UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D. C. 20555 OFFICE OF NUCLEAR REACTOR REGULATION EVALUATION OF A RE VEST FOR EXTENSION OF CONSTRUCTION PERMIT NO. CPPR-158 FOR THE SHEARON HARRIS NUCLEAR POWER PLANT UNIT 1 DOCKET NO.
STN 50-400 Introduction On September 7, 1971, the Carolina Power 8 Light Company, tendered an application for a license to construct Shearon Harris Nuclear Power Plant, Units 1, 2, 3 and 4 (Harris or the facility) with the Atomic Energy Commission (currently the Nuclear Regulatory Commission or the Commission).
Following a public hearing before the Atomic Safety and Licensing Board, the Commission issued Construction Permit Nos.
CPPR-158, CPPR-159, CPPR-160 and CPPR-161 permitting the construction'f the Units 1, 2, 3 and 4, respectively, on January 27, 1978.
On June 26, 1980, the applicant tendered an application for Operating Licenses for the facilities.
By letter dated September 3, 1981, the Carolina Power and Light Company transmitted an application for amendments to the Construction Permits for Shearon Harris Nuclear Power Plants, Units 1, 2, 3 and 4 to add the North Carolina Municipal Power Agency Number 3 (Power Agency) as a co-owner.
The staff, by letter dated November 3, 1981, amended the Construction Permits to reflect the above changes in ownership.
Subsequently, by letter dated December 18, 1981, Carolina Power 5 Light Company notified the staff of the cancellation of Harris, Units 3 5 4.
By letter dated August 1, 1983 Carolina Power and Light Company filed an application for an amendment to the Construction Permits for Harris, Units 1
& 2, to reflect the name change of the co-owner from North Carolina Municipal Power Agency Number 3 to North Carolina Eastern Municipal Power Agency.
The Construction Permits were amended to show the name change by NRC letter dated June ll, 1984.
The Carolina Power and Light Company, by letter dated January 23,
- 1984, informed the staff of the cancellation of Harris, Unit 2.
By letter dated March 16, 1984, the permittees requested an extension of the construction comoletion date for Shearon Harris, Unit 1 from JIIne 1, 1984 to March 1, 1986.
Subsequently by letter dated January 29, 1986, the permittees filed a supplemental request for an extension of the latest construction completion date to June 30, 1987.

Discussion In the above cited applications for extension" of the construction completion date, the permittees indicated the following factors are the major contributors for the delay in the completion of construction activities:
1.
Revised Energy and Load Forecasts reflecting a slower rate of growth in customer demand than previously projected.
2.
Carolina Power and Light Company's Expanded Conservation and Load Management Proqram.
3.
The requested June 30, 1987 extension of the latest date for completion allows the permittees to complete construction, ensure that commitments and regulatory requirements have been met and to allow for contingencies such as delays in construction or licensing.
The NRC staff has reviewed the information provided in the permittee's submittals and has concluded that the factors discussed above constitute good cause for granting the requested extension.
As a result of the staff's review of the Final Safety Analysis Report to date, and considering the nature of the delays, the staff has identified no areas of significant safety consideration in connection with the extension for the construction completion date for Shearon Harris, Unit 1.
The only change proposed by the permittees to the existing construction permit is an extension of the latest construction completion date.
This extension will not allow any work to be performed involving a new safety concern of a type that was not considered by previous Comoission safety reviews of the facility and that is not already allowed by the existing construction permit.
Therefore, the staff finds that (I) the extension of the latest completion date in the construction permit does not involve a significant hazards consideration, (2) prior public notice.of this action is not required, (3) there is reasonable assurance that the health and safety of the public will not be endangered by the requested extension of the construction completion date, and (4) good cause exists for issuance ofan order extending the construction completion date.
Pursuant to 10 CFR 51.32, the staff has determined that this Order will not result in any significant environmental impact (51 FR 9731, March 20, 1986).
Conclusion For the reasons stated
- above, the staff concludes that issuance of an Order extending the latest construction completion date for the Shearon Harris Nuclear Power Plant, Unit I, as set forth in CPPR-158, to June 30, '1987, is reasonable and should be authorized.
