Dear Mr. Grier:
With reference to the inspection conducted by Mr. J. Serabin of your office on May 14-16, 1980 at the James A. FitzPatrick Nuclear Power Plant, and in accordance with the provisions of Section 2.201 of Part II of Title 10 of the Code of Federal Regulations, we are submitting our response to Appendix A Notice of Violation transmitted by your letter dated August 14, 198C as received by the undersigned on August 18, 1980.
APPENDIX A NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on May 14-16, 1980 it appears that one of your activities was not conducted in full compliance with NRC regulations and the conditions of your license as indicated below. This is an infraction.
Environmental Technical Specification 2.3.B, " Airborne Effluents",
states in Section 2, "The release rate of halogens and particulates with half-lives greater than eight days released to the environs as part of airborne effluents shall not exceed a rate Q in curies /see of I-131 equivalent such that:

Contrary to the above, over a period of 26 hours3.009259e-4 days <br />0.00722 hours <br />4.298942e-5 weeks <br />9.893e-6 months <br />, on May 12-13, 1980, the gaseous release rate of halogens and particulates exceeded the~ Technical Specification limit by a factor of 1.3.

RESPONSE-The FitzPatrick Plant staff acknowledges this as an item of noncompliance which was a licensee identified item reported to your
]
office via the OPX System and subsequent LER 80-041.
On M2y 13, 1980 shortly after the plant staff became aware of the Technical Specification violation the following corrective actions were taken to reduce the release rate of I-131:
1)
The refuel floor and reactor building normal ventilation system was isolated.to prevent release of I-131 through these pathways.
2).
The Standby Gas Treatment System was put into service (trains A and t
B) in order to filter the refuel-floor atmosphere through HEPA and charcoal before discharge to the environment via the plant. stack.
3)~
A polyethylene " tent" was built to cover the spent fuel pool, reactor' cavity and equipment storage pit on the refuel floor in order to reduce the amount-of I-131 release from the water phase to the building atmosphere.
4)
Charcoal filter units, capable of drawing 16,000 CFM, (four units at 4,000 CFM each) were installed.co draw suction-from under the polyethylene " tent".on the refuel floor in order to collect the I-131 in the gas phase.
