This is in response to your letter dated July 6,1979, regarding an item of
noncompliance which was forwarded to you by our letter dated June 21, 1979.
With respect to the subject item of noncompliance, it is our understanding,
based on a telephone conversation between yourself, fir. J. K. Thayer, and Mr.
D. V. Kehoe of this office on July 16, 1979, that your position is that Technical Specification 4.7.1.2.a.4 applies only to those manual valves in the flow path
of the Emergency Boiler Feedwater System which are not normally locked open.
He
further understand that the valve in question, DW-V-608, is a normally locked
open valve and therefore the subject technical specification does not apply.
Please be advised that your position with respect to this matter is being
forwarded to the Office of Nuclear Reactor Regulation for resolution.
Your
request that the subject item of noncompliance be withdrawn will be addressed
subsequent to resolution of this matter as stated above.
