This refers to your letter dated August 28, 1980, In response to our letter

dated July 31, 1980.

Thank you for informing us of the corrective and preventive actions documented

,

in your letter with regard to the items of noncompliance contained in the Notice

'

of Violation enclosed with our letter of July 31, 1980.

These actions will be

examined during a subsequent inspection of your licensed program.

With regard to Item 3, contained in the above Notice of Violation, your response

to this item notes the corrective action taken by you to prevent a recurrence of

the situation which resulted in the item of noncompliance and contains a request

that this item be withdrawn for the reasons stated in the enclosure to your letter.

After careful consideration of your response to Item 3, we have concluded that

this item of noncompliance was found to be as stated in the Notice of Violation

and your request that this item be withdrawn is being denied for the reasons

explained in the attachment to this letter.

In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, documentation of your control and account-

ing procedures for safeguarding special nuclear materials and your facility

security procedures are exempt from disclosure; therefore, the attachment to this

letter and the enclosure to your letter, dated August 28, 1980, will not be

placed in the Public Document Room and will receive limited distribution.

Should you have any questions concerning the above, we will be placed to discuss

them with you.
