EA 89-209 During the ~ Nuclear Regulatory Conmission (NRC) inspection conducted on September 7-11,1989, violations ' of NRC requirements were identified.
The violations involved a deficient procedure which led to an event in which the containment spray system was overpressurized and failure to report the event to NRC as required.. In accordance with the " General Statement of Policy and n
Procedure. for NRC Enforcement Actions," 10 CFR Part 2 Appendix C (1989), the violations are listed below:

Technical Specification 6.8.1 requires that written procedures be established for the - activities recommended in Appendix A of Regulatory Guide 1.33, Revision 2 February 1978.
Appendix A of that Regulatory Guide specifies procedures be eetcMi..mc for surveillance tests.
Contrary to the above, as of September.5,1989, Procedure PT/2/A/4208/02 (NS Valve. Stroke Timing - Quarterly on Valve 2NS-18-A) was inadequate in that the procedure did not specify plant condition limitations or caution the operators of the potential for overpressurizing low pressure systems.
On September 5,1989, valve 2NS-18-A was opened in accordance with that l procedure, allowing an overpressurization,of "A" train of the containment spray system and a resultings spill of radioactive contaminated water into the auxiliary building.
This is a Sever'ity 'i.evel IV violation applicable to Unit 2 only l

"10 CFR 50.72(b)(1)(ii)(A) and (B) require that the licensee shall notify the NRC as soon as practical and in all cases within one hour of the
-occurrence of any ev.ent that results in the nuclear power plant being:

1.
in an unanalyzed condition that significantly compromises plant safety, or l
2.
in a condition that is'outside the design basis of the plant.
Contrary to the above, on September 5,1989, an event occurred on Unit 2 at 4:09 p.m., in which the "A" train of the containment spray system was accidentally pressurized to 325 psig while the system design pressure was 220 psig.
The NRC was not notified of the event within one hour as required.
This is a Severity Level IV violation applicable to Unit 2 only (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including 8912070095 891122 PDR ADOCK 05000369 Q

(1) admission or denial of the violation, (2) the reason for the. violation if admitted. (3) the corrective steps which have been taken and the results achieved. (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.
Where good cause is-shown, consideration will be given to extending the response time.
