l l The following information is submitted in response to NRC Inspection Report 80-32, concerning one Severity Leve.1 IV Noncomoliance.

SEVERITY LEVEL IV NONCOMPLIANCE As required by 10 CFR 71.5, no licensee shall deliver licensed material to a carrier for transport unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR Part 170-189.

49 CFR 172.504 states that "each motor vehicle...must be placarded on end and each side...".

Contrary to the above, on July 31, 1980, the licensee delivered low level radioactive material via the Home Transportation Company Trailer

  1. 003 (SSR #21693) to the Chem Nuclear burial site without a " Radioactive placard on the front of the trailer or on the front of the Tractor (#2-l 319).

RESPONSE

We have reviewed our shipping records for the subject shipment. At the time of delivery from Georgia Power Company to Home Transportation Company, the shipment was in full compliance with DOT requirements, including 49 CFR 172.504. Certi'ication of proper placarding had been signed by an authorized represeatative of Georgia Power Company and by the driver of the Home Transportation Company vehicle.

By letter of October 3,1980, Home Transportation Company notified the South Carolina Department of Health and Environmental Control that the driver of the subject vehicle had inadvertently failed to return the placard to proper position after reconnecting the cab and trailer in the Home Transportation Company's yard approximately 1/8 mile from the burial site. The driver had disconnected the trailer to drive the cab I to Barnwell to eat.

We therefore request that this item of noncompliance be re-evaluated and dismissed.
