The Commission

  • discusred the class complaint of discrimination, and the recommendation of the Complaints Examiner, Federal Employee Appeals Authority (CSC) to accept that part of the complaint which met the applicable procedural requirements.

The Commission, by a vote of 4-0.**

Accepted the Complaints Examiner's recommendation to accept the Complainant as agent of a class of NRC employees.

The Commission expanded the class from all present NRC women employees to include all previous NRC women employees whose positions had been audited, The Commission also accepted the examiner's recommendation to limit the issues to whether NRC policy relating to auditing positions in response to requests for promotion has had a discriminatory impact upon women employees of the NRC; and (ELD /ADM) 2.

Requested that the Office of the General Counsel, the Office of Policy Evaluation and the Office of Equal Employment Opportunity develop a proposal for reviewing other allegations regarding discrimination including those in the complaint which were dismissed by the examiner as defective.

10/13/78 Commissioner Gilinsky's Views on the Women's Class Action Suit I supported the Commission's action in this matter because it was a step in the right direction.

However, as I stated at the meeting, I would have preferred to see the Commission take a larger step -- by further expanding the scope of the class action.

In a matter as sensitive as this, where distinctions may turn on subtleties, it seems to me that the only way for the Commission to assess the extent of any discrimination in hiring and promotion is for the matter to be looked into outside the agency.

While I am pleased to have the Commission itself address the broader issues, I

think that a full airing in an external forum of all the issues raised would have provided a more satisfactory basis for consideration of the broader allegations than will the results of the staff action requested.
