of the Forum Building, Harrisburg, to discuss the draft PEIS. Participating in i

GA0 has provided clearance on the reporting forms and instructions needed for implementing 10 CFR Part 75 and the Safeguards Agreement. Consequently, the i

i Executive Branch has informally been notified of this approval. Staff is preparing a letter to the State Department advising them that NRC is now ready to initiate uhe implementation of the US/IAEA Safeguards Agreement in our eligible licensed facilities.

IE Bulletin Supplement 3 to IE Bulletin 79-018, " Environmental Qualification of Class lE Equipment," was issued on October 24 to all power reactor facilities with an opera-ting license.

Anal _vsis of Arkansas Nuclear One Event AEOD has completed its analysis of the April 7,1980, Arkansas Nuclear One event involving the loss of offsite power (Arkansas Nuclear One is a two-unit site having a B&W (Unit 1) and CE (Unit 2) nuclear steam supply systems). The analyses and

evaluation of the event and the natural circulation response of each unit identified both procedural and design deficiencies. The most important findings, which may be generic to other operating plants, were:

susceptibility to loss of offsite power due to a single failure 3

in the switchyard; 2.

improper emergency feedwater pump suction alignment; 3.

lack of uniform natural circulation criteria and operator 4

understanding and recognition of natural circulation conditions; and 4.

Uranium Recovery Operations Description - The Commission, in its review of license applications, renewals, and modifications requires the technical assistance of a contractor te assist in the development of environmental appraisals and impact state,nents. The effort requires a re-view of applicants' submittals and the preparation of an environmental assessment. The assessment, along with other data, will be furnished in a technical evaluation report. The contractor shall additionally be prepared to respond to public ccmment on these assessments and to possibly collect actual field data on some sites.

4 DIVISION OF SECURITY Week Ending October 24, 1980 Federal Republic of Germany The Federal Minister of the Interior, Federal Republic of Germany (FRG) has responded to a draft agreement developed by the Division of Security for the exchange of classified National Security Information between the Federal Min-ister and the Nuclear Regulatory Commission.

This proposed agreement was developed at the request of the Office of International Programs (IP).

Due to proposed changes made in the initial draft by the FRG, the Division of Security has provided IP with appropriate information for further communication with the FRG.

Allied Security Guard Contract On November 1,1980, the Facilities and Systems Security Branch (FSSB) coor-dinated the change-over in contract guard services from ENSEC Service Corpora-tion to Allied Security Inc. of Maryland. Allied Security will be performing guard duties in the Maryland National Bank Building, East-West Towers, Willste Building, Nicholson Lane and the Lugenbeel Building under the direction of FSSB.

IAEA Access to NRC Classified Information Amendments to 10 CFR Part 95, " Security Facility Approval and Safeguarding of National Security Information and Restricted Data," permitting NRC licensees to grant international Atomic Energy Agency (IAEA) representatives access to NRC classified information as required by their visits to NRC-licensed facilities under the U.S./IAEA Safeguards Agreement have been prepared.

The revisions were circulated to concerned Office and Division Directors for concurrence.

3 Reactor Decay Heat Coolinc.

Reactor coolant system (RCS) temperature parameters continue to remain at approximate steady state values (sce plant status section).

On three occassions during the week incure thermocouple temperatures decreased approximately 5'F.

It appeared a small amount of natural circulation flow occurred in the RCS.

The Loss of Decay Heat to Ambient Test is expected to start early next week.

Initial temperature changes are anticipated to be extremely slow due *o already established equilibrium between decay heat input and loss t' ambient output in the RCS.

On Tuesday, October 28, 1980, J. Collins attended a luncheon treeting of the Steelton Kiwanis to discuss the contents of the draft Prograr:matic Environmental Impact Statement (PETS) and status of cleanup operations at TMI-2.

One of the major concerns expres' ed by those who attended the meeting was the schedule for poi ible restart of TMI-1, 2.

On Wednesday, October 29, 1980, B. Snyder, J. Collins, P. Leech, O. Lynch, C. Hickey, L. Chandicr and T. Elsasser held a public meeting at Havre de Grace, Maryland to discuss the contents of the draft PCIS.

The major concern expressed by those who attended the meeting was the potential adverse environmenta7 effect on the lower Susquehanna River and the Chesapeake Bay which might result frcm activities related to the cleanup of TMI-?.

There was universal opposition to the dumping of any processed radioactive waste water into the Susquchanna River.

Many people voiced the opinion that radioactive releases to the river, no matter how small, would have adverse effects on the shell fish and fishing industries in the Chesapeake Bay.

On Friday, October 31, 1980, J. Collins, T. Elsasser, W. Kirk, EPA, and T. Gerusky, DER, met with the Lehanan valley Chamber of Conmerce to discuss the contents of the draft PEIS.

Those who attended the meeting expressed serious concern abnut the possibility of a one year delay until TMI-l would be restarted.

It was the opinion of those at the meeting that a delay of this nature would have very serious adverse financial impact on central Pennsylvania.

Methods of petitioning the NRC Connissioners for relief from the current shut down order were discussed at some length.

It is most probable that as a result of this meeting the Com:nissioners will be contacted by area Chambers of Commerce on this issue.

OFFICE OF STANDARDS DEVELOPMENT IMPORTANT EVENTS FOR THE WEEK ENDING OCTOBER 31, 1980 1

Me:nber State Comments on IAEA Draft Safety Guide By letter dated October 28, 1980 from Joseph D. Lafleur, Jr. to John Trevithick of the Depar'. meat of State, Member State comments are being transmitted to the IAEA on an IAEA draft safety guide entitled " Organization for Quality Assurance in Nuclear Power Plants" (SG-QA7).

SG-QA 7 does not conflict with U.S. policy or practice with regard to the quality assurance organization in nuclear power plants.

Having been involved in and satisfied with the development of the subject Safety Guide, we are recommending that the guide be approved for issuance by the I AEA subject to incorporation of certain comments.

SG-QA7 contains provisions intended to meet the objectives and requirements of the parts of the IAEA Code of Practice on Quality Assurance for Nuclear Power Plants related to the quality assurance organization in nuclear power plants. Although there is no single corresponding U.S. document, the contents of SG-QA7 are generally comparable to the information found in a number of ANSI quality assurance standards. Such standards include ANSI /ASME N45.2-1977,

" Quality Assurance Program Requirements for Nuclear Facilities", ANSI N45.2.6-1978,

" Qualification of Inspection, Examination, and Testing Personnel for Nuclear Power Plants", and ANSI /ASME N45.2.23-1978, " Qualification of Quality Assurance Program Audit Personnel for Nuclear Power Plants."

Regulatory Guides to endorse these standards have been prepared by the NRC. The principal difference between the IAEA Safety Guide and U.S. practice is that many of the provisions in the IAEA Safety Guide are less detailed than corresponding provisions in the ANSI standards.

Thus, the user of the IAEA Safety Guide is left with more discretion with regard to the implementation of the Safety Guide's provisions.

Description : The guide describes a method acceptable to the NRC staff for complying with the Commission's regulations to provide instrumentation to monitor plant variables and systens during and following an accident so that the plant operator can be adequately informed in order that mitigating actions can be taken when necessary.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending October 31, 1980 Transportation Certification Branch Package Review Process An ACRS meeting concerning the independent review of the Transportation Certification Branch package review process was held on October 29. 1980.

Staff members from the Division of Fuel Cycle and Material Safety met with the Subcommittee on Transportation of Radioactive Materials to discuss the scope of a possible independent evaluation sf the Transportation Certification process to determine if the NRC staff reviews provide reasonable assurance that package designs will meet Part 71 requirements. The Subcommittee review was requested by NMSS and the Subcommittee appeared to be in favor of performing the review.

French Team Visit On October 23, representatives of NMSS met with a six-member team from France concerned with regulation of Frerch fuel cycle activities. Descriptions were provided of U.S. regulatory procedures and safety and environmental criteria affecting fuel fabrication, fuel reprocessing and waste disposal.

New York State Advisory Committee Meeting On October 27, two members of the NMSS staff attended a meeting in Albany, New York, of the Advisory Canmittee on Radioactive Materials in the Environment.

This Committee was convened by the New York State Commissioner of Health in 1979 to advise the New York State Depcetmont of Health in assessing the health risks associated with areas of the state where radiation levels are above back-ground because of man's activities and in developing a strategy for dealing with problems where required.

Other Federal agencies participating on the Committee are EPA and 00E.

At this third meeting of the Committee, the following items were discussed although no concrete recommendations were formulated:

1.

A briefing on the status of the DOE-MED sites located in New York State.

2.

Status of the investigation of large tailings piles in northwestern New York, which were generated from non-nuclear activities and which contain above background quantities of natural radionuclides.

The handling and disposal of low level radioactive wastes.

4.

The rationale and methodology used by the NMSS staff to develop Ad-Hoc criteria to decontaminate the soil in an area adjacent to the NFS facility in Erwin, Tennessee.

5.

Rationale and any prospective guidelines from EPA and/or NRC for allowing re-entry into an area after the public has been evacuated because of radiological emergency.

6.

A working draft of a paper related to potential increased exposure of the public to radon due to the sealing of homes for energy conservation measures.

No definite date was set for the next meeting but a tentative time of about six months from this date was estimated.

Implementation of US/IAEA Agreement GA0 has provided clearance on the reporting forms and instructions needed for implementing 10 CFR Part 75 and the Safeguards Agreement.

MC&A Uograde Rule A preliminary draft of the MC&A Upgrade Rule for Category I facilities was circulated for staff comments.

TASTEX Steering Committee Mr. C. N. Smith represented the NRC on the U.S. team at the 4th TASTEX Steering Connittee meeting in Tokyo, Japan on October 20 - 28, 1980. The TASTEX program involves thirteen projects dealing with material control and accounting and containment and surveillarce measures at the Tokai Reprocessing Facility in Japan.

la Crosse Boilina Water Reactor On October 29, 1980, the Appeal Board issued a Memorandum and Order in this proceeding on an application for an amendment of a provisional operating license to permit an expansion of the spent fuel pool.

The Appeal Board affirmed the Initial Decision of an ASLB which had authorized the issuance of the amendment (LBP-80-2). The Appeal Board, however, retained jurisdiction over a referred ruling of the ASLB relating to the jurisdiction of the ASLB to determine whether, in a spent fuel pool expansion proceeding, there was a present need for the power generated by the facility.

The Appeal Board will deal with this jurisdictional question in connection with its review of a sim-ilar matter in the Big Rock Point Nuclear Plant proceeding.

ITEMS OF INTEREST OFFICE OF INTERNATIONAL PROGRAMS WEEK ENDING OCTOBER 31, 1980 Briefing for Embassy Personnel On October 29 ELD, OGC, and IP held a briefing for interested foreign Embassy staff members on nuclear export licensing matters from an NRC perspective.

Approximately 20 foreign countries were represented at the briefing.

Topics co/ered included (1) a recapitulation of the applicable statutory provisions for nuclear exports; (2) the NNPA criteria applicable to NRC-licensed exports; (3) consideration of health, safety and environmental matters in exports; (4) possible future export licensing developments; and (5) steps taken to expedite the export licensing process.

Proocsed Revision to Suoplier's Guidelines Trigaer List On 0.tober 24 IP representatives attended an interagency meeting at the State Department to discuss proposed revisions to the Suppliers Guidelines export control trigger list.

It was agreed, in view of recent developments involving Pakistan and other countries, that initial efforts should be focused on adding appropriate enrichment and reprocessing facility components to the trigger list.

DOE md ACDA were assigt.ed the responsibility of preparing pacers in these areas and another meeting of the group was scheduled tentatively for late November.

Taiwan Reactor Exports On October 28 IP representatives attended a meeting with State Department and Westinghouse officials concerning Westinghouse's proposed export of two power reactors to Taiwan (Taipower 7 and 8). The discussion centered around the timing of Executive Branch and NRC review of the pending export license application in view of Taiwan's stipulation that an export license must be issued by March 25,1981 if U.S. vendors are to be allowed to compete for the order.

IAEA Assignment Betty Wagman, FIPB, left on Wednesday, October 29, to begin a one year cost-free export assignment as a Technical Editor at the IAEA Headquarters in Vienna, Austria.

For the next 12 months, Mrs. Wagman wil' be assisting in the preparation and publication of nuclear safety guides and standards (NUSS Program).

On October 23rd, Bill Menczer and Jim Montgomery, RSLO's for Regions III and IV respectively participated as speakers d. ring a meeting in Iowa City, Iowa, of State radiological health representatives from various Region III and IV States. Bill addressed topics concerning emergency response planning and State surveillance of radioactive materials transportation.

On October 28, 1980, William Menczer, RSLO, Region III accompanied the directors of the Illinois Emergency Services and Disa;ter Agency, Department of Nuclear Safety, and FEMA Plans and Preparedness, Region IV, to various locations within the State of Illinois to observe the conduct of an exercise of the Illinois emergency plan for radiological assistance (IPRA) for the Dresden station. On October 29, 1980, Bill met wit'i the Regional Advisory Committee observers in Morris, Illinois to discuss the exercise and attend a critique of the exercise along with other Federal, State, and local ~ officials.

The next day Mr. Menczer participated in a public meeting in Morris, Illinois to discuss the IPRA.

Representatives from the Regional Advisory Committee, State and local governments, news media, and the public were present. As a result, the RAC Region 5 found that the endorsed Illinois Plan for Radiological Accidents were adequate to prntect the public health and safety, i

ITEMS OF INTEREST WEEK ENDING CCTOBER 31, 1980 AE00 has completed its analysis of the April 7, 1980 Arkansas Nuclear One event involving the loss of offsite power (Arkansas Nuclear One is a two unit site having a B&W (Unit 1) and CE (Unit 2) nuclear steam supply l

systems). The analyses and evaluation of the event and the natural cir-culatien response of each Arkansas Unit identified both procedural and design deficiencies. Some of these findings, which may be generic to other operating plants, were. considered of sufficient importance that AE00 recommended that NRR give them prompt consideration for corrective action. The most important findings were: (1) susceptibility to loss of offsite power due to a single f ailure in the switchyard; (2) improper emergency feedwater pump suction alignment; (3) lack of uniform natural circulation criteria and operator understanding and recognition of natural circulation conditions; and (4) continued unavailability of the Arkansas Unit 2 turbine-driven emergency feedwater train. The other findings which may not be related directly to plant safety or which require a long lead tima to complete were considered by AE00 to be important for additional consideration, but at a lower priority. Specific recontendations concern-ing all the findings have been identified in the report which has been dis-i tributed and forwarded to NRP ~

1ppropriate action.

A presentation on AEOD funct...;, organization, and work activities was mue to the Region III senior site representatives on October 30, 1980. Because of the newness of AE00 and the relationship between AE00 and the site offices, such presentations and associated discussions are considered an important aspect towards establishing effective coniunication channels and assuring mutually supportive efforts. The presentation covered: current AEOD activities to develcp LER sequence coding techniques needed for trend and pattern identifi-cation; status of AE00 actions on identifying needed changes in NPRDS and LER systems for event reporting; the AE00 procedures and philoscphy for reviewing operating events and judging significance; and identificaticn of the sixteen case studies that are now in progress.

Similar presentations will be scheduled for senior site representatives in other regions.

"I continue to feel that we should require assurances from the countries receiving source naterial that the end use is non-nuclear.

However, because the Commission position in SECY-78-368 was to the contrary, I see no basis for disapproving the requested license in this case in view of the relatively small amounts and absence of proliferation concerns in this country."

This is to advise you that the Commission (with three Ccmmissioners approving and Commissioner Gilinsky disapproving) has approved your recommendation for Alternative 3, i.e, the establishment of an NRC review group consisting of NRC members who would seek the advice of outside expert consultants.

In addition, the Commission desires that the review group include some government members from outside NRC, such as from NASA or the National Sureau of Standards.

The Commission has also approved the proposed Review Group Charter as modified in the attached mark-up.

In connection with his disapproval, Commissioner Gilinsky provided the following comment:

"I have changed =y mind and have decided to go along with the ACRS recommendation. "
