Dear Ms. Weiss:

This is in reply to your letter dated June 24, 1981, in which you requested, pursuant to the Freedom of Information Act, copies of documents relating to Southern Boiler and Tank Works, Inc., including all reports on, evaluation of or references to materials manufactured by Southern Boiler and Tank Works, Inc. and incorporated or utilized in any facility licensed by the Commission. You also asked for copies of all segregable portions of otherwise exempt documents relat eng to Southern Boiler and Tank Works, Inc. In response to your request, we have identified the documents listed on Appendix A hereto as containing information on the subject of your interest. Copies of these documents were picked up by your messenger from our office on July 16, 1981. Documents one through five of Appendix B have also been identified as being subject to your request, and have already been made available for public inspection and copying at the NRC Public Document Room (PDR), 1717 H Street, N.W., Washington, DC 20555. The charge for reproducing records located in the POR is five cents ($0.05) per page, as specified in 10 CFR 9.14(a). Portions of document number si.x of Appendix B contain information which is confidential business (proprietary) information. This information is being withheld from public disclosure pursuant tc Exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4). Portions of document number seven of Appendix B contain information which constitutes advice, opinions and recommendations of the staff. This information is being withhcld from public disclosure pursuant to Exemption (5)(of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10CFR9.5(a)5). Documents 8, 9,10 and 11 of Appendix B contains information which constitutes advice, opinions and recomendation of the staff. W;iss - Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for the denial of documents 6, 7, 9,10 and 11 of Appendix B is Mr. Leonard Bickwit, General Counsel. The person responsible for the denial of document eight of Appendix B is Mr. Samuel J. Chilk, Secretary of the Commission.
