CERTIFICATE OF APPROVAL NO. F/357/B(U)-96 FOR THE TN-MTR PACKAGE

Dear Mr. Boyle:

By letter dated March 5, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19115A127), as supplemented on June 12, 2018 (ADAMS Accession No. ML19169A035), the United States (U.S.) Department of Transportation (DOT) requested that the U.S. Nuclear Regulatory Commission (NRC) staff perform a review of the French Certificate of Approval F/357/B(U)-96 Revision Eah, for the Model No. TN-MTR transport package and make a recommendation concerning the revalidation of the package for import and export use. Specifically, you requested that the NRC only review the content in Appendix 9 to the French certificate for shipment of the Gisete 4, Gisete 5, or Gisete 8 radioisotopic thermal generators. The NRC staff performed an acceptance review of your application to determine whether the application contains sufficient technical information in scope and depth to allow the NRC staff to complete a detailed technical review per the International Atomic Energy Agency Specific Safety Requirements No. 6, Regulations for the Safe Transport of Radioactive Material, 2012 Edition.

This letter informs you that the application appears to contain the necessary information to begin our technical review. We have established a schedule for the technical review of your amendment request. The schedule allows for the staff to issue a possible request for additional information by the mid-September 2019, and a recommendation on DOT responding to a request for additional information by the end of November 2019. If no additional information is needed, the recommendation for revalidation and safety evaluation report may be issued the end of September 2019. The staff estimates that completing the safety review of this application will require approximately 250 staff review hours.

R. Boyle Chapter 2A - Appendix 10 contained in the TN Americas LLCs letter dated June 12, 2019 (ADAMS Accession No. ML19169A037), is marked as proprietary information; however, an affidavit requesting withholding and a non-proprietary version of the Chapter 2A - Appendix 10 was not provided. In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390(b), please provide an affidavit, which includes the information required by Title 10 of the Code of Federal Regulations, 2.390(b) and a non-proprietary version of the document.
