection activities associated with fire seal work.

URF0 Meeting with DOE On December 12, 1989, the Director and URF0 technical staff met with DOE UMTRA Project Office representatives and contractors in Denver, Colorado.

The purpose of the meeting was to review the apparent saturated tailings situation at the Durango, CO, UMTRA Project disposal _ site in Bodo Cenyon.

Seeps have been observed in the tailings disposal area, and elevated con-centration levels for some constituents have been observed in two moni-toring wells. DOE's contractors reported on the studies they have con-ducted to date in determining the extent of the problem and also reported on the results of the pumping program utilized to eliminate free water from the tailings.

URF0 Meeting with Hecla Mining.PM The Director of URF0 and select members of the URF0 staff met on December 12, 1989, with the Hecla Mining Project Manager and discussed stabilization of their heap leach site in New Mexico. This site has been inactive since before 1985, and is being prepared for reclamation. During the meeting, plans for decommissioning, reclaiming of the site, and pos-sible relocation of the residual material were discussed.

Fort St. Vrain On December 10, 1989, Fort St. Vrain reinitiated defueling operations.

The licensee will proceed to place fuel in the fuel storage wells until its capacity (12 regions) is reached. Defueling elements (dummy fuel blocks) will be placed in the reactor to maintain structural stability during defueling operations. The licensee anticipates the defueling of the 12 regions to take until February 1990 to complete. Arrangements for offsite shipments of the fuel are uncertain at this time.

5.

Resident. Inspector Counterpart Meeting A resident inspector counterpart meeting was held in the Region IV office between December 12-15, 1989.

Featured speakers included Themis P.

Spies (RES), Charles J. Haughney (NRR), W. F. Kane (Region I), and W. Hall (NUMARC). The Region IV resident office assistants also meet in the Region IV office during this period under a separate agenda.

URF0 Meeting Concerning White Mesa Mill i

On December 13, 1989, the Director of URF0 and select members of the URF0 staff met with representatives of Umetco Minerals to discuss the design of Cell 4A at the White Mesa Mill in Blanding, Utah. The cell will be used for disposal of byproduct material and will be constructed to meet design criteria for high hazard dams. Construction is' essentially complete; however, NRC questions regarding probable maximum flood impacts on freeboard requirements will be explored during the meeting.

URF0 and Union. Pacific. Meeting A meeting is scheduled on December 14, 1989, between the NRC, Union Pacific, and Union Pacific contractors.

Discussions will center upon the reclamation plan at the Bear Creek uranium mill. The reclamation plan has been under NRC review for several months with some issues pertaining to long-term stability remaining unresolved.

8.

Shirley Basin. Mill Shutdown URF0 staff was informed via telecon on December 13, 1989 that the Pathfinder Mines Corporation's Shirley Basin Mill will cease operation on January 1,1990 and go into a standby mode. The shutdown is a result of current market conditions and is presently projected to last until at least August 1990, 9.

!vinson Nemorial Hospital Enforcement Conference An enforcement conference was held on December 15, 1989, between Ivinson Memorial Hospital and Region 1Y staff to review the findings related to an inspection conducted at the licensee's facility on October 26, 1989. The conference focused on the lack of management oversight of the radiation safety program resulting in a significant number of violations identified during this inspection. A number of l

violations were repeat violations from the previous inspection.

10. River. Bend Station Enforcement Conference The Senior Vice President, Gulf States Utilities, and members of his staff met in the Region IV office on December 15, 1989, for an enforcement conference. The discussion concerned the reactor power and flow oscillations that were induced by a malfunctioning recirculation flow control system on January 17 18, 1989, and were discovered by the i

The licensee is continuing work to place plant systems in a long term lay up condition; to locate and corract a minor Spent Fuel Pool leak; and to prepare and submit licensing correspondence to support their movement towards decommissioning.

These methodologies can have many forms (such as those used in NUREG-1150 and other probabilistic studies)-and, as the staff recognizes and experience-has shown, can become controversial.

Staff should submit a summary on the staff's current approach to dealing with uncertainties / methodologies in implementing the EPA probabilistic standard so as to avoid many of~the controversial aspects as possible..

Commissioner Curtiss expressed concerns regarding -- (1) the relationship of the NRC regulations in 10 CFR Part-60 to the x

EPA standard, noting in particular that the subsystem performance criteria contained in 10 CFR Section 60.113 appear to go significantly beyond merely' implementing the EPA standard and may, instead, amount to a separate-and potentially inconsistent environmental standardt (2)-the prescriptive.

nature of the requirements ir. 10-CFR Section 60.113 and the impact that these requirements may have on the ability of DOE to meet the EPA standard, albeit ita a manner that may depart from the exact balance of multiple barriers that would be-required under 60.113; and (3) the prospect that EPA is-j reportedly considering revisiting the containment requirements j
