APPLICANT'S RF.SPONSE TO LETTER OF ANN WHARTON (JULY 4, 1979)

Applicant is in receipt of a letter from Ann Wharton dated July 4, 1979, requesting " permission to intervene" in the subject proceeding.

The letter does not, in even a minimal sense, meet the requirements of 10 CFR 52.714.

Morc importantly, however, Ms. Wharton previously filed a petition for leave to intervene pursuant to the Board's Corrected Notice of Intervention Procedures (4 3 Fed . Reg . 40328, September 11, 1978). That petition was denied. (Memorandum and Order, Feburary 9, 1979, pp. 74-76)

Having so petitioned, Ms. Wharton is not within the cate-gory of persons entitled to file petitions for leave to inter-Vene under the Board's " Supplementary Notice of Intervention .

Ms. Wharton's letter, if construed as a petition for leave to intervene, should therefore be denied.
