Joseph F. Scinto, Deputy Director, Hearing Division The Staff attorneys have, through recollection, screened all likely candidates in which there was a possibility for the mention of WASH-1400 in the product of this office (pleadings, proposed findings, argumen ts ). We have uncovered the following:
San Onofre 2 and 3 (CP) - In proposed findings (on the exclusion area remand), June 21, 1978, referencing testimony on breathing rates which mentions rates in WASH-1400.
Monticello - We believe that Intervenor sought to introduce WASH-1400 and we opposed at the hearing.
Transcripts are being checked.
Erie - On October 20, 1977, we denied reliance on WASH-1400 in assessment cf applications for commercial nuclear power reac tors. We noted, however, that the FES might (as is the practice) mention WASH-1400 as an independent study which happens to reach the same conclusion as the Staff that Class 9's are not credible.
We have not reviewed the evidence - SER's, FES's, testimony, exhibits, discovery responses - to determine all instances in which the Staff used WASH-1400.
We assume that this will be covered by NRR's review; but we note that:
(1) The Gotchy testimony, coal v. nuclear, relies on WASH-1400 for the estimate of health effects due to reactor accidents.
(2) The Gotchy testimony on Radon (and Health Effects) relies on WASH-1400 risk estimators.
(There is, in fact, an independent basis to support these values.)
(3) The Generic Issues materials for River Bend purposes mention (and are phrased to suggest reliance on) WASH-1400.
We filed on 11/17/78 in North Anna a denial of reliance on WASH-1400 for TAP 37.
