Gentlemen:
Thank you for your letter of October 8,1980, concerning your response to
our Inspection Report 80-32 asking for re-evaluation and dismissal of an
apparent item of noncompliance.
Upon review of your response, we accept your explanation of circumstances
beyond your control concerning the conduct of the motor carrier.
Consequently,
we are amending our findings to withdraw our item of noncompliance as being a
matter more properly under the jurisdiction of the USDOT.
