Dear Mr. Grier:
With reference to the inspection conducted by Mr. T. Stetka of your office on September 10-20, 1979, at the James A. FitzPatrick Nuclear Power Plant, and in accordance with the provisions of Section 2.201 of Part II of Title 10 of the Code of Federal Regulations, we are submitting our response to Appendix A, Notice of Violation, Infraction B, transmitted by your letter dated Noveiiiber 1,1979, as received by the undersigned on November 7, 1979.
APPENDIX A NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on September 10-20, 1979, it appears that certain of your activities were not conducted in full compliance with conditions of you. NRC Facility License No. OPR-59, as indicated below.
INFRACTION B.
Technical Specification 6.8(A) states, in part:
" Written procedures and administrative policies shall be established, implemented, and maintained..."
Procedure F-0P-14, entitled, Core Spray System, requires, in Table I, Valve Lineup, that valve number CSP-716B, Torus Suction Line Drain, be locked closed.
Contrary to the above, on September 12, 1979, valve CSP-716B was found to be closed but not locked closed as required by Table I of F-0P-14] g 4 g ) ]

NRC I&E INSPECTION N0. 79-14 Page RESPONSE TO INFRACTION B The FitzPatrick Plant Staff acknowledges that valve CSP-716B did not have a locking device attached to it in such a manner as to prevent opening of the valve without removal of the locking device. The valve was in its proper position as noted by the Inspector, and the locking device was immediately placed on the valve in such a manner as to prevent openit.1g of the valve without removal of the lock and chain.
It should be noted that while the chain lock was present on the valve, the physical arrangement of the valve and its location resulted in the failure to detect that the chain and lock were properly installed.
To preclude further non-compliance in this area, the plant staff has surveyed the physical arrangement of the valve locking devices to insure that these devices can be and are, applied in such a manner as to maintain valves in the prescribed position unless the locking device is removed.
In addition, personnel performing valve lineups have been made aware of this item of non-compliance and instructed to carefully check that locking devices are properly applied where used.
These steps were taken during the same time frame as the corrective actions noted for Infraction A and full compliance was achieved by October 26, 1979.
