January 12, 1979 Note to Thomas F. Engelhardt This will record the report I gave you orally concerning the completion of the Hearing Division's review of the use of WASH-1400 in our pleadings.
Our review was completed by the end of Nc/ ember. There was no OELD use of WASH-1400 other than those mentioned in my note to Jim Kelley dated November 17, 1978. With respect to Monticello, the record was checked and the mention of WASH-1400 in this case refers to the Ccmmission's policy statement that it should not be relied upon.
In North Anna, we are filing further pleadings denying reliance on WASH-1400.
Per Mr. Shapar's request, I informed NRR of those places identified in my note of November 17, 1978 as instances in which NRR may have used WASH-1400. After Barry Smith reminded me, we also informed NRR that in connection with fire protection we have relied upon the Review Group Report which in turn mentions WASH-1400. The points we noted are all covered by the NRR review attached to SECY-78-637.
