VERIFICATION OF SEISMIC ADEQUACY OF MECHANICAL AND ELECTRICAL EQUIPMENT IN OPERATING REACTORS; UNRESOLVED SAFETY ISSUE (USI) A-46, GENERIC LETTER (GL) 87-02, TURKEY POINT UNITS 3 AND 4, AND ST.
LUCIE UNIT 1 (TAC NOS.
- M68303, M68304 and M69483)
We have reviewed the May 5, 1994, submittal from Mr.
W. H. Bohlke, responding to our February 24, 1994, letter, which outlined a general framework of criteria which would satisfy the intent of USI A-46 for facilities located in regions with low seismic hazard.
Mr. Bohlke states that "FPL believes that further NRC requests for work, evaluations, or plant changes would provide no additional safety benefit to our nuclear facilities.
FPL requests that the NRC complete the review of our final reports and issue Safety Evaluation Reports...."
Please note that NUREG-1211, "Regulatory Analysis for Resolution of Unresolved Safety Issue A-46, Seismic Qualification of Equipment in Operating Plants,"

- 1987, states that The NRC will review the inspection procedure, inspection report, and the final report, and will audit all plant-specific reviews before final NRC approval.
Final NRC approval will be made in the form of plant-specific SERs."
Based on our review of your submittals, we cannot definitively conclude that the FPL program, as completed to date and as proposed, meets the intent of GL 87-02 or satisfies the general framework of criteria for sites such as FPL's, as outlined in our February 24, 1994, letter.
The primary FPL justification for not meeting GL 87-02 is the low safety benefit, due to the low probability and expected low intensity of Florida earthquakes.
We intend to evaluate the results of the FPL completed programs against the intent of GL 87-02 during our on-site team inspections of the seismic adequacy of the FPL nuclear facilities rather than pursue the issue through further exchange of documentation.
These inspections will include verification of your A-46 program implementation and our evaluation of the areas where we consider that the FPL program may not meet the intent of GL 87-02.
We will pursue any safety-significant deficiencies identified at that time.
Prior to the inspections, we intend to prepare 'and issue a safety evaluation for each facility discussing those areas where we agree that your program meets the intent of GL 87-02, and further documenting those areas where we are

still unable to conclude that you meet the intent of GL 87-02.
Following our inspections
- and, upon resolution of all outstanding
- items, we will issue SER supplements.
Please notify us when FPL has completed all actions on this issue to allow us to schedule our on-site team inspections, preferably in early 1995.
The inspection scope may include IPEEE related issues.
The TAC numbers will remain open pending the on-site inspections of the FPL program.
