..r Summary of Weekly Information Report Week Ending October 3,1980 Salem 2 There is a significant potential for a delay of the emergency exercise for Salem, and a corresponding delay in the issuance of a favorable finding by FEMA.

Efforts by the utility over the last week to set a date for a meeting between ~ representa-l tives of PSE&G, FEMA, and the State and local authorities have been unsuccessful.

l South Texas Project On September 24, the ASLB issued a Memorandum and Order to implement the Commission's Memorandum and Order dated September 22. The ASLB has called for thc parties involved l

in the South Texas Project to review the I&E Show Cause Order and the applicant's response and make suggestions with regard to expanding or adding additional contentions, considering additional questions, and their effect on the current dis-covery completion date of December 1,1980, and the scheduling of a future prehearing conference and evidentiary hearings.

l NFS - West Valley l

The West Valley Demonstration Project Act was signed'by the President on October 1, 1980. The Act authorizes DOE to establish a program for solidifying the high level liquid wastes which are presently stored at West Valley.

j Waste Shipments Rejected at Beatty, Nevada, from UNC Rhode Island Facility The United Nuclear Recovery Systems of Uood River Junction, Rhode Island, is presently decontaminating their facilities and grounds preparatory to requesting termination of their SNM license. The State of Nevada refused to accept a recent shipment of waste on its way to Beatty from UNC after finding a leak in two drums and indicated that it will refuse five other UNC shipments in transit or at Beatty. The State of Nevada stated that all shipments are to be returned to United Nuclear.

State of Rhode Island officials questioned whether or not they should allow the shipments to ~come back into the state and are considering what action they will take on the other five shipments, such as refusing to allow the material to be returned to the United Nuclear facilities.

Recent actions by the Pennsylvania Public Utility Commission (PAPUC) to deny the request of the. licensee for emergency rate relief and further interpretations that prevent revenues received from rate j.

decline in work activities at TMI-2.

c-0FFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending October 3, 1980 Hearing on Disposal of Radioactive Waste in Oceans As a result of interest in disposal of radioactive waste in oceans, Congressman Toby Moffett, Chairman of the Subcommittee on Environment, Energy and Natural Resources, has scheduled a hearing on October 7,1980 in San Francisco, California.

Richard E. Cunningham will testify at the hearing on matters related to AEC licensing of ocean disposal of radioactive wastes.

Public Meeting of ACRS re Package Design Certification Process At the request of the Division of Fuel Cycle and Material Safety, a public meeting has been scheduled with the ACRS Subcommittee on Transportation for October 29, 1980. The purpose of the meeting will be to plan for an ACRS Subcommittee review of package design certification process conducted by the Transportation Certification Branch.

Staff Visit to Battelle Northwest and Exxon Nuclear Company Members of the Safeguards staff visited Battelle and Exxon Nuclear Comp'ny during the week of September 22. The Battelle-PNL visit was to review the results of several.value-impact analyses they are performing in support of the MC&A Upgrade Rule. They also met with representatives at Battelle-HARC to identify potential research activities in the area of maximizing the effective-ness of guard rasponse under emergency conditions and of maximizing the effective-ness of the MC&A system with respect to the interaction between required procedures and human factors considerations. The visit to Exxon Nuclear was for the purpose of obtaining information of the facility operations to be used in improving the safeguards regulatory base.

Waste Shipmeats Rejected at Beatty, Nevada, from UNC Rhode Island Facility As previously noted, United Nuclear Recovery Systems of Wood River Junction, Rhode Island, is presently decontaminating their facilities and grounds pi eparatory to requesting termination of their special nuclear material licens2.

During the decommissioning process, they are generating approximately 200 drums a day of waste which is being shipped to licensed burial grounds at Barnwell, South Carolina and Beatty, Nevada.

A recent shipment was received at Beatty and upon inspection it was noted that liquid had seeped out of the bungs on two drums.

The State of Nevada refused to accept this shipment and has indicated it will refuse five other UNC shipments in transit or at Beatty as well.

The State of Nevada stated that all shipments are to be returned to United Nuclear.

Upon hearing of this, State of Rhode Island officials questioned whether or not they should allow the shipments to come back into the state.

In fact, one truck returning to Rhode Island was stopped at the Connecticut /Rhode Island border on October 1 and was only allowed to proceed to United Nuclear when it was determined tha~t State of Connecticut law prohibited radioactive material in transit after 4:00 p.m.

State of Rhode Island officials are considering what action they will take on the other five shipments such as refusing to allow the material to be returned to the United Nuclear facilities.

Rhode Island officials are also trying to contact officials of the State of Nevada to see if they can convince them to allow the four trailers currently in Beatty to be disposed of at the NEC0 facilities.

Radiological Contingency Planning Visits Visits are being made to a number of fuel cycle and materials licensees to discuss radiological contingency planning.

Radiopharmaceutical suppliers visited included ' Abbott Laboratories, North Chicago, Illinois; Amersham Corporation, Arlington Heights, Illinois; and E. R. Squibb & Sons, New Brunswick, New Jersey.

In addition, visits were made to the two UF6 conversion plants:

1 Allied Chemical at Metropolis, Illinois; and Kerr-McGee at Gore, Oklahoma.

l Guidance for Vital Area Selection The final Statement of Work (SDW) for the technical assistance project entitled

" Guidance for Vital Area Selection" has been completed.

Safeguards teams spent two weeks. conducting p.eliminary field tests of vulnerability assessment. techniques at the North Anna power station during September 1980. After completing further field tests, the staff plans to conduct a program of safeguards assessments at power reactors, similar to that conducted at fuel cycle facilities in the past.

The following Notification of Significant Enforcement Action was dispatched during the past week:

EN-80 47 Confirmatory Orders for Licensees' Responses to IE Bulletin 80 On October 2,1980, Confirmatory Orders were sent to 10 licen-sees for 1E facilities to formalize commitments from the licensees for certain actions in response to IE Bulletin 80-17, " Failure of 76 of 185 Control Rods to Fully Insert During a Scram at a BWR."

The Bulletin and its supplements were issued to initiate short term and interim actions to assure reliability and availability of the GE BWR control rod drive scram system subsequent to the failure to scram event at Browns Ferry Unit 3 on June 28, 1980.

In the case of the 16 reactors, the affected utilities did not provide an acceptable response to an NRC Bulletin which requested additional assurance of ability to scram. Additional communication by the NRC with each utility resulted in acceptable commitments to assure the ability to scram.

Consumers Power Company (Palisades) - On September 30, 1980, the Commission received a check in the amount of $16,000 from the subject licensee in full payment of the proposed civil penalty issued on September 16, 1980.

ITEMS OF INTEREST OFFICE OF INTERNATIONAL PROGRAMS WEEK ENDING OCTOBER 3, 1980 Arrangement Renewed Commissioner Hendrie, on September 29, 1980, signed the five-year information exchange and cooperation renewal arrangement with Messrs. Jens Kampmann and Per Suhr, Director and Office of Energy Chief, respectively, of the Danish Agency for Environmental Protection.

Foreign Assignees at NRC IP has received acceptance for an on-the-job training assignment for Dr. Jiri Semecky, A Czech national, from the Office of Nuclear Reactor Regulation, Structural Engineering Branch.

Dr. Semecky has been recommended to NRC by the International Atomic Energy Agency through the National Research Council.

This assignment has been discussed informally with the Department of State and no objections have been raised. An official letter of invitation, signed by the Executive Director for Operations, will be sent through State Department channels when administrative details for the Essignment are completed.

Meeting with Canadian Officials on Export Matters l

On Thursday, September 26, representatives of State, DOE, Commerce, and NRC (IP) met with Canadian officials from Atomic Energy of Canada Limited (AECL) and the Department of Industry, Trade & Commerce to discuss the transfer of US-origin components and technology to Romania, via Canada, for ultimate use in the Canadian-built CANDU nuclear power facility Cernavoda I.

At the meeting, the Canadian officials were provided with a detailed explanation of U.S. export control requirements for Romania. With respect to NRC-licensed components, it was indicated that a consolidated export license application covering all US-supplied components would be submitted in the near future.

WEEK ENDING OCTOBER 3,-1980 An AE0D report was issued on September 30, 1980 on the interim equipment and

. procedures at. Browns. Ferry to detect water in the Scram Discharge Volume (SDV)

Headers. As discussed in the report, AEOD found that: (1) the interim instru-mentation and related procedures being used to detect and respond to the pre-sence of water in-the SDV at Browns Ferry are generally adequate to protect against all currently identified. sources of water except for a potentially rapid inflow from the scram outlet valves arising from degraded air pressure l-in the Hydraulic Control Unit air header; and (2) any proposed interim equipment and procedures to be used to protect against the degraded air condition must address the very limited time available to the operator for corrective action.

AE0D has recommended that the degraded air. system issue be promptly addressed by NRR and IE to rectify the current deficiencies. A copy of the report has been sent to NRR and IE for information and appropriate action.

A progress meeting was held October 2 at the Nuclear Safety Information Center (NSIC) on the development of the LER Sequence Coding and Search Procedure.

When fully implemented, this system will provide,.in a computer retrievable form, failure data and information covering not only the principal occurrence in each event,'but also related component and system responses which are asso-ciated with the principal. occurrence.. This program will permit a systematic search for such items as common cause failures and complex system interactions,.

as well as collating the data for trend and patterr analyses. To date, NSIC has developed most of the coi.guter software and hcs encoded about 100 events on a trial basis' and is now verifying the acceptability of computer search strategies'.

Formal presentations and workshops on this system are being scheduled for NRC personnel;in mid-October and for industry organizations in late November.-

Discussions were held between AEOD and EG&G (Idaho) on their operational data assessment activities and on-the LER Sequence Coding and Search Procedure.

It was indicated that AE00 intends to survey several' potential organizations re-garding their interest and capability to routinely implement this procedure after it is fully developed and verified.
