CONSENT TO CONFIRMATORYORDER MODIFYINGLICENSE (TAC NOS. MA4495 AND MA4496)
Dear Mr. Plunkett:
By letter dated Decemb'er 9, 1998, Florida Power and Light Company (FPL) informed us of the revised schedule commitment for implementing Thermo-Lag 330-1 fire barrier corrective actions at Turkey Point Plant, Units 3 and 4. Due to U.S. Nuclear Regulatory Commission (NRC) staff concerns that Thermo-Lag corrective actions have not been completed at Turkey Point Plant to date and to preclude any schedule slippage, we plan to modify the Turkey Point Plant, Units 3 and 4, licenses by order to make this commitment a requirement.
If FPL consents, we plan to incorporate the commitment into a Confirmatory Order Modifying License (Order) as follows:
Florida Power and Light Company shall complete final implementation of Thermo-Lag 330-1 fire barrier corrective actions at Turkey Point Units 3 and 4 described in the FPL submittal to the NRC dated December 9, 1998, by December 31, 2001.
By consenting to issuance of the Order confirming the above commitment, FPL is waiving its right to request a hearing on all or any part of the Order. You must sign, as noted on the enclosure to this letter, that you agree to such a commitment on behalf of FPL and return the enclosure within 10 business days from the date of this letter to Mr. Samuel J. Collins, Director, Office of Nuclear Reactor Regulation, U.S. Nuclear Regulatory Commission, One White Flint North, 11555 Rockville Pike, Rockville, MD 20852-2738.
After receiving your written consent, the NRC willissue the aforementioned Order.

Florida Power-and Light Company shall complete final implementation of Thermo-Lag 330-1 fire barrier corrective actions at Turkey Point Plant, Units 3 and 4, described in the Florida Power and Light Company submittal to the U.S.
Nuclear Regulatory Commission dated December 9, 1998, by December 31, 2001.
Florida Power and Light Company also agrees to incorporating this commitment into a Confirmatory Order Modifying License (Order) that will be effective immediately upon issuance.
I recognize that by signing below, Florida Power and LightCompany consents to the issuance of an immediately effective Order incorporating the above commitment and, by doing so, pursuant to 10 CFR 2.202(a)(3), Florida Power and LightCompany willnot have a right to request a hearing on all or any part of this Order.
