Combined Inspection 50-289/79-19; 50-320/79-25

This refers to your letter dated February 5,1980, in response to our letter

dated January 14, 1980.

After careful consideration of your response, we conclude that the items of

noncompliance did occur as described in the Notice of Violation with regard to

Item 2, for which you have taken exception to the validity of the assessment

of noncompliance.

Your February 5, 1980 letter and attachment contain statements to which we

wish to respond.

Our detailed response to those statements, which bear directly

on the item of noncompliance, are contained in the enclosure to this letter.

Since your letter does not mention any corrective steps which have been taken

by you regarding the item of noncompliance, Item 2, discussed above, we again

ask that you submit to this office within twenty (20) days of your receipt of

this letter, a written response to Item 2 of the Notice of Violation in accor-

dance with Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10,

,

Code of Federal Regulations.

Thank you for informing us of the corrective and preventive actions documented

in your letter with regard to Item 1, contained in the Notice of Violation

enclosed with our letter of January 14, 1980.

These actions will be examined

during a subsequent inspection of your licensed program.

In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, documentation of your control and ac-

counting procedures for safeguarding special nuclear materials and your facility

security procedures are exempt from disclosure; therefore, the enclosure to

this letter and the enclosure to your letter, dated February 5,1980, will not

be placed in the Public Document Room and will receive limited distribution.
